I am the procurement lead of a foreign trade company, who has just taken over a batch of precision instruments imported from Germany. Previously we handled customs declaration in-house, but this time we plan to engage an import agency for assistance.

However, I am not sure whether the import agency service itself needs approval, for example, what qualification requirements apply to the agency firm. Besides, for goods of special categories such as medical devices, are additional approvals required? I heard from peers that some import agencies had their goods detained due to missing valid qualifications.

Our batch of goods follows a tight delivery schedule, and the loss will be huge if the process is stuck due to approval issues. I hope to clarify exactly which scenarios require approval and which do not, and how to confirm whether the import agency holds compliant approval qualifications.

First of all,it shall be made clear that import agency approvals are divided into two categories: the first is the record-filing approval for the agency entity, and the second is the import approval for special category goods. Under the national customs clearance integration framework in 2026,all enterprises conducting import agency business must complete customs declaration qualification record-filing at the General Administration of Customs Single Window. Entities without completed record-filing cannot undertake agency business, which is a basic statutory requirement.

For ordinary goods import agency, only the aforesaid record-filing completed by the agency is required,no additional approval is needed. If special categories are involved, such as medical devices, hazardous chemicals, endangered species and other goods, the agency only needs to ensure its own record-filing is compliant in line with the import license requirements of the goods themselves, while the special approval for the goods shall be processed by the entrusting party or assisted by the agency. The two shall not be mixed up.

A common misconception is that some enterprises mistakenly believe that the agency company needs industry-specific licenses. In fact, additional qualifications issued by corresponding regulatory authorities are only required for agencies involved in segmented fields such as bonded services and cold chain services, which are scenario-specific requirements rather than general approval. If the agency fails to complete the record-filing,the declaration will be rejected, resulting in declaration cancellation and re-submission,as well as extra costs such as port demurrage. It is recommended to verify the agency's record-filing status via the Single Window, which is the most direct verification method.

For final compliant implementation, qualification clauses shall be explicitly specified in the import agency agreement,a copy of the agency's record-filing certificate shall be retained, and the loss compensation liability caused by the agency's qualification issues shall be stipulated,so as to avoid risks from the source.

The core of import agency approval lies in the customs record-filing qualification of the agency entity. In 2026, the General Administration of Customs optimized the Single Window record-filing process, which only requires submission of business license and customs declarant qualification certificate for completion, no offline in-person handling is needed.

It shall be noted that if the agency conducts cross-port business, it needs to complete local record-filing at the corresponding port, otherwise it cannot carry out local agency services. Some customers mistakenly believe that import agency requires industry-specific approval.

In fact, additional corresponding logistics licenses are only required for agencies handling special categories such as dangerous goods and fresh produce, which belong to logistics qualifications rather than import agency approvals. If the agency's record-filing expires and is not renewed, the declaration will be rejected, and the agency needs to contact the customs in time for extension to avoid port demurrage.

Import agency approval is connected to the compliance of logistics links. If the agency company has not completed customs record-filing, the bill of lading it issues cannot be exchanged normally, resulting in the failure of goods pickup. Meanwhile, if the agency undertakes bonded goods agency business, it needs to complete goods ownership control record-filing at the administrative committee of the bonded zone, otherwise it cannot carry out bonded warehousing agency business.

In response to your demand for tight delivery schedule, it is recommended to prioritize agencies with national port linkage qualifications, whose record-filing information can be queried with one click on the Single Window, to avoid process delays caused by temporary agency replacement. In addition, the calculation of free storage period and container detention fee shall be clearly agreed with the agency, and relevant fees caused by port demurrage due to agency qualification issues shall be borne by the agency.

Import agency approval does not directly affect taxation, but the compliance of the agency will affect subsequent VAT deferral applications. The 2026 EU VAT deferral rule requires the agency company to provide compliant import declaration certificates. If the agency fails to complete customs record-filing, the documents it declares cannot be used as valid supporting documents for VAT deferral.

In addition, if the agency is involved in cross-border foreign exchange collection and payment, it shall be ensured that it holds trade compliance qualifications, otherwise the entrusting party's foreign exchange payment will be suspended by the bank. It is recommended to specify tax compliance clauses when signing the agency agreement, and require the agency to provide declaration document records of the latest 3 months, to ensure its tax process meets the latest BEPS requirements.

Import agency approval is directly linked to cross-border foreign exchange collection and payment compliance. In 2026, the State Administration of Foreign Exchange requires agency companies to complete trade agency record-filing at SAFE before undertaking entrusted foreign exchange collection and payment business. If the agency fails to complete such record-filing, the entrusting party cannot complete foreign exchange payment through its account, and has to handle the foreign exchange payment procedure on its own, increasing operating costs.

In addition, if cross-border RMB settlement is involved, the agency shall hold CIPS participation qualification, otherwise RMB payment cannot be completed. It is recommended to check the agency's SAFE record-filing information before cooperation, to ensure it has the authority to collect and pay foreign exchange, and avoid payment failure caused by compliance issues.

The compliance of import agency shall be clarified through legal clauses. In 2026 international trade, the agency agreement shall clearly specify the scope of the agency's qualifications. If the agency conducts business beyond the recorded scope, it shall bear the liability for breach of contract.

In addition, if letter of credit settlement is involved, the agency shall hold the qualification to issue letters of guarantee, otherwise it cannot provide the entrusting party with goods ownership guarantee under the letter of credit. It is recommended to add qualification clauses in the agreement, explicitly requiring the agency to provide documents including customs record-filing certificate and SAFE record-filing certificate.

If losses are caused by the agency's qualification issues, the agency shall make full compensation. Meanwhile, attention shall be paid to IPR customs protection record-filing. If the agency is involved in import of infringing goods, it shall bear joint and several liability.

The compliance of import agency will affect the efficiency of on-site inspection. If the agency fails to complete customs record-filing, the documents it declares will be listed as key inspection targets by the customs, resulting in extended inspection time. In addition, if the agency handles inspection of special goods such as precision instruments, it needs to have professional capacity for container unstuffing and seal handling, which requires the agency to hold corresponding on-site operation qualifications.

In 2026, the customs promoted paperless inspection, and the agency needs to have the Single Window inspection reservation authority, otherwise it cannot make inspection reservations. It is recommended to confirm the agency's on-site inspection authority before cooperation, to avoid delivery schedule delays caused by inspection delays.

Import agency approval is related to goods packaging compliance. If the agency undertakes import of special goods such as dangerous goods and precision instruments, it shall hold packaging compliance review qualification, to ensure that the goods packaging meets UN standards and importing country requirements. In 2026, the customs requires the agency to provide the goods' MSDS report and packaging appraisal certificate.

If the agency fails to provide such documents, the declaration will be rejected. In addition, if special treatment such as moisture-proof processing and reinforcement is required for the goods, the agency shall have corresponding packaging design capacity, otherwise the goods may be damaged during transportation. It is recommended to confirm the agency's packaging compliance review qualification before cooperation, to ensure the goods packaging meets all relevant requirements.
