I am the person in charge of a small and medium-sized trading enterprise that has just started import business. Recently, I entrusted a third party to provide full-process import agency services for the first time, and have paid various scattered fees such as agency fees, terminal handling fees, service fees for agency advance payment, and warehousing fees.

I heard from peers that someone was audited because they couldn't distinguish which import agency fees are taxable, was fined tens of thousands of yuan, and their customs clearance credit was affected. Now I feel uncertain.

I don't know which of these fees related to import agency need to be taxed and what taxes to pay respectively. I also want to know what common misconceptions in the industry should be avoided to prevent mistakes and problems, and I hope to clarify clear compliance requirements and make arrangements in advance.

The most common misconceptions in the industry are merging all fees related to import agency into the value of goods for tax payment,or treating agency service fees completely as domestic services and only paying domestic VAT without declaring any import-related taxes at all. Some enterprises also directly exclude service fees for agency advance payment and additional errand service fees collected by the agent from the taxable scope, assuming these do not need to be taxed.

These misconceptions will trigger completely different negative chain reactions: Blindly merging fees for tax payment will lead to overpayment of taxes, needlessly increase import costs, and compress profit margins,Underpayment or missed payment will trigger customs audits and tax warnings. In addition to paying back taxes and a late fee of 0.05% per day,the enterprise's import and export credit rating will also be downgraded. All subsequent import businesses will be listed as key supervision objects. In severe cases, goods may be detained at the port, resulting in additional port detention and container detention fees ranging from tens of thousands to hundreds of thousands of yuan.

Dividing the taxable scope according to the nature of fees is the most direct physical risk isolation measure: If it is a pure agency service commission collected by the agent, only domestic VAT needs to be paid,If it is miscellaneous fees such as terminal handling fees, warehousing fees, and loading/unloading fees paid by the agent on behalf of the principal in the import link, they need to be included in the customs value of the goods to pay import duties and import VAT.

Completely retaining the fee split list is an exclusive risk control tip. You need to require the agent to clearly split agency service fees and advance-paid fees in the contract and invoice in advance, clearly mark the nature of each fee, which facilitates verification by customs and tax authorities. In case of price assessment disputes, you can quickly provide evidence to avoid unnecessary penalties and cost losses.

The core criterion for determining whether import agency fees are included in the customs value of goods is whether the fees are related expenses incurred before the goods are unloaded at the place of entry in the territory, and whether they are seller's commissions. If the agency fee is paid by the seller to the agent, or the commission paid by the buyer to complete the seller's sales arrangement, it must be included in the customs value; If it is an import agency commission incurred by the buyer entrusting a domestic agency on its own, it does not need to be included in the customs value, and only needs to declare and pay VAT domestically.

During the price assessment process, the customs will verify the fee clauses in the agency contract. If the fee division is unclear, the customs value will be tentatively determined directly, which will delay customs clearance efficiency.

Logistics fees incurred due to delays such as container detention fees and port detention fees during the import agency process do not need to be included in the customs value of goods for tax payment. Such fees belong to subsequent logistics expenses incurred due to the consignee's own reasons after the goods enter the territory. The core node for taxable determination is the unloading at the place of entry.

All additional logistics expenses incurred after unloading do not need to be included in the tax base of import link taxes, and only need to be treated as enterprise operating costs and deducted before domestic income tax. If it is fees such as port change fees and transshipment fees incurred before unloading and paid by the agent on behalf of the principal, they need to be included in the customs value to calculate import duties and import VAT.

Import agency service fees belong to brokerage agency services in modern service industry. General taxpayers apply a VAT rate of 6%, while small-scale taxpayers apply a levy rate of 1% (the preferential policy for small-scale taxpayers will continue until 2026). After the agent issues a special VAT invoice, the principal can normally deduct input VAT.

If the VAT deferral mode is selected for import, the domestic VAT of agency fees is not calculated together with import VAT, and they can be declared and deducted separately, so there is no problem of double taxation. The overall tax burden can be optimized through compliant structure design.

The payment path of import agency fees does not affect the determination of taxable nature. Whether paid directly to the agent or transferred through an overseas third party, the tax payment requirements must be distinguished according to the nature of the fees.

If the agency fee is paid in RMB through CIPS cross-border payment, it only needs to accurately mark the nature of the fee as "import and export agency service fee" during foreign exchange receipt and payment declaration, which will not affect the taxable determination by tax and customs authorities. As long as the corresponding contracts, invoices, and payment vouchers are retained, compliance requirements can be met, and there is no need to adjust the taxable scope additionally.

The import agency contract must clearly mark the nature, bearer, and tax-paying subject of each fee to avoid tax risks caused by ambiguous fee agreements. If the contract stipulates that all taxes and duties are borne by the principal, it is necessary to clearly list the split method of agency service fees and advance-paid fees, as well as the corresponding division of tax payment responsibilities.

This avoids mutual shifting of responsibilities between the agent and the principal when tax payment is missed, and both being included in the verification list. Clearly agreed fee clauses can also serve as a legal basis for subsequent dispute handling, reducing the compliance risks of both parties.

During on-site inspection, if the customs has doubts about the division of customs value for import agency fees, it will require the provision of agency contracts and fee lists. You need to prepare a clear split version in advance, marking the occurrence time and link of each fee to facilitate verification by customs officers.

If the fee is incurred after unloading, you need to provide the corresponding terminal operation time sheet to prove that the fee was incurred after unloading and does not need to be included in the customs value. As long as the evidence is clear, the release can generally be completed quickly without delaying customs clearance time or incurring additional penalties.

Enterprises with long-term import business can agree on a fixed fee split mode with the import agent, sort out all fees according to their nature, and establish a fixed tax declaration template to reduce the compliance cost of each import.

They can also select an appropriate settlement method for agency fees according to their own tax situation, such as summarizing and invoicing recurring small agency fees on a monthly basis to reduce the frequency of declaration and lower compliance management costs. At the same time, according to the tariff rate of imported goods, the fee split method can be optimized to adjust the overall tax burden within the compliant scope and improve profit margins.
