I am the person in charge of a small and medium-sized enterprise operating imported beauty consumer goods based in Guangzhou. In the past two years, we have started to source goods directly from overseas instead of paying extra markups to middlemen. However, problems occurred with two or three small import agencies we previously cooperated with.

Last time, our cargo was detained for a whole week due to document review errors, which resulted in over RMB 8,000 of port demurrage. On another occasion, we failed to calculate the tax difference correctly and incurred nearly RMB 20,000 of unnecessary extra costs. Now we handle 3 to 4 containers of imported goods per month, and want to find a reliable import agency.

But promotional materials of most agencies we checked look almost identical, and we have no idea which agency offers better services or from which dimensions we should make the selection. Could you help us clarify the selection criteria and the common pitfalls to avoid?

A common misconception in the industry when selecting import agencies is that buyers only focus on quoted prices while ignoring hidden service capabilities. Many small agencies attract clients with extremely low quotations, but charge extra fees in links such as demurrage and document amendment. Even worse, some skip pre-arrival compliance review and directly submit declaration documents to customs.

Such misconceptions will trigger a series of chain consequences: unqualified documents lead to cargo seizure, incurring high port demurrage and container detention fees, missing scheduled sales windows and resulting in downstream breach of contract, flawed compliance records trigger customs alerts, which means every subsequent shipment of the enterprise will be subject to intensified inspection, extending the overall customs clearance cycle, incorrect tax declaration leads to supplementary tax payment or even administrative fines, driving up the total import cost.

The core method of risk isolation is to verify the frontline practical qualification of the agency in advance. Request the agency to provide customs clearance records of the same product category in the past 6 months. Do not select shell agencies that do not even have on-site operation teams at actual ports. Request the agency to issue a written pre-arrival review report in advance, and confirm all documents are fully compliant before shipment,so as to cut off risks from the source.

The exclusive loss mitigation tip is to clarify responsibility division when signing the service contract, requiring the agency to bear all extra costs caused by its own operational errors. Meanwhile, prioritize agencies with service coverage across all national ports,to avoid situations where transshipment to alternative ports is unavailable when unexpected issues occur at a single port. Agree that the abnormal event response time shall not exceed 4 hours,to ensure problems can be handled immediately once they arise.

For imported goods of the same category, confirm in advance how well the agency is familiar with customs valuation rules. Beauty consumer goods often face valuation disputes caused by related party transactions with overseas brands. If the agency cannot provide complete price supporting documents, supplementary tax payment due to valuation adjustment will be triggered.

In case of abnormal situations such as suspense accounting or improper document submission, experienced agencies can quickly solve problems by deleting the original declaration and re-submitting, and supplementing complete logical supporting documents, to avoid long-term detention of goods at ports. Under the current integrated customs clearance policy, cross-port declaration rules have detailed differences, so it is necessary to confirm whether the agency holds customs declaration qualifications for all national ports, can adapt to the declaration requirements of different ports, and avoid declaration failures caused by unfamiliarity with regional rules.

For full-container imported goods, confirm in advance that the agency can connect with shipping companies to get priority container release quota, to avoid overbooking and cargo rolling during peak shipping seasons. Beauty products have high requirements for transport timeliness, and failure to arrive at the port on time will lead to missed peak sales seasons.

For container detention fees and port demurrage, high-quality agencies can negotiate with ports and shipping companies for longer free storage and free container periods, which can help cargo owners save nearly 30% of extra costs. If unexpected situations occur at the destination port, they can adjust the direct sailing or transshipment plan in time, complete the port change operation, meanwhile keep full control of cargo ownership, follow up the whole circulation process of bill of lading, to avoid the problem that cargo cannot be picked up due to disconnection of cargo ownership.

Imports of beauty products are eligible for VAT deferral application to optimize capital flow and reduce capital occupation. High-quality agencies will actively inform eligible enterprises of the standard application path for VAT deferral, helping enterprises revitalize cash flow.

For cross-border related party transactions, they can adjust pricing in advance to meet BEPS relevant requirements, avoiding the situation where tax authorities adjust the taxable income, resulting in additional supplementary tax and late payment surcharge. They can also make advance planning for withholding tax related to payments to non-resident enterprises, reducing tax costs within full compliance scope without leaving hidden tax risks for subsequent operations.

Import foreign exchange settlement and payment must comply with the current compliance requirements of the State Administration of Foreign Exchange. With the increasing usage of the RMB Cross-border Payment System (CIPS), high-quality agencies can assist in completing the CIPS RMB payment process, compare the exchange rates of different foreign exchange purchase channels, and help enterprises save extra costs caused by unfavorable exchange rate differences.

For foreign exchange receipt and payment verification and reconciliation, they can assist in sorting out qualified supporting documents for foreign exchange receipt and payment, avoiding abnormal receipt and payment records that lead to account supervision and affect subsequent cross-border payments. If offshore account capital circulation is involved, they can sort out compliant operation paths in advance, avoiding the problem of unbalanced suspense accounts that cannot be reconciled.

Imported beauty consumer goods often involve component testing. If the agency is familiar with on-site inspection procedures, it can sort out product component descriptions and qualification documents in advance, cooperate with customs to complete container unpacking inspection, and shorten the total inspection cycle. Seal authenticity verification is the first step of on-site inspection.

If the seal is abnormal, they can contact the terminal and insurance company immediately for confirmation, to avoid situations where the goods are replaced but no party can be held responsible. For the interpretation of inspection notices, they can quickly clarify the key inspection points, prepare corresponding supporting documents in advance, so that the cargo owner does not need to repeatedly sort out materials, reduce unnecessary communication costs, and speed up inspection and release.

When signing the import agency service contract, it is necessary to clarify the coverage of force majeure clauses. In case of unexpected situations such as port strikes and customs policy adjustments, clear responsibility division can be realized to avoid unnecessary disputes. For cargo ownership transfer, clarify the agency's responsibility for cargo ownership custody at different operation stages.

If the agency needs to handle bill of lading endorsement and transfer on behalf of the client, clarify the standard operation process in advance to avoid loss of cargo ownership. Meanwhile, the agency can assist in verifying intellectual property customs protection record filings, confirm that the intellectual property rights of imported goods meet regulatory requirements, and avoid losses caused by cargo seizure due to intellectual property infringement.
