I am the head of a newly established import agency company. Recently, I plan to register a trademark but have no idea about classification at all.

Last week, a customer asked if we offer logistics distribution services, and I realized that if our trademark category does not cover transportation services, we might face infringement complaints. Now I don’t know which core category to choose or which related categories to add.

I’m worried that choosing too few will leave gaps in protection, while choosing too many will waste costs. I want to know which category import agency trademarks belong to, and if there are specific classification guidelines and pitfall-avoidance suggestions?

The most common misunderstanding in import agency trademark registration is only registering Class 35 (Commercial Agency Services) while ignoring related categories. Many enterprises assume Class 35 covers all agency businesses, but in practice,if international logistics distribution is involved,Class 39 (Transportation and Warehousing Services) needs to be supplemented,if marketing or training for imported goods is provided,Class 41 (Education and Training) must be covered.

Missing categories may trigger chain risks: for example, providing logistics services without registering Class 39 could lead to infringement complaints from competitors, resulting in trademark opposition or revocation,if cross-border payment consultation is involved, failing to register Class 36 (Financial Services) may lead to compliance penalties.

Risk isolation measures: First define the core business scope, then match corresponding categories. For example,an enterprise focusing on import customs declaration agency should select Class 35 (Group 3503: Sales Promotion on Behalf of Others) as the core category, and associate it with Class 39 (Group 3901: Transportation) and Class 42 (Group 4209: Design Consulting).

Exclusive Loss Prevention Tips: Use trademark search tools to check existing registered categories before registration to avoid conflicts with existing trademarks, meanwhile, applying for "full-class protection" is costly but prevents others from squatting on related categories, making it suitable for enterprises with long-term development plans.

From a customs policy perspective, import agency trademark classification must align with the scope of customs declaration business. If an enterprise provides customs declaration agency services, Class 35 (Group 3506: Business Management Assistance) is the core category, but note that this group does not include transportation services.

If consulting services related to customs declaration are involved, Class 42 (Group 4209: Technical Research) needs to be supplemented. In addition, if an enterprise uses its own trademark for customs declaration business, it must complete intellectual property recordation with customs, and clearly specify the service categories corresponding to the trademark during recordation; otherwise, it may not enjoy intellectual property protection during inspection.

The logistics links involved in import agency require matching Class 39 trademarks. For example, providing international ocean freight agency services requires registering Group 3901 (Transportation), and warehousing services require Group 3906 (Warehousing).

If an enterprise uses its trademark to provide container detention handling or port change services, these all fall under Class 39. Note that if logistics services are not reflected in trademark categories, when a third party uses the same trademark to provide similar services, the enterprise cannot enforce rights through trademark law, which may lead to customer loss.

Import agency trademark classification is related to tax planning. If an enterprise provides VAT deferral consulting services, it needs to register Class 35 (Group 3507: Business Auditing) or Class 42 (Group 4220: Tax Consulting).

In addition, if cross-border payment exchange rate optimization services are involved, Class 36 (Group 3602: Financial Services) needs to be supplemented. Correct category registration ensures the compliance of tax services and avoids tax recordation failure due to inconsistent trademark categories.

From the perspective of cross-border payment and collection compliance, if import agency trademarks involve settlement and account balancing services, Class 36 (Group 3602: Currency Exchange) must be registered. If an enterprise uses its trademark to provide offshore account management services, Class 36 (Group 3601: Banking) needs to be supplemented.

In addition, SWIFT message parsing services fall under Class 35 (Group 3506: Business Management Assistance); ensure trademark categories cover these services, otherwise regulatory authorities may deem the enterprise as operating beyond its scope.

Import agency trademark classification needs to consider customs protection of intellectual property rights. If an enterprise's trademark involves cargo ownership transfer services in freight transportation, Class 39 (Group 3901: Transportation) and Class 42 (Group 4209: Legal Document Preparation) must be registered.

In addition, if L/C soft clause review services are provided, Class 42 (Group 4207: Legal Services) needs to be supplemented. Correct category registration enables more comprehensive protection during customs recordation and prevents infringing goods from passing through customs.

From a port inspection perspective, if import agency trademarks involve seal authenticity identification services, Class 35 (Group 3506: Business Management Assistance) or Class 42 (Group 4209: Technical Testing) must be registered. If container unloading inspection response services are provided, Class 39 (Group 3901: Transportation Assistance) needs to be supplemented.

In addition, consulting on machine inspection skills falls under Class 42 (Group 4209: Technical Consulting); ensure trademark categories cover these services, otherwise the trademark cannot be used to claim service rights during inspection.

Import agency trademark classification needs to match the supply chain structure. If an enterprise provides CIF/FOB trade term conversion services, Class 35 (Group 3503: Sales Promotion on Behalf of Others) and Class 39 (Group 3901: Transportation) must be registered.

If inventory linkage strategy consulting is involved, Class 42 (Group 4209: Design Consulting) needs to be supplemented. Correct category registration supports the branding of supply chain optimization services and enhances market competitiveness.
