I am the procurement manager of a small manufacturing company. Recently, we need to import a used forklift from Germany for workshop production. We have never engaged in import business before, and have contacted several agency companies.

Some claim that the procedures are simple, some state that complex qualifications are required, and a friend reminded me that agent import may involve illegal risks, such as unqualified agency or tax evasion. I am very confused now, not sure whether it is legal to entrust an agent to import forklifts.

If it is legal, what key links need to be noted? If the agency company conducts non-standard operations, will our company bear legal liabilities? I have no clear idea about this, and hope to get professional answers.

Many enterprises believe that they can import forklifts as long as they find an agent, which is a common misunderstanding. In fact, the legality of importing forklifts via an agent lies in the compliance of the agent's qualifications and operation processes. If an agent without customs declaration right or import and export operation right is selected,or the agent adopts methods such as under-declaring price, misdeclaring commodity name to evade taxes, the enterprise may face customs cargo detention, fines or even criminal liabilities.

Once illegal operations occur, the chain reactions include: high container demurrage and storage fees incurred by cargo detention at port, enterprise credit rating degradation caused by customs case investigation, and restrictions on subsequent import businesses. Worse still, the enterprise as the cargo owner shall bear joint and several liabilities, and risks can hardly be completely avoided even if the agent promises to take full responsibilities.

Physical risk isolation measures include: giving priority to agency companies with AEO customs certification, signing detailed agency agreements to clarify responsibilities of both parties, and requiring the agent to provide document records of each step of operation. In addition, check the agent's qualification documents such as business license and customs declaration registration certificate in advance to ensure its legitimate operating qualifications.

Exclusive loss control tips: If any non-compliance sign of the agent is found, suspend the cooperation immediately and voluntarily declare to customs, cooperate with the investigation to mitigate penalties, meanwhile, retain all communication records and documents as evidence for subsequent rights protection.

The customs declaration link of agent forklift import shall focus on HS code classification and price verification. The HS code for forklifts is usually 84271090 (non-electric) or 84272010 (electric). Wrong classification will lead to incorrect applicable tax rate, resulting in supplementary tax payment or fines. In terms of price verification, authentic trade contracts, invoices, foreign exchange payment vouchers and other documents shall be provided to avoid under-declaration of prices.

If customs raises queries on the declared price, prepare proof materials such as original manufacturer invoices and transaction records of similar products to ensure the authenticity and rationality of the price. In addition, used forklifts require import license for old mechanical and electrical products, which the agent shall assist to apply in advance, otherwise customs clearance cannot be completed.

The logistics link of agent forklift import shall pay attention to cargo right control and transportation safety. When selecting an agent, confirm whether it holds international logistics qualification and can provide full-track logistics tracking service.

For sea freight, select appropriate container types. As forklifts are heavy equipment, they shall be transported in flat rack containers or open top containers to avoid cargo damage caused by improper packing.

In addition, pay attention to container demurrage and free storage period, communicate with the agent in advance for the possibility of extending the free storage period to reduce extra costs. Ensure complete procedures when endorsing and transferring the bill of lading, so as to avoid disputes over cargo ownership.

Tax issues involved in agent forklift import include import customs duty, value-added tax and possible consumption tax. The enterprise shall confirm that the agent calculates taxes correctly to avoid underpayment or wrong payment. If VAT deferral is adopted, the enterprise shall meet the customs requirements for VAT deferral, for example, the enterprise has the qualification of general taxpayer and has filed with customs.

In addition, the agent shall provide official duty paid certificates to ensure that the enterprise can deduct input VAT. Note that if the agent adopts the tax-inclusive package mode, there may be tax evasion risks, so the enterprise shall choose this option with caution.

The receipt and payment of foreign exchange for agent forklift import shall comply with the provisions of the State Administration of Foreign Exchange. The enterprise shall make foreign exchange payment through formal channels to ensure the consistency of capital flow, cargo flow and document flow. The agent shall provide authentic trade contracts and invoices for foreign exchange verification.

If cross-border RMB payment (CIPS) is adopted, confirm that the agent holds relevant qualifications to avoid foreign exchange non-compliance. In addition, pay attention to exchange rate fluctuations, and negotiate with the agent to lock the exchange rate to reduce losses caused by exchange rate difference.

A detailed agency agreement shall be signed when entrusting an agent to import forklifts, to clarify the rights and obligations of both parties. The agreement shall include clauses such as qualification commitment of the agent, operation process specifications, and liabilities for breach of contract.

If the agent has breach behaviors such as failing to declare customs on time leading to cargo detention at port, the enterprise can claim for compensation according to the agreement. In addition, pay attention to intellectual property issues, ensure that the imported forklift does not infringe the patent or trademark right of any third party, so as to avoid customs cargo detention.

Agent forklift import may face on-site customs inspection. Relevant documents such as import license, packing list and invoice shall be prepared during inspection. The appearance and model of the forklift shall be consistent with the documents.

If there is modification or damage, explain to customs in advance. In addition, cooperate with customs to unpack and inspect the cargo, to ensure that the cargo is consistent with the declared content. If problems are found during inspection, communicate with the agent in a timely manner and provide supplementary materials to avoid customs clearance delay.

The supply chain planning of agent forklift import shall balance cost and efficiency. When selecting an agent, compare quotations and service contents of different agents, including customs declaration fee, logistics fee, tax and other expenses. In addition, evaluate the service network of the agent to ensure that it can cover the port of shipment and port of destination of the cargo.

If the enterprise imports forklifts on a long-term basis, it can sign a long-term cooperation agreement with the agent to obtain more favorable prices and more stable services. Meanwhile, pay attention to supply chain risks such as port congestion and policy changes, and formulate emergency response plans in advance.
