I am a company focused on investing in and operating art cinemas. This year, we secured non-commercial screening authorization for three niche overseas art films in China. Previously, we only handled scheduling and screening of domestic films and are completely unfamiliar with the entry operation process for imported films.

We are stuck in the agency link: when approaching domestic film distribution companies, they state they are only responsible for publicity and distribution and do not undertake import and export agency businesses such as customs clearance and settlement; when approaching ordinary import and export freight forwarders, they say they have no experience in handling audio-visual cultural imports and dare not take the order. We have already set the screening schedule for the second half of this year and are very pressed for time, so we want to figure out exactly who to approach for agency services for imported films in China, what qualifications the agency needs to have, and whether there will be compliance risks?

For imported films entering China, the agency division has two parts: first, film copyright distribution agency, responsible by institutions with imported film distribution qualification approved by the national film regulatory authority, focusing on content review submission and obtaining release permits, second, import and export customs clearance and settlement agency, responsible by import and export agencies with Cultural Products Import and Export Qualification, undertaking end-to-end import and export operations including overseas film source transportation, customs clearance declaration, foreign exchange settlement to compliant tax payment.

Pre-document review in the import and export agency link mainly examines two documents: one is the imported film approval document issued by the national film regulatory authority, the other is the complete copyright authorization document. All documents need to be translated into official standard versions and submit Customs Recordation of Intellectual Property Rights in advance to avoid cargo detention due to ownership disputes.

The sequence of core node connection is: book space for transportation in advance after obtaining the import approval. Most film source carriers are high-spec storage hard disks,so anti-demagnetization and anti-impact packaging need to be done before transportation, declare pre-classification to customs in advance, apply for green channel for cultural products import, shorten customs clearance time, and adapt to the established screening schedule.

For abnormal plans,if there are price review disputes or ownership verification, the agency needs to provide complete authorization documents and approvals as soon as possible, cooperate with customs verification,if there is incorrect document information, delete and resubmit the declaration within three working days to avoid extra costs caused by port detention. Finally complete foreign exchange tax payment,value-added tax payment, and after obtaining the customs release order, deliver to the distributor, then proceed with subsequent release arrangements.

Film sources for imported movies are mostly digital storage media, which are usually declared as digital cultural products in classification. The price review link requires the submission of an official transaction contract issued by the copyright owner; for non-commercial screenings, relevant official certification documents must be provided to clarify the composition of the dutiable value. If there is a price review dispute, complete transaction background materials need to be organized to prove the authenticity of the transaction price and the absence of underreporting or false reporting.

Under the integrated customs clearance model, one can choose local declaration and port inspection and release to shorten the overall customs clearance time. If there is incorrect declaration information, the declaration must be deleted and resubmitted within the time limit specified by customs to ensure the closed loop of declaration logic and avoid leaving bad customs records that affect subsequent business development.

Film source storage media for imported movies are high-value and fragile items. When transporting, direct flights are preferred to avoid repeated handling losses in transit, and full-coverage transportation insurance covering the entire chain from overseas departure to domestic delivery must be purchased. In case of port overcrowding and container rejection, priority cabin space must be reserved with the airline in advance, and free storage period and container detention period must be locked in advance to avoid extra container detention fees and storage fees.

The overall logistics path should prefer airport express channels or professional cultural products customs clearance ports. When delivering film sources, the seal information must be checked, and the bill of lading must be endorsed and transferred before delivery to the distributor to fully control the cargo ownership risk.

Imported films are subject to customs duties and value-added tax during import. If used for non-commercial public welfare screenings, corresponding tax preferential policies can be applied for, and relevant certification documents must be prepared in advance and submitted to customs and tax authorities. If overseas copyright payment is involved, withholding income tax on non-resident enterprises must be withheld and paid in accordance with regulations.

A reasonable tax structure arrangement can be used to optimize tax costs and complete compliant tax payment. For import projects that meet VAT deferral conditions, VAT deferral can be handled to alleviate capital occupation pressure, avoid occupying large operating funds in advance, and optimize the overall project cash flow.

Cross-border payment of overseas copyright fees involved in imported films must complete foreign exchange receipt and payment recordation in accordance with foreign exchange management regulations. If RMB is used for payment, it can be settled through the Cross-Border Interbank Payment System (CIPS), which has faster arrival speed, lower exchange costs, and arrival timeliness more suitable for short-cycle scheduling compared with SWIFT.

Before settlement, the consistency of transaction documents must be checked to ensure the authenticity and compliance of the transaction background, avoid abnormal settlement and reconciliation that affects subsequent foreign exchange receipt and payment business. All foreign exchange receipt and payment vouchers must be retained and archived for future regulatory inspections to ensure the entire process complies with foreign exchange regulatory requirements.

For imported film agencies, advance intellectual property customs protection recordation must be completed to clarify copyright ownership and avoid infringement disputes leading to cargo detention and schedule delays. The agency agreement must clearly define the division of powers and responsibilities of both parties, especially the division of compliance responsibilities, and provide fallback content for force majeure clauses.

If the release cannot be delayed due to policy adjustments, the responsibility bearing and loss division of each party must be clarified. For exclusive screening authorization, the cargo ownership transfer node must be clearly defined in the agency agreement to avoid legal disputes caused by authorization conflicts.

When film source media for imported films are subject to on-site customs inspection, full sets of document copies must be prepared in advance, and customs inspectors must cooperate to verify the authenticity of the seal. If it is an X-ray inspection, the packaging must be organized in advance to avoid affecting the judgment of the X-ray inspection result due to messy packaging.

If unpacking and inspection are required, staff familiar with the media attributes must be arranged to cooperate on site to avoid demagnetization or physical damage to the film source media that affects subsequent use. If laboratory identification is required, corresponding samples shall be provided as required, and the identification process shall be followed throughout to obtain the test report in time, accelerate the overall customs clearance speed, and avoid schedule delays.
