I am a small and medium-sized factory manufacturing household goods, having just obtained bulk orders from European and American clients. We have long focused on domestic sales, never handled exports before, do not have our own export qualifications, nor have we established a professional foreign trade team.

The shipping deadline is approaching, and we have contacted several small agencies whose quotations vary significantly. Some claim to handle all export procedures, while others state that we need to process export tax rebates ourselves. We have also heard cases of unethical agencies embezzling tax rebate funds.

I am extremely anxious now, worried about choosing the wrong agency leading to shipping schedule delays, cargo detention and penalty fees, or being inspected for non-compliance which will affect subsequent orders. I want to ask how to choose an export agency, and what core issues should be noted in the entire process to ensure smooth implementation?

There are two common misconceptions in the industry: first, only focusing on quotation levels and blindly choosing agencies whose fees are far below the market average, second, trusting verbal promises without signing a formal written agreement with clear rights and responsibilities. Many small agencies without fixed qualifications attract clients with extremely low agency fees, then profit by charging various hidden miscellaneous fees and intentionally withholding export tax rebates, and some even embezzle clients' export tax rebate funds to cover their own deficits. Once the agency's operations are non-compliant,the chain reaction will be that your goods will be subject to customs audit and inspection, leading to high port congestion surcharges, even cargo detention and failure to deliver on time, triggering breach of contract compensation with overseas clients, and in severe cases, the manufacturing enterprise may even be included in the customs supervision anomaly list, affecting all subsequent export businesses.

The core means of physical risk isolation is to verify the agency's qualifications and risk control system in advance. First, confirm that the agency has complete import and export business qualifications, and has a stable direct operational team at the port of cargo departure, rather than a middleman who transfers orders to others. Order transfer by middlemen will not only increase additional costs, but also lead to unclear rights and responsibilities when problems arise, making it impossible to resolve anomalies in a timely manner.

When signing a formal agreement, all fee details, tax rebate arrival timelines and liability for breach of contract must be clearly specified. Avoid hidden hazards from vague verbal agreements, all verbal promises must be incorporated into written terms.

Exclusive loss-prevention tip: Before cooperation, you can ask the agency to provide operation cases of 3-5 similar export businesses in the recent period, and check the agency's customs credit rating. Prioritize agencies with a Class A or above credit rating. If during cooperation, you find signs of non-compliant operations by the agency, terminate the cooperation immediately and report to the port customs, and replace a compliant agency to re-handle procedures to prevent further expansion of risks.

You need to confirm the agency's customs declaration filing qualifications in advance, verify its enterprise filing information with the General Administration of Customs, and confirm that there are no unsettled violation records. If the exported goods involve own brands or licensed brands, you need to ask the agency to verify the intellectual property rights (IPR) customs filing information in advance, to avoid cancellation and re-declaration or cargo detention due to inconsistent filing information or incomplete authorization materials.

For the national integrated customs clearance declaration model, the agency needs to verify the consistency between the manifest information and the customs declaration form declaration information in advance, to avoid system auto-hanging and failure to clear customs due to data differences. If there is a customs price verification dispute, the agency must quickly compile complete transaction contracts, payment vouchers and price description materials, and cooperate with the customs to complete the price verification process, to avoid customs clearance delays caused by insufficient preparation of materials and additional costs.

The export agency needs to have stable shipping line booking channels, and can lock cabin space in advance to avoid cargo rolling due to space shortage during peak seasons. When signing the cooperation agreement, clarify the logistics scope responsible by the agency, and the liability division for container detention charges and port detention charges, to avoid fee disputes when anomalies occur. For different export routes, the agency needs to provide multiple solutions for direct flights and transshipments, and select the most suitable solution based on your delivery time requirements and cost budget.

In case of emergency situations such as destination port diversion, the agency needs to quickly contact the shipping line to complete the port diversion procedures and adjust the bill of lading information, to avoid goods failing to arrive at the port normally due to delayed procedures. After the goods are shipped, the agency needs to follow up on the cargo transportation dynamics in a timely manner, synchronize with you and overseas clients, and handle anomalies during transportation promptly.

Before cooperation, confirm the export agency's tax rebate qualifications and tax rebate operation arrangements, clarify how long the tax rebate will arrive, whether advance tax rebate is available, and what the fee standard for advance tax rebate is. During operation, the agency must ensure the consistency of the four flows (goods, invoices, payments and contracts), cooperate with tax authorities to complete the letter inspection process, and avoid tax rebate failure due to inconsistent four flows.

All tax rebate-related documents must be filed and archived by the agency, including export goods customs declaration forms, VAT special invoices, foreign exchange collection vouchers, ocean bills of lading, purchase contracts, etc., to avoid affecting tax rebate declarations due to missing documents. It must be clearly specified that if tax rebates cannot be processed or delayed due to the agency's operational errors, the agency shall bear corresponding loss liabilities to protect your own rights and interests.

The export agency must have compliant foreign exchange receipt and payment qualifications, support cross-border RMB settlement and foreign exchange settlement, and meet the requirements of the latest Cross-Border Interbank Payment System (CIPS), to avoid being inspected by the State Administration of Foreign Exchange (SAFE) for non-compliant foreign exchange receipt and payment processes. In the foreign exchange settlement and receipt link, the agency needs to select a suitable settlement timing based on real-time exchange rate trends to help optimize settlement returns and reduce exchange rate difference losses.

The agency must complete account reconciliation for foreign exchange receipts and payments, ensuring that each foreign exchange receipt corresponds to the corresponding export order, to avoid unbalanced hanging accounts and affecting the enterprise's foreign exchange compliance rating. Before cooperation, confirm the agency's foreign exchange classification level, and prioritize Class A agencies which enjoy more convenient foreign exchange receipt and payment channels and shorter settlement cycles.

The cooperation agreement must clarify the ownership of the goods, stipulating that before the goods are delivered and the buyer takes delivery, the title of the goods always belongs to the exporter, and the agency shall not dispose of the goods without permission. If the export order adopts the letter of credit (L/C) settlement method, the agency must assist in reviewing all terms of the L/C in advance, and check for hidden soft clause traps, to avoid failing to receive payment normally due to unmet soft clause requirements.

The agreement must clarify the liability division after force majeure events, and the dispute resolution method in case of trade disputes, so as to prepare for risks in advance. If the exported goods involve own intellectual property rights, the agency shall assist in verifying the customs IPR protection filing to avoid cargo detention due to inconsistent filing information and resulting losses.

After the goods arrive at the port, the agency shall arrange personnel familiar with on-site procedures to follow up on the inspection link, verify the authenticity of the seal in advance, and ensure that the container seal is consistent with the seal number on the customs declaration form, to avoid cargo detention during inspection due to abnormal seals.

If manual unpack inspection is required, the agency shall prepare the complete set of declaration documents in advance, cooperate with customs officers on site to complete the goods verification, and confirm the packing position of the goods in advance to facilitate quick unpack inspection and shorten the inspection process. If the customs requires laboratory testing, the agency shall follow up the entire testing process, obtain the test report in a timely manner, and provide it to the customs to complete the subsequent customs clearance procedures, to avoid customs clearance delays and unnecessary additional costs due to untimely follow-up of procedures.
