I have been a foreign trade SOHO for almost two years. Previously, I have been shipping goods under a friend's company. Recently, my friend's business has adjusted and they no longer accept my orders, so I have to find an export agency on my own.

I have contacted several agencies recently: some quoted prices half lower than others, some said they could help me avoid taxes and save costs, and others said they could receive payments on my behalf without going through formal verification procedures. I'm getting more and more worried.

I've heard from peers that some rogue agents have embezzled payments and tax refunds, leaving goods detained at the port and having to pay large penalties to clients. I currently have three containers of goods that need to book space next week, and I don't know how to choose an agency, what to check, what pitfalls to avoid. I want to ask how to find a reliable export agency.

Many SOHOs' first reaction when looking for an agency is to compare prices, which is the most common mistake: blindly pursuing low agency fees. Low-price agencies often charge various hidden fees later, such as documentation fees, customs declaration fees, tax refund handling fees, with total costs more than 30% higher than normal quotes. Worse, they may use non-compliant methods to "save costs",laying hidden compliance risks.

The chain negative reactions of non-compliant operations can easily escalate: if an agency does not have formal import/export operation rights or incomplete qualifications,it will lead to customs declaration delays, resulting in huge container detention fees and storage fees at worst,or even goods detained by customs due to qualification issues, affecting client delivery and losing long-term overseas clients. If an agency conducts illegal payment receipt on your behalf, you will be listed in SAFE (State Administration of Foreign Exchange)'s verification list, affecting the compliance records of all your subsequent export businesses, and even being listed as a key monitoring object.

The first step is to verify the agency's import/export qualifications and operating years, requiring them to provide business license and import/export right filing certificate, preferring institutions with long operating years to avoid the risk of small new agencies running away with payments.

The second step is to require signing a standardized export agency agreement, clarifying the division of responsibilities, agreeing on agency fee standards, tax refund timelines, payment receipt paths, and isolating operational risks from the contract level.

The third step is to verify the agency's tax refund and payment receipt compliance records in advance, confirming no history of non-compliant operations, cutting risks at the source. If you have already encountered a low-price trap, immediately require them to provide a full list of fees, and only arrange shipment after verifying no errors,to avoid subsequent overcharging.

Need to confirm the agency's customs declaration filing qualification in advance, confirm they have filed customs declaration rights at the export port, and have no records of customs penalties. If the agency does not have customs declaration qualification itself and entrusts a third party, confirm if the entrustment process is compliant and whether there will be errors or omissions in declaration information. For SOHOs' bulk or small-volume exports, confirm if the agency can handle customs declaration for corresponding product categories.

Some sensitive categories such as electrified products, textiles require special qualifications; if the agency lacks corresponding qualifications, the declaration will be rejected, requiring re-declaration after deleting documents, which will not only delay shipping schedules but also incur additional amendment fees. Need to ask the agency to provide past customs declaration cases for corresponding product categories in advance, confirm they have operating experience, to avoid valuation disputes and goods detention at the port.

When finding an export agency, confirm if they can arrange logistics independently or resell cargo rights to a third party. If the agency is responsible for logistics coordination, confirm their cooperation agreement with shipping companies, whether they can obtain preferential sea freight prices, and whether they will increase freight prices. Also confirm the charging standards of free storage time and container detention fees, and agree in advance that if the goods cannot be cleared at the port on time due to the agency's reasons, the container detention fees shall be borne by the agency.

For transit goods, confirm if the agency can match the most reasonable transit path, avoid container rejections at transit ports, and delay delivery timelines. Also confirm that cargo rights always belong to the SOHO, will not be disposed of by the agency without permission, and the consignee information on the bill of lading must be consistent with requirements and cannot be changed arbitrarily.

If exporting to the EU or the US, confirm if the agency can handle VAT deferral to help you save capital occupation in the import link and reduce capital costs. Some agencies will not actively inform SOHOs of the VAT deferral policy but will charge full VAT fees in advance to earn tax spreads.

Need to confirm in advance if the agency's tax structure is compliant, and whether they will transfer profits through related transactions, leading to SOHOs bearing additional non-resident withholding taxes. For tax requirements of different export destinations, the agency needs to sort out tax risks in advance to help isolate SOHOs' personal assets and business risks, and not implicate SOHOs' own asset safety due to the agency's tax non-compliance.

During the payment receipt and settlement link, confirm if the agency's payment receipt path is compliant, supporting CIPS (Cross-Border Interbank Payment System) RMB cross-border payment or only receiving payments through offshore accounts, what the exchange spread is, and whether additional settlement handling fees will be charged.

Some non-compliant agencies will require SOHOs to transfer payments to personal accounts, which is illegal settlement, will be monitored by SAFE, and may even lead to account freezing. Need to confirm the agency can provide formal settlement vouchers, all payment receipt and settlement processes comply with SAFE's regulatory requirements, no irregular hanging or balancing accounts, ensure the safety and traceability of fund flow, and avoid delayed fund arrival.

When signing the agency agreement, clarify cargo rights ownership, and agree that the agency has no right to dispose of goods without permission, even in case of fee disputes, cannot detain goods privately. Clarify the L/C (Letter of Credit) operation process, exclude soft clauses from SOHOs' rights, and agree that if the agency's operational errors lead to L/C negotiation failure, the agency shall bear corresponding losses.

Also clarify the ownership of tax refund proceeds, agree on the payment timeline after tax refund arrival, to avoid the agency misappropriating tax refunds. For goods involving intellectual property rights, confirm the agency can assist in applying for customs IPR (Intellectual Property Rights) recordation, avoid goods being detained due to infringement, and ensure smooth customs clearance.

Need to confirm if the agency has on-site staff who can handle customs inspection immediately, without SOHOs having to go to the port personally. In case of seal anomalies or machine inspection alerts, can the agency quickly cooperate with customs to conduct container stuffing/unstuffing inspection, provide corresponding declaration materials, explain goods information, avoid extended inspection time due to delayed response, and additional costs.

For goods requiring inspection and testing, can the agency connect with regular testing institutions, follow up the inspection process, obtain test reports as soon as possible, help release goods quickly, reduce detention time, avoid delayed shipping schedules, and affect client delivery timelines.

Need to confirm if the agency's export tax refund operation process is compliant, can meet the requirements of four streams alignment (logistics, capital flow, invoice flow, information flow), avoid tax verification due to non-compliant documents, and tax refund rejection. Confirm the tax refund timeline in advance: generally, regular agencies process tax refunds within 1-3 months after payment verification.

Some bad agencies will delay tax refunds and misappropriate tax funds. Confirm the agency can complete document filing, organize all export documents, purchase invoices, payment receipts, cooperate with tax authorities' verification, avoid tax refund failure due to missing documents, ensure SOHOs can receive full tax refunds on time, no fund occupation.

Choose a matching agency based on export scale and shipment frequency: for long-term stable shipments, negotiate a fixed agency fee package with the agency to reduce per-unit export costs. Confirm if the agency can adapt to commonly used trade terms, whether it can match corresponding operation processes for FOB or CIF, no additional adjustments needed.

Plan inventory linkage schemes based on shipment volume, help optimize overall export costs, avoid stockouts or overstocking, sort out the entire export link's costs, find optimizable nodes, and improve overall revenue space.
