I am the operator of a home appliance export enterprise in the Yangtze River Delta region. I have been engaged in direct export of home appliances to European and American markets for 6 years. Last year, as the European Union launched an anti-dumping investigation against Chinese home appliances, we switched to the re-export mode via Malaysia. We first ship goods to Malaysia for container swapping and labeling before sending them to the EU.

The total value of re-export orders we handled this year has exceeded 12 million RMB. Recently, I heard from peers that the re-export mode can also apply for export tax refund. Some have already received the tax refund, while others were subject to tax inspection due to non-compliant operation, not only failing to get the tax refund but also paying late payment surcharges and fines.

I am very confused now, and want to know whether export re-export trade can get tax refund at all? What mandatory conditions need to be met? Can I make supplementary declaration for tax refund for the goods I shipped before? What core risks should be avoided during operation?

Export re-export trade can fully apply for tax refund as long as it is operated in compliance with regulations. First, three core pre-conditions must be met: first, when goods are declared for departure from Chinese ports, they shall be declared as "general trade",and shall not be declared as "re-export cargo" or "transit cargo",second, the goods are finally delivered to the overseas consumer market and are not re-transported into the territory, third, full foreign exchange receipt verification is completed, and the four flows of cargo flow, fund flow, document flow and invoice flow are fully matched.

In the pre-audit stage, focus on checking the trade mode column of the customs declaration form. The trade mode must be filled in as "10 General Trade". The port of discharge on the bill of lading can be filled in as the port of the transit country, but the final destination country must be filled in as the actual consumption country. At the same time, reserve the container swapping certificate of the transit country, second leg bill of lading, and destination country customs clearance certificate as reference documents in advance.

Attention shall be paid to the connection of core nodes. The cargo ownership in the transit link shall always belong to the domestic export enterprise, and there shall be no early transfer of cargo ownership to a third party. The foreign exchange receipt can be paid by the trader in the transit country,or directly paid by the customer in the final destination country. The foreign exchange receipt amount must be completely consistent with the FOB value on the customs declaration form, and no outstanding balance on account is allowed.

In terms of abnormal response,if container detention at the transit port leads to delay of the second leg bill of lading, submit a situation explanation to the competent tax authority immediately, and reserve materials such as detention notice and ship change certificate to avoid triggering document abnormal warning. If the previous re-export orders are still within the validity period of tax refund declaration (according to 2026 policies,it is before the deadline of the VAT declaration period in April of the year following export),you can normally make supplementary declaration as long as you complete the reference documents. No tax refund declaration shall be made beyond the declaration validity period.

In the export declaration link of re-export trade, first pay attention to the filling logic of trade mode. If you mistakenly fill the trade mode as "12 Re-export Cargo" during declaration, the system will directly judge that it does not meet the tax refund conditions. Even if you modify the customs declaration form later, you need to go through the process of deleting and resubmitting the declaration, which requires an audit cycle of at least 15-30 working days, and may also trigger customs valuation inspection.

The "final destination country" column of the customs declaration form must be filled in as the actual consumption country, not the transit country. Even if container swapping and labeling operations are carried out during transit, you do not need to mark the transit information on the customs declaration form, only need to reserve the full set of documents of the transit link for reference.

If there is an error in the declaration information, you shall submit a modification application within 1 month after the departure of the goods. Modification applications exceeding the time limit will be rejected by the customs, and you will directly lose the tax refund declaration qualification.

The logistics path design of re-export trade directly affects the validity of tax refund reference documents. When selecting a transit port, priority shall be given to ports with document mutual recognition mechanism with Chinese customs. Ports that have achieved mutual recognition in 2026 include Port Klang in Malaysia, Port of Singapore, Laem Chabang Port in Thailand, etc. The container swapping certificates and second leg bills of lading of these ports can be directly used as tax refund reference materials, without additional notarization and authentication. For the container swapping operation in the transit link, apply to the shipping company for full journey cargo ownership lock in advance.

The shipper on the bill of lading shall always be the domestic export enterprise, and the shipper information shall not be modified at the transit port, so as to avoid the risk of being identified as cargo ownership transfer. At the same time, apply for a free storage period of at least 7 days at the transit port in advance to avoid the increase of logistics cost caused by container detention charges. The container detention charge vouchers shall also be reserved for reference, as supporting materials for the authenticity of the logistics link.

Attention shall be paid to avoiding related party transaction pricing risks in the tax planning of re-export trade tax refund. If the transit trader is an overseas affiliated company of the domestic enterprise, the pricing of the received goods value shall comply with the arm's length principle, and the profit margin shall be controlled within ±5% of the fair range of the same industry, so as to avoid being identified by the tax authority as transferring profits through related party transactions and triggering BEPS-related inspection.

If the transit country and China have a bilateral tax agreement, you can also apply for the VAT deferment policy. You do not need to pay import VAT in the container swapping link at the transit port, and can directly re-export the goods, which can reduce the cash flow occupation in the transit link by 10-15%. At the same time, pay attention to the local tax compliance of the transit country to avoid being deemed as a permanent establishment in the transit country and being required to pay local enterprise income tax.

Attention shall be paid to path compliance in the foreign exchange receipt link of re-export trade. The payer can be the customer in the final destination country or the transit trader. The attachment of the payment message shall be marked with the corresponding export customs declaration form number to avoid the situation that the foreign exchange receipt cannot be matched.

If you use the CIPS RMB cross-border payment path, complete the trade background filing at the bank in advance, and submit materials such as re-export trade contract and logistics path description to avoid the foreign exchange receipt being intercepted. When settling foreign exchange, you can choose exchange rate optimization tools to lock the forward settlement exchange rate, so as to avoid profit loss caused by exchange rate fluctuations.

The foreign exchange settlement vouchers shall be reserved for reference in one-to-one correspondence with the customs declaration form and foreign exchange receipt slip. If there is a delay in foreign exchange receipt, submit a deferred foreign exchange receipt application to the competent tax authority before the tax refund declaration, and the maximum extension period is 12 months.

The contract clause design of re-export trade shall prepare risk hedging in advance. The container swapping service contract signed with the transit trader shall clearly stipulate the ownership of the goods, clarify that the transit trader only provides container swapping and labeling services and shall not dispose of the goods, and at the same time stipulate the compensation liability if the transit trader leaks re-export trade information leading to anti-dumping investigation.

The trade contract signed with the final customer shall clearly stipulate the origin marking rules of the goods, so as to avoid the goods being detained by the destination country due to wrong origin marking. At the same time, add force majeure clauses to the contract to clarify the division of responsibilities for strikes at transit ports, port congestion and other situations, and the corresponding situation explanation can be used as abnormal supporting materials for tax refund reference. If branded goods are involved, complete the intellectual property customs protection recordal in advance to avoid infringement disputes in the transit link.

If the export declaration link of re-export trade is selected for on-site inspection, take the initiative to explain to the customs staff that the goods are re-exported goods and finally flow to the consumer market of a third country, and there is no need to declare transit information separately. When unpacking for inspection, ensure that the shipping marks and labels of the goods are consistent with the declaration information on the customs declaration form, and there shall be no marks indicating the transit country as the place of origin, so as to avoid being identified as false declaration by the customs.

After inspection, reserve materials such as inspection notice and goods inspection record as supporting materials for tax refund reference. If you are required to send samples for inspection and identification, take the initiative to cooperate and provide product test reports, instructions and other materials to shorten the identification cycle and avoid affecting the subsequent tax refund declaration progress. After the seal is replaced, reserve the number of the new seal in time and check it with the seal number on the second leg bill of lading to ensure consistency.

The packaging of re-export trade goods shall meet the dual packaging standards of the transit port and the destination country. Home appliance products are ordinary goods, which do not require UN dangerous goods packaging, but shall be properly treated for moisture prevention and reinforcement to avoid cargo damage during container swapping at the transit port. Prepare an accurate MSDS report in advance to clarify the material, composition and hazard level of the goods. You do not need to repeat the packaging identification when swapping containers at the transit port, and can directly use the MSDS report issued in China as the voucher.

If the goods are packed with wooden packaging, complete the IPPC fumigation treatment in advance and mark the IPPC logo to avoid the goods being detained during inspection at the transit port or destination country. The fumigation certificate shall also be reserved for reference as proof of compliant export of goods. The shipping mark on the packaging shall be clearly marked with the code of the final destination country to avoid wrong delivery of goods during container swapping.

The document filing for re-export trade tax refund declaration shall strictly meet the four-flow consistency requirements. The documents to be reserved include: export customs declaration form, special VAT invoice, foreign exchange receipt slip, full journey bill of lading (first leg + second leg), transit port container swapping certificate, destination country customs clearance certificate, trade contract. Conduct pre-declaration verification before declaration to check the matching degree of document information.

If there is a comparison abnormality, adjust it immediately, and do not force the declaration. If you receive a tax correspondence investigation, submit the full set of reference documents within 10 working days, explain the full link logic of re-export trade, and avoid tax refund failure caused by failure to pass the correspondence investigation. According to 2026 policies, the retention period of tax refund documents is 10 years, which shall not be damaged or lost, and need to be retrieved at any time during subsequent tax spot checks.

The supply chain architecture design of re-export trade can further optimize tax refund income. Choosing the mode of exporting to the transit port under FOB trade term, with the second leg transportation being responsible by the transit trader, can simplify the retention requirements of logistics documents. When declaring tax refund, you do not need to provide the original copy of the second leg bill of lading, only need to provide a copy. When carrying out cost calculation, include the tax refund income into the overall profit calculation.

The export tax rebate rate for home appliance products in 2026 is 13%, and obtaining the tax refund in compliance can increase the overall profit margin by 8-10 percentage points. If the annual re-export goods value exceeds 50 million RMB, you can also design a supply chain mode of "domestic export + transit consolidation + global distribution" to further reduce the cost of the transit link and meet the compliance requirements of tax refund at the same time.
