I am a small and medium-sized trader based in Guangzhou, focusing on importing Korean and Japanese beauty products. This month I just confirmed the cooperation with a local agency to handle 3 batches of mass-market color cosmetics imports through Huangpu Port.

I have been engaged in self-operated imports before, and always paid stamp duty based on the full CIF value of the goods. This time the agency said that under the agency import model, stamp duty is only payable based on the service fee amount, which is nearly 10,000 RMB less in total after calculation.

I am worried that their plan is non-compliant, and that tax evasion investigations will affect my company's import and export operation qualifications, or even lead to late surcharges and fines. I would like to consult what is the statutory levy standard for Guangzhou agency import stamp duty in 2026, how the tax base is defined, whether there are corresponding reduction and exemption policies, and what documents need to be retained for inspection during declaration?

The statutory stamp duty rate for agency import in Guangzhou in 2026 is 0.03%,and the tax base is only the service commission amount stipulated in the agency agreement, rather than the total CIF value of the goods, which is the core difference from the self-operated import model. Many enterprises confuse the tax calculation rules of the two models and wrongly declare based on the full goods value, directly leading to over 80% extra tax cost. Some enterprises even spend up to 3 months on the tax refund application process for overpaid tax, occupying a large amount of working capital.

Enterprises that meet the qualification of small-scale taxpayers can also enjoy the inclusive policy of 50% stamp duty reduction, where transactions with commission amount under 500 RMB in a single agency agreement are exempted from stamp duty directly. The prerequisite for enjoying this policy is that the commission amount must be separately specified in the agency agreement, and cannot be combined with goods payment, logistics fees and other expenses for valuation. Otherwise, the tax authority will directly determine the tax base based on the total amount, which will instead increase the tax burden.

Calculated based on industry average data, enterprises with annual agency import goods value exceeding 10 million RMB can save 30,000 to 80,000 RMB per year only through stamp duty compliance optimization. During declaration, they only need to retain three types of documents for inspection: the agency import agreement, service fee invoice, and copy of customs declaration form,no additional supporting materials are required, leading to extremely low operation threshold.

Under the agency import model, the "Consuming and Using Entity" and "Domestic Consignee" fields in the customs declaration form will be filled with the actual owner of the goods and the agency respectively. When declaring stamp duty, enterprises can directly use the separated subject information in the customs declaration form to prove that the transaction is a service agency instead of goods procurement, so as to avoid being assessed to pay stamp duty based on the goods value. If the subject information is not filled correctly when the customs declaration is submitted, and no valid supporting materials can be provided during subsequent tax audits, the enterprise will be required to make supplementary stamp duty payment according to the self-operated import rules.

The incurred late surcharge will be charged at 0.05% per day starting from the customs declaration date, and the late surcharge for a single shipment with goods value over 10 million RMB can reach tens of thousands of RMB at maximum. It is necessary to check the subject column information of the customs declaration form in advance before declaration. If there is any entry error, you can apply for modification within 7 days after customs clearance without paying any form modification fee. If the modification period is exceeded, you can submit a situation statement and the agency agreement to the customs to apply for a relevant supporting letter.

If the logistics fee is paid on behalf of the actual owner by the agency under the agency import model, the details of the paid-on-behalf expenses need to be separately listed in the agency agreement. If the logistics invoice is issued to the actual owner of the goods, this part of the expense does not need to be included in the stamp duty tax base. If the logistics invoice is directly issued to the agency and the agency payment attribute is not clearly specified in the agreement, the logistics fee will be recognized as a component of the agency service fee and included in the stamp duty tax base.

For a single shipment with 100,000 RMB level logistics fee, 30 RMB extra stamp duty will be paid, and the cumulative extra cost for enterprises with large annual shipment volume can exceed 1,000 RMB. Before signing the agency agreement, enterprises can prioritize requiring the agency to handle logistics expenses under the reimbursable payment on behalf model, and separately retain copies of the logistics bill of lading and freight invoice for inspection to avoid extra tax expenditure.

The new national unified stamp duty regulations in 2026 clearly stipulate that the service agreement for entrusted import agency does not belong to the goods purchase and sale contract, and stamp duty is levied only on the service commission under the category of "work contract" at a rate of 0.03%. This rule is applicable nationwide, and there is no additional local surcharge in Guangzhou.

If an enterprise has both self-operated and agency import businesses, it needs to calculate the contracts and tax amounts of the two types of businesses separately, and mixed declaration is not allowed. Otherwise, it will trigger a risk warning from the tax system, and the enterprise needs to submit relevant materials for verification.

The verification period usually lasts 15 to 30 days, which will affect the enterprise's tax credit rating. Eligible small and micro enterprises can also enjoy the 50% stamp duty reduction policy in a superposition manner, no advance filing is required, and they can directly check the corresponding preferential option during declaration.

When making foreign exchange payment for agency import service fees, it is necessary to clearly mark "agency import service fee" in the postscript, and the payment cannot be combined with goods payment. Otherwise, the mismatch between the bank-side foreign exchange payment data and the stamp duty declaration data will trigger a compliance warning from the State Administration of Foreign Exchange, and the enterprise needs to submit relevant supporting materials to explain the discrepancy. The foreign exchange payment voucher and stamp duty tax paid voucher need to be retained for inspection for a period of 10 years.

If the corresponding vouchers cannot be provided during subsequent audits, the behavior will be recognized as illegal foreign exchange payment, and the enterprise will face a fine of less than 5% of the paid foreign exchange amount. Before payment, check in advance whether the commission amount in the agency agreement is consistent with the declared stamp duty amount. If there is a small tail difference, prepare a situation statement in advance to avoid data anomalies.

When signing the agency import agreement, a separate "service commission" clause must be set up to clearly stipulate the calculation method, payment time and amount of the commission. Vague expressions such as "lump sum fee" and "comprehensive service fee" are not allowed. Otherwise, the commission and paid-on-behalf expenses cannot be clearly distinguished in subsequent tax audits, and the enterprise will be required to levy stamp duty based on the total amount.

If the commission amount is not separately specified in the agreement, a supplementary agreement can be signed to clarify relevant contents. The supplementary agreement has the same legal effect as the original agreement, and can also be used as a valid voucher for stamp duty declaration. Avoid using terms in the standard agency contract that do not clearly split expenses. Reviewing the contract content in advance can reduce more than 90% of stamp duty compliance risks.

If the actual value of agency imported goods is more than 5% different from the declared value during on-site customs inspection, the customs will issue a price verification supplementary tax notice. The supplementary import tariff and value-added tax incurred in this part do not belong to the scope of agency service fees, and do not need to be included in the stamp duty tax base.

After receiving the price verification supplementary tax notice, enterprises only need to retain the supplementary tax voucher and the price verification notice issued by the customs, which can be directly used as supporting materials in subsequent tax audits, and no additional adjustment to the stamp duty declaration amount is required. Expenses such as container unpacking fee and sample testing fee incurred during the inspection process, if paid on behalf of the actual owner by the agency, do not need to be included in the stamp duty tax base either, as long as the expense vouchers are retained separately.

Enterprises with annual agency import goods value exceeding 50 million RMB can sign cooperation agreements with agencies in the form of annual framework agreements, and declare stamp duty in one lump sum based on the total annual commission amount. They can enjoy priority verification services for large-value taxable vouchers, and avoid repeated operations of single-shipment declaration. The annual framework agreement needs to clearly stipulate the estimated annual goods value, commission rate and settlement method.

If the difference between the actual year-end settlement commission and the estimated amount exceeds 10%, the difference can be adjusted in the next year's declaration, and no late surcharge is required. For enterprises adopting the annual framework agreement model, there is no need to separately declare stamp duty for each single import shipment, which can save more than 70% of labor cost in tax declaration.

The stamp duty tax paid voucher for agency import is not a necessary document for export tax refund. However, if the enterprise also engages in export business, the compliant stamp duty declaration record will affect the tax credit rating. Enterprises with tax credit rating lower than Grade B will have their export tax refund audit speed restricted, with the audit period extended from the normal 7 working days to 30 working days, which occupies the working capital of the enterprise.

The stamp duty tax paid voucher for agency import needs to be retained for inspection together with the agency agreement and customs declaration form. If the subsequent export tax refund verification involves the corresponding import business, it can be submitted as supporting materials to speed up the verification process. Do not omit stamp duty declaration to save a small amount of stamp duty cost, otherwise it will affect the overall efficiency of export tax refund.
