I am the person in charge of a foreign trade factory that exports solid wood furniture in the Pearl River Delta. In the past two years, the European Union has imposed an additional 45% anti-dumping duty on Chinese-made furniture, and our order volume has dropped by 30%. Last year, we tried to work with an individual agent with a very low quotation to handle Thailand entrepot trade, but the origin certificate they provided was forged.
The whole container was detained at the port of Rotterdam. In the end, we paid huge fines and compensated the customer for liquidated damages, losing a total of 280,000 RMB. Now we dare not choose small agents randomly. I would like to ask what formal companies are currently engaged in Thailand entrepot trade? It is best to find service providers that can cover full-chain services including local factory affiliation in Thailand, issuance of full sets of compliant documents, sea-land-air logistics docking, and subsequent foreign exchange collection and export tax rebate. What qualifications should be focused on verification during selection?

The most common misconception in this industry is that many enterprises prioritize quotation when selecting a Thailand entrepot trade agent. Most low-price agents issue documents by affiliating with shell Thai companies, and have no actual production,inbound-outbound inventory and logistics records. Once the destination country customs launches an anti-circumvention investigation, not only will the goods be detained and the full amount of anti-dumping duties required to be supplemented, but all the enterprise's entrepot trade records in the past 3 years will be traced. The resulting fines and liquidated damages are often more than 10 times the cost saved by low quotations. In severe cases, the enterprise will be blacklisted by the destination customs and permanently denied market access.
The first step to select a service provider is to conduct thorough qualification verification. Do not only judge by the scale of the office premises in China, but focus on verifying its local resource capacity in Thailand: whether it has long-term cooperative physical manufacturing factories, whether it can provide a full set of traceable materials corresponding to the batch of goods, such as material picking slips, outbound warehouse receipts, local logistics tracks, instead of only issuing basic documents such as origin certificates and packing lists.
Prioritize service providers that can provide more than 3 years of successful entrepot trade cases for the same category of products, and require them to present customs release records of corresponding cases in the destination country to confirm that they have no previous record of failed anti-circumvention investigation. Before signing the contract,it must be clearly agreed that all losses caused by non-compliant documents including customs detention and fines shall be fully borne by the service provider, and no oral commitment shall be accepted. If the annual entrepot trade value exceeds 5 million RMB,you can request an on-site inspection of the cooperative factories and warehouses in Thailand, and start cooperation after confirming that the qualification is not a shell structure.
At present, formal Thailand entrepot trade service providers in the market are mainly divided into two categories: one is the full-chain comprehensive agent covering domestic customs declaration, local operation in Thailand and destination country customs clearance, which is suitable for small and medium-sized factories with full-trust outsourcing demands, the other is local service providers that only provide local qualifications and document services in Thailand, which is suitable for large foreign trade enterprises that have their own logistics and customs clearance resources. You can choose the matching type according to your own needs.

When selecting a Thailand entrepot trade agent, focus on verifying the compliance of its customs declaration operation, especially whether the exporter name on Thailand's local export customs declaration is consistent with the issuing entity of the origin certificate, and whether it can provide the retained copy of Thailand's export customs declaration slip. At present, the Thailand Customs has realized regular data interconnection with major destination country customs including the EU and US.
If there are logical contradictions between the customs declaration data, origin certificate and customs clearance data, such as value deviation over 10% or inconsistent product name declaration, the system will easily trigger an early warning, and the goods will be listed as the key target for anti-circumvention investigation. If you have previous entrepot trade records, you can ask the service provider to conduct pre-document logical verification to check for data deviations, and avoid joint investigation caused by conflicts between new and old records.

The route selection of entrepot logistics directly affects the risk coefficient. You need to confirm whether the Thailand entrepot trade solution provided by the service provider includes complete logistics track retention: the first-way bill of lading from the domestic port of departure to Laem Chabang Port of Thailand, the land waybill from the local Thai port to the factory/warehouse, the record of seal number after re-container loading in Thailand, and the second-way bill of lading from Thailand to the destination country.
The ownership transfer records of all documents must be clearly traceable. Do not accept the solution of directly discharging the first-way goods into a public shared warehouse in Thailand.
The inbound and outbound records of goods in public warehouses are not unique, which will easily reveal flaws during the investigation. Prioritize service providers that can provide self-owned warehouses in Thailand, which can independently control the whole process of container loading and container changing, and retain complete photos and videos to cope with investigations.

Two key nodes should be focused on for Thailand entrepot trade tax compliance: first, whether the local VAT declaration in Thailand is compliant. Whether the Thai company provided by the service provider has completed VAT declaration for all entrepot batches on time, and has no record of tax arrears or omission of declaration. If the local Thai company has tax abnormalities, all documents issued by it will be deemed invalid by the destination customs. Second, the rationality of entrepot pricing.
The value deviation between the goods exported from China to Thailand and the goods exported from Thailand to the destination country should be controlled within a reasonable range of 15%-25%. Do not have obvious under-declaration or over-declaration of value, to avoid being identified as related party transaction for profit transfer, which will trigger joint investigation by the tax authorities of the two countries. You can ask the service provider to provide the reference pricing range for the same category of entrepot goods, and make pricing plans in advance.

The compliance of foreign exchange collection links should be planned in advance. Confirm whether the service provider can provide matching foreign exchange collection paths, either receiving foreign exchange through the Thai company and then transferring it back to China, or completing foreign exchange collection and transfer through a compliant offshore account.
All capital flows must correspond one-to-one with logistics flows and document flows. Do not accept the solution of collecting foreign exchange through private accounts, which will easily trigger early warnings of China's foreign exchange regulatory authority, resulting in blocked settlement and frozen accounts.
At present, the CIPS RMB cross-border settlement channel supporting Thailand entrepot trade has been mature. Prioritize service providers that can provide RMB cross-border settlement services, which can effectively avoid exchange rate fluctuation risks and reduce compliance risks of foreign exchange collection.

When signing a contract with a Thailand entrepot trade service provider, three clauses should be optimized specially: first, the fallback clause for document compliance, which clearly stipulates that all losses caused by forged or non-compliant documents, including cargo detention losses, fines, customer liquidated damages, etc., shall be fully borne by the service provider, with clear compensation time limit specified, and vague responsibility division shall not be accepted.
Second, the response clause for anti-circumvention investigation, which stipulates that if the destination country launches an anti-circumvention investigation, the service provider must cooperate to provide a full set of traceable materials and bear all extra costs incurred during the investigation, including travel expenses and appraisal fees for on-site verification. Third, the confidentiality clause, which stipulates that the service provider shall not disclose the enterprise's customer information, goods value information and other commercial secrets, to avoid customer resource diversion.

If you apply for domestic export tax rebate when conducting Thailand entrepot trade, you need to ensure four flows are consistent: the trade contract, logistics documents, invoices and capital flow between the domestic company and the Thai company must fully match. Do not have the situation that goods are directly shipped from China to the destination country, where the logistics track does not conform to the contract, which will easily be identified as false trade, resulting in recovered tax rebate and even a fine of 1 to 5 times the tax amount.
The document filing shall retain a full set of entrepot trade materials, including first-way and second-way bills of lading, local container changing and production records in Thailand, instead of only retaining basic domestic customs declaration materials. If it is the first time to apply for entrepot trade tax rebate, you can ask the service provider to cooperate in conducting pre-verification of documents to check loopholes that do not meet tax rebate requirements, and avoid the situation that required materials cannot be provided during subsequent customs correspondence verification.
