I am a freight forwarder for cross-border fresh spice trade. I recently took an order: a foreign supplier ships the goods to Shanghai Waigaoqiao Bonded Zone for storage, and then resells them in batches to buyers in Southeast Asia and the Middle East.
The goods do not enter the domestic market throughout the process. I previously heard from peers that some entrepot trades do not require declaration, while others said they were fined over 100,000 for missed declarations. I am now unsure whether I need to make an export declaration.
If I do not declare, will it affect subsequent title transfer and customs clearance? If I declare, will it generate an unnecessary operational cost? I would like you to clarify the compliance requirements in this scenario and provide me with accurate operational guidance to avoid problems.

The most common industry misconception is assuming that all bonded zone entrepot trades do not require export declaration,or that export declaration is mandatory in every scenario. Both operations hide compliance risks.
In the scenario where goods enter the bonded zone from overseas and are directly re-exported without entering the domestic market, failing to complete the filing-type declaration will result in no record of goods entry and exit in the customs system. Upon subsequent exit, they will be judged as goods without certificates, leading to detention, port congestion, and leaving a bad compliance record for the enterprise. Serious cases may incur a fine of 5% to 30% of the cargo value. If export declaration is forcibly made when it is not required,it will generate unnecessary customs declaration fees and document fees, and will also affect the statistics of the enterprise's export tax refund quota, triggering subsequent tax audits.
Under the 2026 customs supervision rules, export declaration is required only when goods move from a domestic non-bonded area into the bonded zone and are then re-exported. For entrepot trade where goods enter the bonded zone directly from overseas, only an inward filing is required, and no export declaration is needed.
Risk isolation measures: Provide trade contracts and proof of title to the customs broker in advance for pre-audit,clarify the entry and exit path of the goods, and then match the corresponding declaration requirements. If a wrong declaration has been made, you can apply to delete the declaration and re-file within 15 natural days, which will not leave a bad record.

According to the latest requirements of the 2026 customs supervision on bonded zones, the core criterion for determining export declaration in entrepot trade is whether the place of origin is a domestic non-bonded area. If the goods originate from a domestic non-bonded area and enter the bonded zone for re-export, it is classified as domestic goods entering the zone, and export declaration must be made according to regulations to complete the upload and audit of the electronic customs declaration data.
If the goods enter the bonded zone directly from overseas and are only stored for transit before exiting, only the inward filing declaration needs to be completed, and no export declaration is required. If there are multiple title transfers, the change of title information must be reported to the customs for each transfer, without repeating the export declaration. If a valuation dispute arises, the entrepot trade contract and payment vouchers can be provided to prove ownership of the goods and accelerate the document review process.

In scenarios where bonded zone entrepot trade does not require export declaration, attention must be paid to the information marking on the Bill of Lading during logistics operations. It must be clearly noted that the goods are "transit cargo," the port of destination is the bonded zone, and subsequent re-export is required.
If a change of port or resale is involved, an application for changing the port must be submitted to the bonded zone logistics park 72 hours in advance to update the cargo storage information and avoid overdue storage fees. The storage period for entrepot goods can be applied for up to 2 years.
Goods not exported within the period will be seized and sold by customs according to law, so a shipment plan must be made in advance. For entrepot trade where goods do not enter the domestic market, you can apply for exemption from part of the storage and operation fees by submitting qualification materials to the park operator in advance.

Bonded zone entrepot trade that does not require export declaration does not involve the payment of domestic VAT and tariffs, nor does it require the determination of export tax refunds. If domestic goods enter the zone for entrepot trade and export declaration is made, the export tax refund policy can be enjoyed according to regulations, provided that the customs declaration form, transport document, and collection voucher are kept.
The profit from entrepot trade can be applied to enjoy the tax preferential policies for offshore trade according to regulations. In 2026, Shanghai bonded zones can reduce the 10% local retention portion of corporate income tax for entrepot trade profits that meet the requirements. It should be noted that the pricing of entrepot trade must comply with the arm's length principle to avoid being identified as profit transfer, which triggers tax adjustments.

In the foreign exchange settlement link, for entrepot trade that does not require export declaration, settlement and collection can be processed with the entrepot trade contract, inward filing list, and bill of lading, without providing the export customs declaration form. If it is RMB-settled entrepot trade, it can be settled directly through the CIPS system, which is simpler than foreign currency settlement, has faster arrival time, and lower exchange rate fluctuation risk.
It should be noted that the collection and payment of foreign exchange for entrepot trade must be completed within 180 days. Exceeding this period requires filing for a delay with the State Administration of Foreign Exchange, otherwise it will affect the enterprise's subsequent foreign exchange quota, resulting in the inability to settle or purchase foreign exchange normally.

The entrepot trade contract must clearly state that the storage location of the goods is the bonded zone and that they do not need to enter the Chinese domestic market, and clarify the division of declaration responsibilities to avoid subsequent disputes due to declaration issues. If multiple title transfers are involved, the contract must specify the handover time and division of responsibilities for each transfer, and the endorsement of the bill of lading must be continuous and complete to avoid title disputes.
If letter of credit settlement is involved, the requirements for declaration documents in the L/C terms must be checked. If export declaration is not required, the applicant must be asked to amend the terms in advance to avoid discrepancies due to the inability to provide the export customs declaration form, leading to refusal of payment by the bank.

After export declaration is made for domestic non-bonded goods entering the zone for entrepot trade, the filing of documents for export tax refunds must be carried out according to regulations to ensure the consistency of the four flows: goods flow, capital flow, invoice flow, and contract flow, to avoid tax inquiries. If the goods are declared for export but do not actually leave the country, it will be identified as fraudulent tax refunds, requiring the repayment of the refunded tax and generating late fees.
Entrepot trade that does not require export declaration does not need tax refund filing, will not occupy the enterprise's tax refund quota, and will not affect subsequent export tax refund businesses. If tax refund abnormalities occur, the full set of documents for the entrepot trade should be organized in time to cooperate with the tax authority's inspection and explain the actual situation of the business.

For high-frequency bonded zone entrepot trade businesses, the supply chain path can be optimized by choosing the mode of direct entry from overseas into the bonded zone to avoid unnecessary export declaration links, reduce operating costs, and shorten cargo turnover time.
For businesses that require export declaration to enjoy tax refunds, the trade structure can be adjusted by first sending domestically purchased goods into the bonded zone for entrepot trade to legally enjoy the tax refund policy and reduce the overall tax burden. According to the delivery times of different buyers, the batch release of goods can be flexibly arranged to reduce overall storage costs while complying with customs supervision requirements and balancing compliance costs and operational efficiency.
