I am a small cross-border e-commerce seller on Amazon Europe, with an annual export volume of around 30 million RMB. Most of my orders are small-batch and scattered shipments. Each time my import-export agency charges several hundred RMB per order for tax refund document organization services.

For many small orders, the tax refund amount is even lower than the service fee, making it completely unprofitable. I previously heard from peers that some merchants did agency export without declaring tax refunds, only to be summoned for tax inspection interviews later, and some were even deemed to have tax fraud, requiring tax payment and fines.

I am now extremely torn: on one hand, I want to save unnecessary costs, and on the other hand, I fear crossing compliance red lines. I want to ask if agency export without tax refund is legal? If it is legal, what requirements need to be met? Are there any subsequent regulatory risks?

First,it is important to clarify a common industry misconception: many merchants believe that forgoing tax refunds in agency export means no need to report to tax authorities. This is the core cause of regulatory risks. If the declaration obligation is not fulfilled as required, the tax system will automatically mark the export order as abnormal. First, the enterprise will be required to make up 13% VAT and surcharges at the domestic sales tax rate. In serious cases,it will trigger an income underreporting investigation, and even involve upstream and downstream tax fraud investigations, affecting the normal declaration of all subsequent import and export business of the enterprise.

Forgoing tax refunds in agency export is inherently legal, provided three core conditions are met for compliant implementation: First, confirm that the exported goods do not fall under prohibited, restricted,or explicitly exempted categories, ordinary general goods are eligible. Second, ensure the four flows are completely consistent: the principal parties, goods value, and quantity information in the commission contract, logistics bill of lading, foreign exchange receipt, and export declaration form must fully match, with no data forgery. Third, actively apply for export tax exemption. Both you and the agency must complete the tax exemption declaration for the order within the next month's tax declaration period after customs declaration, without concealing the corresponding income.

If there were previously unreported tax-exempt export orders, supplementary declarations must be completed within 3 months after discovery. Meanwhile, retain all business documents for at least 10 years to prepare for random inspections by tax and customs authorities, which will not incur additional compliance risks.

In the customs declaration process for agency export without tax refund, the "tax refund indicator" field on the customs declaration form must be checked as "tax-exempt"; checking "tax refund" or "deemed domestic sale" by mistake is prohibited. If there is a mistake, deletion and re-declaration will be required, resulting in at least 3 working days of customs clearance delay.

Additionally, the order will be added to the customs valuation anomaly list, and subsequent export declarations of similar goods within 6 months will be prioritized for inspection. The information of the domestic consignor and overseas consignee on the customs declaration must fully match the actual transaction parties; using other enterprises' names without authorization is prohibited, otherwise, it will trigger an abnormal logical check of the customs declaration, be directly rejected by the system, and may even result in administrative penalties.

Orders with waived tax refunds do not require input VAT transfer operations. The VAT input invoices from the procurement process can be directly used to offset output tax for domestic sales, without separate retention.

For export merchants with small-scale taxpayer status, no additional tax processing is needed; simply report the corresponding export income in the "tax-exempt sales" column during quarterly declarations. Do not fabricate input invoices to reduce tax burden, as this will trigger abnormal VAT input-output comparison, directly leading to inclusion in the tax inspection list, with tax payment and fines far exceeding the cost savings.

In the foreign exchange receipt process, all export-related foreign exchange income must be directly remitted from the overseas buyer's account, without third-party personal account transfers or offshore account retention for non-declaration and settlement. When settling foreign exchange, submit the corresponding export declaration form and commission contract to the bank, clearly indicating the "trade payment" nature of the funds; do not settle foreign exchange under the names of "service fees" or "labor fees".

The annual foreign exchange receipt amount must be within a 5% error margin of the total annual export declaration amount; exceeding this will trigger abnormal inspections by the State Administration of Foreign Exchange, affecting subsequent foreign exchange quota applications.

The commission export contract with the agency must explicitly include the clause: "The entrusting party voluntarily waives export tax refund rights, and both parties jointly bear the relevant tax exemption declaration obligations" to avoid subsequent rights and responsibilities disputes.

The contract should clearly stipulate the responsible party for document retention and the cooperation obligations of both parties during regulatory inspections, to prevent entrusting parties from being penalized due to document loss by the agency. Do not sign any supplementary agreements involving "tax refund sharing" or "subcontracting export" with the agency, as this will be deemed illegal subcontracting, rendering the contract invalid and leading to full confiscation of corresponding income.

Orders with waived tax refunds do not require pre-declaration for export tax refund; simply list tax-exempt income separately during VAT tax declaration. For orders that have already been submitted for pre-declaration, withdrawal operations must be completed before formal declaration, and a tax refund waiver declaration must be submitted in the system.

Once submitted, the tax refund declaration option for such goods cannot be changed within 36 months. Annual tax-exempt export income should be registered in a separate ledger, with corresponding declarations, contracts, logistics documents, and foreign exchange receipts bound in sequence for inspection. During tax authority inquiries, submit all materials within 7 working days; failure to do so will result in tax payment requirements.

Merchants with small-batch and scattered exports can choose to consolidate multiple shipments to the same destination for unified customs declaration and tax-exemption declaration, reducing document preparation costs by over 80%. For orders where the tax refund amount is lower than document costs, prioritize cross-border e-commerce declaration models such as 9610 and 9710.

These models have simpler tax-exemption declaration processes and do not require VAT input invoices, further reducing compliance costs. Do not consolidate shipments from different shippers to meet tax refund amounts, as this will trigger four-flow inconsistency inspections, leading to suspension of export qualifications for all related orders.

The probability of inspection for export orders with waived tax refunds is the same as for tax-refund orders. During inspection, proactively inform customs officials that the order is for tax-exempt export and no tax refund procedures are needed.

When container inspection is required, ensure the goods' name, quantity, and specifications fully match the customs declaration, without undeclared goods, as this will be deemed misdeclaration, subject to fines of 5% to 30% of the goods value. If goods require inspection and appraisal, submit the corresponding product test report within 3 working days; if the results match the declaration, no additional customs clearance costs will be incurred.
