We are a foreign trade enterprise specializing in 3C products. We recently procured a batch of electronic products from Ho Chi Minh City and plan to re-export them to Germany via Vietnam.
The agent we previously cooperated with said that additional certificate of origin and tariff guarantee will be required for Vietnam's re-export to Europe in 2026, and we are worried about customs clearance delays and cost overruns. Now we want to confirm the actual operational process of Vietnam's re-export to Europe, especially the special requirements for 3C products (such as smartphones and tablets), and how to avoid port detention risks caused by policy changes?

The core opportunities for Vietnam's re-export to Europe in 2026 focus on the superimposed effect of deepened RCEP dividends and new China-EU cross-border e-commerce regulations. Vietnam has revised its Rules of Origin to lower the Regional Value Content (RVC) requirement for 3C products from 30% to 25%,and added a clause that the value-added part processed in Vietnam can be counted towards EU origin, which is a key favorable policy for your re-export business. However, please note that the "digital origin verification system" implemented by German Customs starting from January 2026 requires all re-export goods to submit Electronic Origin Declaration (EOA) that connects to the Vietnamese Customs system in real time. This system is 3 times faster than traditional paper documents, but sets extremely high requirements on data accuracy.
For 3C products,it is recommended to prioritize the direct sailing route between Ho Chi Minh Port and Hamburg Port (2 sailings per week). The newly added "fast customs transit channel" on this route in 2026 supports completing customs inspection within 4 hours after the goods arrive at the port, which avoids demurrage fees. The Vietnamese exporter shall complete the "pre-classification declaration" 72 hours before the shipment departs, and the declared HS code must be completely consistent with the final declared HS code of the EU importing country, otherwise secondary inspection will be triggered. For example,a peer enterprise once misdeclared "smartphone (851712)" as "mobile phone accessory (851719)",resulting in 12 days of goods detention by German Customs and an extra demurrage fee of 300,000 EUR.
In terms of cost optimization, you can leverage the Vietnam-EU "tariff differential arbitrage": Vietnam applies 0% import tariff on EU electronic products (based on the CPTPP agreement),while the EU imposes a 6.5%-12% tariff on electronic products imported from China. You can obtain dual advantages through "Vietnam domestic value-added processing + EU FOB declaration",which not only meets EU rules of origin, but also avoids China's export tariffs. Please note that this scheme requires completing the "processing trade handbook filing" with Vietnamese Customs 30 days in advance, and retaining complete supporting documents for the processed value-added part (such as procurement invoices and production flow records).
Compliance red line warning: The General Department of Taxation of Vietnam requires all re-export trade enterprises to implement "four flows in one" (goods flow / capital flow / document flow / information flow) management in 2026,and special vigilance is needed for the "offshore company holding goods title" model. It is recommended to directly use a local Vietnamese company as the re-export entity, and complete settlement through the CIPS system to avoid exchange rate losses caused by SWIFT message delays.

Chief Customs Declaration Specialist: For 3C products re-exported from Vietnam to the EU, you need to focus on the association between the "EU Importer Registration and Identification Number (EORI)" and Vietnamese Customs. It is recommended to submit the electronic scan copy of "Origin Declaration (FORM Y)" 7 working days in advance, and prepare supporting documents including product disassembly diagrams and MSDS reports.
German Customs requires an electronic fumigation certificate for non-wooden packaging. If the 3C products contain batteries, you shall declare the UN3480/3090 dangerous goods code separately to avoid X-ray machine alarm during machine inspection.。

Senior Logistics Specialist: The route from Ho Chi Minh Port, Vietnam to Europe launches the new "dual-space transportation" scheme in 2026, which links the main sea freight space and auxiliary air freight space, shortening the transit time of goods at Hamburg Port from 72 hours to 48 hours.
You shall select "Order B/L" endorsed by the Vietnamese exporter, and purchase "title transfer insurance" to cover detention risks of goods at transit ports. Special reminder: The barge fee between Hai Phong Port and Ho Chi Minh Port will increase by 15% in 2026, so it is recommended to prioritize the "door-to-door" service of direct shipping carriers such as COSCO SHIPPING.。

Senior Tax Consultant: Vietnam implements the "re-export trade VAT deferral" policy in 2026, which allows enterprises to defer the payment of import value-added tax before goods leave the territory, only requiring submission of a "goods departure commitment letter". However, the German tax authority implements strict review on VAT deferral applications from non-physical enterprises.
It is recommended that you set up a subsidiary in Vietnam or entrust a local tax agent to handle relevant procedures. If you adopt the "Vietnam-Hong Kong" transit mode, please be alert to the 16.5% profits tax levied by the Hong Kong Inland Revenue Department on re-export income, and use CIPS RMB settlement to reduce exchange rate fluctuation risks.。

Trade Compliance Specialist: 3C product re-export involves intellectual property recordation issues. If the products contain patented chips, you shall complete recordation at the National Office of Intellectual Property of Vietnam in advance.
For foreign exchange collection, it is recommended to use the CIPS (Cross-border Interbank Payment System) to avoid "message loss" caused by SWIFT system upgrades. In 2026, the State Bank of Vietnam has required all re-export trade enterprises to bind their CIPS accounts, and submit "logistics trajectory video" as supporting evidence for each foreign exchange settlement.。

Foreign Trade Legal Specialist: Vietnam's new 2026 Re-export Trade Law adds the "exclusive agent clause", which prohibits re-exporters from representing more than 2 competing enterprises at the same time. It is recommended that you sign an exclusive cooperation agreement with the Vietnamese agent, specify the irrevocable agency right clause, and add the force majeure clause for policy changes in the contract, which stipulates that the maximum loss compensation shall not exceed 20% of the contract amount.。

On-site Inspection Specialist: Port inspection in Vietnam focuses on verifying the consistency between product serial numbers and customs declaration forms. The newly launched blockchain traceability system in 2026 requires 3C products to provide full-chain on-chain information including production batch, logistics trajectory and sales data.
If your goods are selected for inspection, you shall immediately activate the emergency response team, bring product manuals, test reports and other documents to the site for cooperation within 2 hours, to avoid goods return caused by inspection refusal.。

Special Packaging Engineer: 3C product packaging shall meet the requirements of EU REACH regulation. Lithium battery products must use short-circuit prevention packaging (such as aluminum foil bags and anti-static foam), and each package shall be affixed with the UN3480 label.
It is recommended to adopt the combination of three-layer reinforced carton and buffer air column, which can reduce the transportation damage rate from 1.2% to 0.3%, and lower the risk of packaging violation fines from European Customs.。
