I am a domestic food manufacturer newly starting cross-border business, mainly producing pre-packaged herbal health foods. This year, I just received two orders to Southeast Asia and the EU. Previously, we only did domestic sales and have never handled any food export-related processes.

I heard from peers that some manufacturers had their goods detained at domestic ports for half a month due to incomplete procedures, were fined by the destination country's customs, and eventually lost long-term cooperative customers. Now there is less than a month left until the agreed delivery date, but I still can't figure out what procedures need to be done, nor do I know the differences in requirements between different destination countries.

I also don't know if pre-packaged foods need additional special procedures. I'm afraid of missing materials when handling procedures on my own, which would delay the shipping schedule. Even if I want to find an agent to operate, I need to first clarify the overall requirements to prepare materials in advance. Can you explain in detail?

The procedure handling for food export agency is sorted in full-link order. The first step is pre-document qualification verification, which is the most error-prone link. Domestically, enterprises are first required to have import and export operation rights. Food production enterprises need to provide customs-recorded food production qualifications. Pre-packaged foods also need to complete label pre-review in advance. Labels must comply with both domestic export supervision requirements and destination country label specifications. For example, the nutrition facts table and allergen labeling required by the EU,and halal certification required by some Southeast Asian countries, all need to be confirmed completely during the document stage.

Second is core node coordination. For domestic declaration, core documents such as contracts, invoices, packing lists, export food production enterprise record certificates, and exit inspection and quarantine certificates are required. The agent will organize all documents in compliance in advance, verify the information is correct before declaration, and coordinate the three core nodes of inspection application, customs declaration, and space booking in an orderly manner to avoid node disconnection and delay the shipping schedule.

Regarding contingency plans, for common abnormalities such as unqualified labels and suspicious qualification information,a 3-5 day rectification buffer time is reserved in advance. By pre-reviewing labels and qualifications, the probability of abnormalities is reduced from the source. If on-site inspection is encountered, corresponding explanation documents are prepared in advance to speed up the inspection and release process.

Finally, there is the procedure coordination for destination country customs clearance. Corresponding customs clearance documents are prepared in advance according to the destination country's requirements, such as origin certificates and free sales certificates required by some countries, and official certification is done in advance. Finally,it ensures that the goods are shipped in compliance and cleared smoothly. A procedure list will be issued in advance for the entire process, and customers only need to prepare materials according to the list.

In the food export declaration link, it is necessary to confirm the validity of the export food production enterprise's record information in the customs system. If the record information has changed, it needs to be updated in advance to avoid rejection due to inconsistent record information. If it is agent export, it is necessary to confirm that the authorization scope of the agent customs declaration power of attorney is clear, and the commodity code classification is accurate.

The classification of food commodities is prone to differences. For example, some foods with health care functions are easily misclassified as pharmaceuticals, which will directly lead to declaration failure or even transfer to inspection. Before declaration, it is necessary to check the composition, function, and use of the commodity to confirm the correct classification. All information in the declaration documents must be consistent.

There should be no differences in product name, quantity/weight, or value. Under the integrated customs clearance declaration mode, information is shared across national ports. Any information error will affect the customs clearance speed. In case of document deletion and re-declaration, it needs to be completed within the specified time limit to avoid additional costs due to port detention of goods.

Food export has high requirements for logistics timeliness, especially for foods that require temperature control. It is necessary to confirm the route space and corresponding container configuration in advance, and complete space booking 7-10 days in advance to avoid shipment delay due to peak season overbooking or container rejection. If it is LCL (Less than Container Load) export, it is necessary to confirm that the LCL warehouse has food storage qualifications to avoid problems such as deterioration or contamination during storage.

The free storage period and demurrage fee standards at the destination port need to be confirmed in advance. The free period varies greatly between different routes. Applying for an extension of the free period from the shipping company in advance can avoid high additional costs due to delayed customs clearance after the goods arrive at the destination port. If a temporary port change is needed, it is necessary to apply to the customs for changing the declaration information in advance to avoid the goods being detained at the transit port.

The tax matters involved in food export need to be sorted out in advance. Compliant exports can enjoy the domestic value-added tax (VAT) refund policy. When goods enter the destination country for customs clearance, import VAT needs to be paid, which can be deferred through the VAT deferment mode to ease the pressure of capital occupation. If exporting through an agent, it is necessary to clarify the tax subject in advance to avoid unclear division of tax responsibilities.

The pricing of food exports between cross-border related parties must comply with the arm's length principle to avoid being identified as profit transfer and triggering relevant anti-tax avoidance investigations. For non-resident entities purchasing domestic food for export, it is necessary to clarify the withholding tax payment obligations of non-resident enterprises in advance and confirm the composition of the dutiable value to avoid the risk of tax underpayment affecting the subsequent export business.

The collection and payment of foreign exchange for food exports need to comply with current foreign exchange supervision requirements. Foreign exchange collection must be completed within the specified time limit after export, and collection and payment planning should be done in advance. Using CIPS (Cross-border Interbank Payment System) for RMB cross-border payment can avoid exchange rate fluctuation risks and reduce the transfer fees and delays associated with SWIFT payments.

If exporting through an agent, it is necessary to clarify the collection and payment path in advance. Agent settlement requires providing complete and true trade background materials to ensure compliance with the collection and payment process and avoid problems such as settlement rejection or fund suspension. For collection and payment through offshore accounts, information filing should be done in advance to ensure accurate declaration of transaction information and avoid temporary account freezing affecting capital turnover.

The trade contract for food exports needs to clearly define the responsibility division for various procedures, such as the responsibility for handling origin certificates and official certifications required by the destination country, and the responsibility for customs detention or fines due to incomplete procedures. It is necessary to check for soft clauses in letters of credit (L/C).

For example, some L/Cs require a pre-issued qualification certificate from the destination country's customs, which is usually impossible to obtain within the presentation period and may easily lead to L/C discrepancy rejection. The responsibility for procedure handling varies under different trade terms and should be clearly stipulated in the contract. For brand food exports, it is necessary to complete the customs protection record for intellectual property rights in advance to avoid goods being detained due to infringement complaints.

When food exports are subject to on-site customs inspection, it is necessary to prepare goods samples, production records, and third-party component testing reports in advance. The customs' inspection focus on food includes label compliance, component authenticity, and production qualification validity. It is necessary to check the seal authenticity in advance to ensure that the seal information is consistent with the declaration information, avoiding full container unpacking and re-inspection due to inconsistent seals, which will prolong the inspection time.

If sample inspection and identification are required, it is necessary to cooperate with the customs to provide samples of the corresponding specifications to speed up the issuance of test reports. It is necessary to check the inspection notice information in advance, confirm the goods storage location and inspection time, and arrange docking in advance to avoid missing the inspection time and causing goods to be detained at the port.

The packaging of food exports must comply with international transportation requirements and the destination country's compliance regulations. The outer boxes of pre-packaged foods need to be moisture-proof and anti-damage treated. For long-distance sea transportation, additional waterproof reinforcement is required to avoid moisture and deterioration during transportation.

For special foods that require temperature control, such as foods with added active probiotics, temperature-controlled packaging with corresponding insulation materials should be matched according to requirements to ensure component stability during transportation. Some countries have strict environmental protection requirements for packaging materials.

For example, many EU countries prohibit the use of untreated solid wood packaging. It is necessary to complete fumigation heat treatment for wooden packaging in advance and issue an official fumigation certificate to avoid goods being returned due to unqualified packaging.

To handle export tax refund for food exports, it is necessary to complete document filing in advance to ensure that the information of goods flow, capital flow, invoice flow, and contract flow is consistent, avoiding tax correspondence investigations due to inconsistent information, which will prolong the tax refund arrival time. If exporting through an agent, the agent should issue a certificate of agent export goods, and the principal should handle the tax refund procedures.

It is necessary to complete foreign exchange collection within the specified time limit; goods that do not meet the foreign exchange collection requirements cannot apply for tax refund. Tax refund declaration must be completed within the specified time limit after export.

Before declaration, pre-declaration verification should be done to check for declaration errors in advance to avoid delayed arrival due to failed tax refund review. Capital return is a compliance red line for export tax refund; it is necessary to ensure that the capital flow is fully compliant to avoid triggering compliance risks that affect tax refund eligibility.

The procedure handling for food exports can be integrated into the overall supply chain structure planning. According to the delivery date agreed in the order, the time nodes for procedure handling should be arranged in advance, linking the time for document handling, pre-review, and declaration with production and space booking nodes to shorten the overall export cycle and reduce inventory and capital occupation costs.

The responsibility division for procedure handling can be adjusted according to different trade terms to match the corresponding supply chain nodes, avoiding procedure omissions due to overlapping or blank responsibilities. For long-term and stable food export business, commonly used qualification documents can be filed in the system in advance. Only order information needs to be updated for each export, reducing the time for repeated verification, effectively improving export operation efficiency, and lowering overall operation costs.
