I am the owner of a small factory that just started cross-border export of outdoor home products this year. Last month, I found a local ordinary freight company to ship a full container of goods to the Port of Hamburg. Now the goods have been stuck and detained at the port for almost a week.

The service provider does not take any responsibility for customs clearance and subsequent formalities, and the container demurrage fee is rising every day. I am completely at a loss facing all the German-language notices. I previously heard from peers in the foreign trade circle that freight forwarders can handle such issues, but I have no idea what a freight forwarder is, nor what the essential difference is between a freight forwarder and the ordinary freight service provider I used before. What is more, I am not sure whether finding the right freight forwarder can help me solve the current problems of customs clearance, demurrage reduction and subsequent export tax rebate, for fear of randomly choosing the wrong provider again and falling into bigger pitfalls.

A freight forwarder is not an ordinary cargo transport intermediary, but a full-link cross-border service execution entity that connects cargo owners, shipping lines, customs authorities and tax departments. Its core value is not simply booking space and transporting goods, but connecting all scattered nodes in the whole import and export process,so that you do not need to contact service providers in different fields one by one,and can complete all compliance operations related to cross-border trade.

In the pre-document review phase, all documents necessary for customs clearance including your product classification code,EU EPR qualification, certificate of origin, commercial invoice and other materials will be verified simultaneously before booking space,to complete the missing items in advance, which prevents the situation that material deficiency is found after the goods arrive at the port resulting in customs detention. It can avoid more than 90% of initial customs clearance abnormalities in advance, and reduce the probability of subsequent problems from the source.

In the core node connection phase, the freight forwarder will contact the shipping line, domestic customs broker, and destination port customs clearance agent simultaneously, follow up all operations including manifest declaration,in-port transfer, and document exchange at the destination port throughout the whole process. In case of unexpected situations such as sailing delay and container rollover, alternative plans will be adjusted synchronously immediately,so you do not need to spend a lot of time communicating and coordinating different parties across time zones.

In the exception contingency phase, for the Hamburg port customs detention situation you are facing now,the freight forwarder can directly cooperate with on-site personnel at the destination port to submit supplementary explanation application for rapid inspection, and apply for a maximum 21-day free detention period at the destination port at the same time,to reduce the demurrage cost to the greatest extent. The full set of compliance documents for subsequent foreign exchange settlement and export tax rebate document filing will also be sorted out synchronously,to ensure four-flow matching and smooth passing of tax verification,so as to realize full-process compliance implementation.

Incorrect HS code classification of products is currently the top cause of customs detention at European ports. Outdoor home products are often questioned by customs for improper classification due to ambiguous marking of material composition, so it is necessary to prepare product composition test reports, production process descriptions, annotation provisions of the corresponding code and other supporting materials in advance, and submit them to the classification department of the destination port customs for advance ruling.

The domestic customs declaration data shall be completely consistent with the destination port customs clearance data in logic, and the deviation of value, weight and product name description shall not exceed 5%, to avoid secondary price verification caused by abnormal bilateral data comparison. If customs detention has already occurred, priority should be given to submitting an active explanation application to take the fast customs clearance channel, instead of blindly deleting the declaration and re-declaring, which will trigger a higher customs inspection control rate for the next 6 months.

Currently, shipping lines at major European base ports normally provide basic policies of 7-day free container period and 3-day free storage period. Long-term cooperative compliant agents can additionally apply for extension of the free container period to 21 days and the free storage period to 14 days, which can cover the buffer period of most customs clearance abnormalities.

If demurrage fees have already been incurred for your goods, you can directly submit a situation description to the shipping line to apply for fee reduction, and a reduction ratio of 30%-70% can be obtained normally. When selecting routing solutions, direct vessels have a 40% higher punctuality rate and 60% lower container rollover probability than transshipment vessels.

For goods on Europe routes with high timeliness requirements, priority should be given to locking direct vessel space. After the bill of lading is issued, the consignee and consignor information and product description content shall be checked immediately to avoid extra costs caused by subsequent document amendment.

Goods shipped to the EU can apply for the VAT deferral policy, which means there is no need to pay import VAT on the spot when the goods first enter the EU port, and the tax can be declared and deducted uniformly in the subsequent sales link, which can greatly reduce the proportion of cross-border capital occupation. The current export tax rebate rate for outdoor home products remains at 13%.

It is necessary to ensure that the declared value matches the actual transaction price, and do not intentionally underreport the value to reduce customs clearance costs, otherwise it will trigger associated transaction verification by bilateral tax authorities, and additional tax supplementary payment and fines may be incurred subsequently. For small and medium-sized foreign trade entities with annual export turnover below 5 million RMB, corresponding tax preferential policies for micro, small and medium-sized foreign trade enterprises can be matched to reduce the overall tax cost in a compliant way.

In the cross-border foreign exchange collection link, it is necessary to ensure that the payer information completely matches the order signing entity and the consignee/consignor information on the customs declaration form. The SWIFT message corresponding to each foreign exchange collection shall be archived and retained. Do not accept unknown transfers from offshore accounts to avoid triggering compliance risk control alerts from banks.

Using the CIPS RMB cross-border payment channel to settle orders in European regions can avoid exchange loss in the middle of currency conversion, reduce the exchange difference loss by about 3%, and there is no need to submit additional complex foreign exchange declaration materials. The settlement receipt of each foreign exchange settlement shall be bound one by one with the corresponding customs declaration form, commercial invoice and logistics document for subsequent retention and inspection.

When signing a contract with the freight forwarder, the liability for customs clearance exception support and the division of rights and responsibilities for demurrage reduction shall be clearly specified. Do not sign a standard contract without clear responsibility boundaries.

For outdoor home products shipped to the EU, make intellectual property customs protection record in advance to avoid goods detention caused by intellectual property infringement complaints at the destination port. After obtaining the bill of lading issued by the freight forwarder, confirm the ownership of the goods clause immediately.

Do not send the original of the bearer bill of lading at will to avoid goods ownership loss caused by delivery of goods without presentation of original bill of lading. If a letter of credit payment is agreed with the overseas buyer, verify the L/C clauses in advance, remove soft clauses, and avoid bank non-payment caused by discrepancies.

The current X-ray inspection passing rate of the Port of Hamburg is around 85%. If you receive an inspection notice, arrange on-site personnel to accompany the inspection as a priority, and sort out all product parameter descriptions and supporting qualification documents in advance, which can greatly improve the inspection efficiency.

In case of container unpacking inspection, check in advance whether the seal number is completely consistent with the seal number marked on the bill of lading, to avoid cargo damage disputes caused by mid-way container changing. If the product needs to be sent for material identification inspection, give priority to the third-party identification agency recognized by customs, and the identification report can be obtained normally in 3-5 working days, which can minimize the waiting time for inspection.

Most outdoor home products are made of solid wood or metal. Before export to the EU, fumigation treatment must be completed in advance to issue a fumigation certificate meeting ISPM 15 standards, to avoid customs detention caused by unqualified plant quarantine. Clear marks, weight and destination labels shall be marked on the outer layer of the packaging, and buffer reinforcement layers shall be added inside to avoid collision and cargo damage during sea transportation.

MSDS documents shall be compiled in advance in accordance with the latest EU standards. For coated metal furniture, the environmental protection parameters of the coating composition shall be clearly marked to meet the EU environmental compliance requirements, and avoid direct return of goods by destination port customs due to substandard environmental parameters.
