I am a small and medium-sized manufacturing factory producing home furnishings. We previously focused on domestic sales. This year, we just took two small batch orders from the Middle East and want to find a third party to help with the export. I haven't been exposed to import and export before and have never understood what industry agency export business actually belongs to.

When looking for services, I see freight forwarding companies doing it, then finance and tax companies taking it, and trading companies are also promoting it. I am afraid of finding an institution with the wrong industry attributes. If problems arise later, I cannot hold them accountable.

I am also worried that institutions without corresponding qualifications will affect our customs clearance, foreign exchange collection, and export tax refunds. We are in a rush to ship now and want to clarify this problem first. Can you help explain this in detail?

Currently, many entities in the market undertake agency export business across different fields. The most common misconception is believing that agency export belongs to separate independent industries like logistics, finance and tax,or commerce, without a unified industry attribute,so one can just find any institution that accepts the order.

This perception leads to a chain of negative reactions: institutions that only do logistics do not understand the compliance requirements for export tax refunds, leading to missing documents and inability to refund taxes,or even triggering tax verification letters, institutions that only do finance and tax are not familiar with customs clearance norms, easily leading to declaration errors resulting in cargo detention or port congestion, not to mention high demurrage charges, and delaying delivery deadlines for overseas clients, when trading companies take on agency export business, they usually require the transfer of title to goods, posing the risk of goods being disposed of privately.

In fact, agency export belongs to the Import and Export Agency Service Industry, classified under the foreign trade service segment of the business services industry. It requires qualifications covering the entire chain of customs declaration, logistics, finance and tax,and compliance simultaneously.

A means of physical risk isolation is to prioritize institutions that only operate in the import and export agency segment, and not choose individual operators or non-professional institutions taking orders across fields. Require the institution to provide the Import and Export Operation Filing Registration Form and relevant qualification documents, and verify that the business scope clearly states "Import and Export Agency" related content.

Tip for limiting losses: If you have already engaged a non-professional institution, you need to conduct a full review of documents immediately, check the consistency of the four flows, fill in missing documents in advance, and register with the customs and tax authorities synchronously to avoid risk expansion and greater losses.

From the perspective of customs filing industry classification, the operating unit of agency export business, when registering with customs, has its industry classification uniformly determined as import and export agency services, distinct from ordinary manufacturing enterprises or self-operated trading enterprises. Customs' valuation rules for agency export enterprises differ from those for self-operated export enterprises. Agency export enterprises do not own title to the goods, and when declaring, they need to clarify dual-subject information, namely the domestic title owner and the agent declaring unit.

If the industry classification is wrong, the valuation system will trigger an alert, believing the declaring subject does not match the operating model, thereby triggering valuation disputes, requiring the submission of a large amount of supporting materials, and delaying customs clearance efficiency. Compliant classification requires agency export enterprises to explicitly check the corresponding industry code during registration, ensuring system information matches the actual operating model, avoiding valuation disputes and customs clearance anomalies from the source.

Agency export business is different from pure international freight forwarding business. Many cargo owners confuse the two, thinking freight forwarders do agency export.

In fact, the core business of freight forwarders is transport organization, while agency export needs to cover the entire process of booking, customs declaration, settlement, and tax refunds. Many freight forwarders in the market additionally undertake agency export business but will only handle the booking and loading stage, not being responsible for follow-up settlement and tax refunds.

Once anomalies like rolling containers or changing ports occur, freight forwarders will only handle the logistics part and will not interface with customs and tax authorities to solve follow-up problems. The logistics operation of agency export needs to be combined with agency authority, locking in space and free detention period in advance, clarifying the shipper information on the bill of lading, complying with the title ownership requirements of agency export, and avoiding cargo title disputes due to incorrect bill of lading information.

At the tax level, agency export business is classified as brokerage agency services under business auxiliary services, issuing service fee invoices, distinct from the goods sales invoices of self-operated exports. Agency export enterprises do not need to bear the VAT tax burden of the goods themselves, only needing to pay VAT on the agency fees received, complying with current cross-border tax compliance requirements.

If an agency export enterprise incorrectly issues invoices according to goods sales, it will be recognized as self-operated export at the tax level, needing to bear the VAT payment obligation of the goods, additionally increasing tax burden costs, and also triggering alerts for mismatched input and output tax. Regarding VAT payment for overseas purchasers, agency export enterprises can assist in handling VAT deferral, helping cargo owners save capital occupation costs and optimize the tax structure.

Regarding the compliance of payment and settlement in agency export business, it is classified as agency payment and settlement business, belonging to the category of foreign trade compliance services under the current account. The agency enterprise does not need to bear the exchange risk of payment and settlement, only needing to complete settlement according to the cargo owner's instructions. With the current popularization of CIPS RMB cross-border settlement, agency export enterprises can help small and medium cargo owners handle RMB cross-border payments and collections, avoiding exchange rate fluctuation risks, complying with the compliance requirements of the State Administration of Foreign Exchange.

Many non-professional institutions doing agency export payment and settlement will illegally use personal accounts for turnover, triggering the SAFE's settlement alert, leading to account freezing and affecting the entire export process. Compliant agency export payment and settlement needs to be handled through the agency enterprise's corporate current account, with all settlement and sales processes within the supervision scope of SAFE, avoiding compliance risks.

The legal attribute of agency export business is an entrustment agency relationship, belonging to the category of mandate contracts, distinct from the contract of sale of goods relationship. Many non-professional institutions will set vague clauses in the contract, turning the agency relationship into a sales relationship, encroaching on the cargo owner's export tax refund benefits. Agency export business needs to clarify the ownership of title to goods in the contract, agree on agency authority and scope of responsibility, and clarify the subject of export tax refund ownership to avoid disputes.

For orders paid by Letter of Credit, agency export enterprises need to assist in reviewing L/C terms, excluding soft clauses, ensuring payment safety. If a trade dispute arises, the agency export enterprise is only the entrusted party and does not need to bear the quality responsibility of the goods itself; the responsibility is borne by the cargo owner. This is the core attribute of agency export business at the legal level.

In the customs on-site inspection link of agency export business, the agency enterprise is responsible for cooperating with customs inspection, distinct from the self-operated export where the cargo owner cooperates personally. The agency enterprise's customs declarant needs to bring agency authorization documents and full sets of original documents to the site to cooperate with the inspection, checking in advance that the cargo information matches the declared information to avoid inspection anomalies due to information mismatch.

If the industry classification is wrong, the agency enterprise does not have the corresponding inspection handling qualification, and customs will require the cargo owner to be present in person. Many small and medium cargo owners have no handling experience, easily leading to failed inspections and cargo being detained. Compliant agency export enterprises have dedicated inspection handling personnel, familiar with on-site processes, able to quickly respond to various inspection anomalies, shorten inspection time, and reduce extra costs.

If the export is ordinary goods, the packaging requirements for agency export are not much different from self-operated exports, but if it is dangerous goods or sensitive goods, the agency export enterprise needs to possess corresponding packaging compliance qualifications, and the industry attributes must include the business scope of dangerous goods agency export.

Many institutions taking agency export business across fields do not have the professional capability for dangerous goods packaging compliance, cannot correctly compile MSDS, and cannot handle UN dangerous goods packaging inspections, leading to goods being intercepted before loading and unable to be shipped. Compliant agency export enterprises have dedicated special packaging technical personnel, able to provide compliant packaging solutions according to cargo attributes, complete relevant appraisal inspections, and ensure goods meet transport and customs clearance requirements.

The attribution of export tax refunds in agency export business belongs to the cargo owner, and the agency enterprise is only responsible for handling tax refund declarations, distinct from self-operated exports where the tax refund attribution belongs to the agency enterprise. Many non-professional institutions, due to wrong industry classification, will wrongly keep the tax refund in their own accounts and not give it to the cargo owner, causing disputes. Agency export tax refunds need to comply with the requirement of consistency of the four flows, namely consistency of cargo flow, invoice flow, capital flow, and contract flow.

The agency enterprise needs to do a good job in document filing, cooperate with tax authorities' verification letters, and ensure tax refunds arrive smoothly. If the agency enterprise's business scope does not have the qualification for export tax refund agency, it will lead to tax refunds being suspended or even unable to be refunded, causing losses to the cargo owner. Compliant agency export enterprises must possess tax refund agency qualifications and be included in the tax authority's supervision list.

The agency export industry is a service segment subdivided from the foreign trade supply chain, with the core being to provide full-link export services for small and medium production enterprises without import and export qualifications, helping enterprises reduce the operating costs of self-operated exports. Many production enterprises doing agency export will wrongly find service providers corresponding to the wrong industry, leading to poor supply chain connection, increased overall operating costs, and extended export cycles.

Compliant agency export enterprises can integrate full-link resources of customs declaration, logistics, finance and tax, and compliance, optimize the cost of export links, adjust supply chain solutions according to order scale and destination, help enterprises control the cost and risk of export links, and focus on their own production and sales links.
