Reliable sourcing and import agency services.
We are a small and medium-sized e-commerce seller on the Taobao ecosystem that has just started import business. Recently we imported a batch of beauty products from overseas for the first time, and entrusted an agent to handle the whole process of import customs declaration. I heard from peers earlier that some unethical agents would charge VAT from the principal repeatedly, and include VAT in the service fee for price markup.
Some other friends were inspected by customs for failing to clarify the payment entity, and were required to make up tax payment plus late payment surcharge, which completely messed up their annual capital budget. Now I am totally confused: do we need to pay VAT for agency import customs declaration at all? As the principal, do I need to bear this cost?
Who is the actual entity responsible for the payment? Can I deduct the input VAT afterwards? We already have very thin profit, so we do not want to pay extra money for no reason or violate regulations, and want to get this issue fully clarified.

In the traditional agency import customs declaration mode, many small agencies will blur the definition of VAT payment entities, repeatedly charge the import VAT that should be deducted by the principal after price markup. Some other agencies mistakenly advance the VAT payment on behalf of the principal and include it in their own cost, which makes the principal unable to deduct input VAT normally, directly adding hidden costs of 10% to 13% or even higher. For small and medium-sized cargo owners, this expense is enough to eat up most of the import profit.
In the vast majority of cases, the import agency service itself is only a brokering service, and the agent only collects the agreed agency service fee. The import VAT shall be paid by the actual cargo owner, and the customs duty paid certificate can be issued directly to the actual cargo owner for subsequent input VAT deduction. If the imported goods meet the requirements of national tax reduction and exemption policies, the enterprise can apply for relevant incentives normally. Qualified enterprises can also apply for VAT deferral to postpone the tax payment link and optimize cash flow.
To optimize VAT cost,VAT Deferral Policy is currently the most highly adaptable optimization solution, which eliminates the need to pay the full amount of import VAT in advance, and greatly eases the capital pressure of small and medium-sized cargo owners.
In terms of access threshold, the policy only requires that the imported goods fall under general trade import category, the enterprise holds compliant import and export qualifications, and has no major tax violation records in the past three years. We will dynamically calculate the return ratio according to the single-batch import value and annual import scale of the enterprise, rule out scenarios that do not meet the access conditions, help the enterprise isolate the risks of double taxation and non-deductibility,realize compliant cost reduction, and will not charge any unnecessary extra service fees.

The core of import VAT payment recognition is the dutiable value of imported goods. In the customs valuation process, the customs will determine the dutiable value based on the actual transaction price of the goods, and multiply it by the corresponding tax rate to calculate the payable import VAT amount.
If the goods value is under-declared or misrepresented during agency customs declaration, the calculated VAT amount will be incorrect, which will not only lead to supplementary tax payment requirements, but also generate late payment surcharge, and even affect the enterprise's customs credit rating. If there is a valuation dispute, the enterprise needs to provide corresponding supporting documents including foreign exchange payment vouchers, original manufacturer invoices, contracts and other certification materials within the specified time limit, apply to customs for re-valuation, and adjust the payable VAT amount.
The customs broker is only responsible for submitting documents on behalf, and does not bear any responsibility for the VAT amount itself. The final tax amount is subject to the duty paid certificate issued by the customs system.

The import VAT deduction requires that the consignee name on the duty paid certificate must be consistent with the entity that conducts the deduction. For agency import, you can choose to issue the duty paid certificate to the actual cargo owner, or issue it to the agency, then the agency issues a special VAT invoice to the cargo owner.
If you choose VAT deferral, you do not need to pay VAT on the spot at the customs clearance link, and you can directly conduct input deduction and payable tax deduction in each periodic VAT filing. It is equivalent to obtaining an interest-free loan, which effectively optimizes the cash flow of the enterprise.
For enterprises that import high-value goods in particular, the capital occupation cost can be reduced by more than 30%. As long as the enterprise meets the requirements on tax credit rating, it can apply for VAT deferral.

The VAT payment can be made through the agent's account on behalf, or the actual cargo owner can pay the tax directly to customs via the E-Port system. Both methods are compliant. If you choose the agency payment method, you need to specify the tax payment path and invoicing requirements in the agency agreement, to avoid inconsistent capital flow and goods ownership which will affect subsequent input VAT deduction and foreign exchange receipt & payment verification.
For import businesses settled in cross-border RMB, the import VAT amount is converted according to the RMB exchange rate on the customs clearance date, no extra foreign exchange purchase is required for tax payment, which avoids unnecessary exchange difference loss, and the tax payment can be completed by direct deduction from domestic RMB accounts.

The agency import agreement must clearly state the VAT payment entity, payment method, and delivery time of the duty paid certificate, to avoid disputes caused by unclear rights and responsibilities. If the agent, without prior consent from the principal, includes the VAT amount into its own cost and results in the principal's failure to deduct input VAT, the principal can claim compensation for corresponding losses against the agent in accordance with the agency agreement.
If tax-exempt imported goods are involved, the provider of tax exemption qualification and responsibility division for non-compliance situations shall be clearly specified in the agreement in advance, to avoid penalties caused by improper enjoyment of tax exemption policies.

If the imported goods are inspected on site by customs, and it is found that the actual goods do not match the declared information, the customs will re-calculate the dutiable value of the goods, and adjust the payable import VAT amount correspondingly. If the originally paid tax amount is lower than the adjusted amount, the difference part of VAT shall be supplemented, and late payment surcharge calculated from the date of declaration will also be generated.
Therefore, the information of goods name, quantity and value must be checked before declaration to ensure consistency with actual situation, avoid incorrect VAT amount calculation caused by information error, eliminate unnecessary cost, and prevent prolonged customs clearance time which leads to extra port detention charges.

You can adjust the import batches and customs clearance time according to the monthly import plan of the enterprise, and optimize cash flow in line with VAT payment rules. For import categories with obvious peak and off seasons, you can stock up in advance in the off season, apply for VAT deferral, ease the capital pressure in peak seasons, and balance the tax cost of different quarters.
If the enterprise conducts both import and export business, it can adjust the rhythm of import VAT deduction and export tax rebate, optimize the overall tax cost, reduce the net tax outflow amount, and improve the capital use efficiency of the whole supply chain.

The calculation of import VAT amount has no direct correlation with the selection of trade terms. Under FOB terms, international freight and insurance fee need to be added to the dutiable value for VAT calculation. Under CIF terms, the dutiable value already includes these two costs. The calculation benchmarks are consistent, and the VAT amount will not increase due to the change of trade terms.
If you choose customs clearance at transit ports, you need to confirm the VAT administration rules of the transit port in advance to avoid double taxation. Choosing direct shipment and direct customs clearance can reduce the intermediate links of VAT payment, lower the probability of incorrect or omitted tax payment, shorten the customs clearance time, and reduce extra costs such as container detention and port detention charges.
