We are a small manufacturing factory specializing in original home goods, engaged in domestic retail and wholesale. This year we just received two batches of orders from Southeast Asian customers, who have paid the full deposit and are ready for shipment. However, our factory has no independent import and export management rights and has never done export business before.
Asking around friends, we were told that we could find an export agent. Now we are stuck on the tax refund issue. We've heard that some agent export businesses can't enjoy tax refunds, while others say the tax refunds must go to the agency.
Our profit margin for this shipment is already thin; the tax refund is almost enough to cover half of the raw material costs. If we can't get the tax refund, it means we've worked for nothing and will even lose money. We urgently need to figure out whether agent export business can indeed enjoy tax refunds, what conditions we need to meet, and what pitfalls to avoid in the operation.

First of all,it is clear that under the current 2026 export tax refund policies, agent export business can enjoy tax refunds if they meet compliance requirements. There are two common industry misunderstandings: one is that finding an agent will definitely lead to smooth tax refunds, and the other is that tax refunds must belong to the agency and cannot be obtained by the factory. Many small and medium-sized factories,in order to save service fees, find unqualified small agents to operate. The agent fails to file compliant documents as required,so not only can the tax refund not be disbursed normally,it may even be intercepted by the agent. Moreover,non-compliant documents will trigger tax inquiries, affecting the factory's own tax credit rating,in severe cases, the export tax refund qualification will be suspended. When the goods arrive at the port, the customs clearance cannot be completed due to abnormal tax refund procedures, resulting in high demurrage fees, and even being seized and auctioned by the destination port customs.
To isolate such risks, first verify the legal import and export operating qualifications of the agent in advance. Clearly specify the recipient of tax refunds and the payment deadline in the agency agreement. According to policy requirements, the principal,as the actual owner of the goods,is the actual beneficiary of the tax refund. The tax refund should be directly refunded to the principal's account. Only when the principal clearly authorizes and the agreement is clearly stipulated can the agent collect the payment to deduct relevant fees.
If you have already encountered the situation where the agent intercepts the tax refund, report to the competent tax authority with the agency agreement and the full set of export documents immediately, and suspend the payment of subsequent agency fees to avoid further loss expansion. All operations must ensure the consistency of goods, invoices, funds and documents, which is the core premise of export tax refund compliance and the core standard for tax bureau verification. This red line must not be touched. Advance document pre-auditing can eliminate more than 90% of tax refund failure risks.

The precondition for agent export tax refund is that the domestic shipper and production and sales unit on the export customs declaration form are marked according to the actual situation. According to the 2026 customs declaration form filling specifications, for the customs declaration form of agent export business, the domestic shipper shall be filled in by the agent, and the production and sales unit shall be filled in by the actual principal. The tax refund qualification corresponds to the taxpayer qualification of the production and sales unit. If the principal is a small-scale taxpayer, only tax exemption can be enjoyed, not tax refund; if it is a general taxpayer, it can apply for normal tax refund if it meets the conditions.
If the production and sales unit is filled in as the agent incorrectly in the customs declaration link, it will lead to wrong tax refund subject and fail to apply for tax refund normally, requiring deletion and re-declaration. This will not only delay the shipping schedule, but also generate additional document modification fees, and may even affect the tax refund declaration period. In case of price review disputes, provide materials such as agency agreement, purchase contract, and foreign exchange payment voucher in time to prove the actual transaction price of the exported goods, avoiding the price review being lower than the actual price and affecting the tax refund amount.

In the process of agent export business, logistics documents are one of the core materials for tax refund filing. Materials such as ocean bill of lading, air waybill, packing list, and container loading list must ensure consistent information. There must be no mismatch between product name, quantity, consignor and consignee information and the customs declaration form, otherwise it will directly lead to tax refund failure. In case of cargo re-stowage, port change and other situations, update the bill of lading information in time and re-file the documents; do not use old bill of lading materials to apply for tax refund.
If the logistics is designated by the buyer under FOB terms, require the agent to follow up in time to obtain the original bill of lading, and keep the scan and handover records, so as to avoid being unable to file documents due to the absence of the bill of lading. In addition, for additional fees such as container demurrage and port change fees, the responsible party shall be clearly stipulated in the contract, avoiding subsequent disputes over cost allocation, affecting the progress of the tax refund process, and increasing unnecessary time costs.

The tax structure involved in agent export tax refund needs to be adjusted according to the actual situation of the principal. If the principal is a manufacturing enterprise, the tax refund is calculated according to the "exemption, credit and refund" policy; if it is a trading enterprise, it is calculated according to the "exemption and refund" policy.
The calculation methods cannot be mixed, otherwise it will lead to incorrect tax refund amount, requiring correction of the declaration and delaying the payment time. Under the 2026 cross-border tax new regulations, if the agent export goods are sold to RCEP member countries in Southeast Asia and meet the origin rules, they can also enjoy double preferences: on the one hand, they can enjoy import tariff reduction and exemption in the destination country; on the other hand, they can enjoy normal export tax refund in China.
The overall tax burden can be further reduced by optimizing the tax structure. It should be noted that the pricing of cross-border related party transactions must comply with the arm's length principle. The export price cannot be deliberately raised to get more tax refund, otherwise it will be identified as tax fraud, trigger tax inspection, and bring serious compliance risks.

Compliance in the foreign exchange collection link of agent export business is a necessary condition for tax refund. According to the 2026 regulations of the State Administration of Foreign Exchange, except for special circumstances allowed by policies, foreign exchange must be collected for agent export business to apply for tax refund.
The payer of foreign exchange collection shall be consistent with the buyer of the export contract; third-party payment without filing will affect the tax refund. If RMB settlement is used, keep the message information through the CIPS system; it can be directly used as a compliance voucher when declaring tax refund without additional notarization of materials.
In case of large exchange rate fluctuations, the settlement time can be agreed with the agent in advance to lock in the exchange rate, avoiding exchange rate loss eroding the benefit of tax refund. When settling foreign exchange, ensure the consistency of capital flow and transaction; capital backflow will be directly judged as non-compliant and unable to apply for tax refund.

All agreements in the process of agent export tax refund must be reduced to a written contract; verbal agreements are not allowed. Especially core contents such as the recipient of tax refunds, payment time, service fee standard, and liability division for abnormal situations must be included in the contract terms.
If it is agreed that the tax refund will be paid to the agent and then transferred to the principal, the liability for breach of contract for overdue payment shall be clearly stipulated, avoiding the agent occupying the tax refund for a long time without disbursing it. In addition, pay attention to the agreement on intellectual property rights.
If the exported goods have brand authorization, the ownership shall be clearly stipulated in the agency agreement, avoiding the goods being seized by customs due to intellectual property issues and affecting the progress of the tax refund process. In case of tax refund disputes, the written contract is the most core basis for rights protection, which can effectively reduce the cost of rights protection and shorten the time cycle for dispute resolution.

If the exported goods are inspected on site by customs, prepare materials such as agency agreement, purchase contract, and product detail list in advance, cooperate with the customs inspection, and ensure that the actual information of the goods is consistent with the customs declaration form and tax refund declaration information. In case of abnormal seals, take photos for evidence in time, contact the terminal and customs to re-seal, avoiding failing the inspection due to seal issues and delaying the tax refund.
If there is any objection to the inspection result during the inspection, provide relevant supporting materials in time to apply for re-inspection; do not directly sign to confirm the disputed result. The wrong inspection result will directly affect the compliance of the tax refund, and subsequent corrections will take a lot of time and manpower costs, and may even directly lead to the rejection of the tax refund review.

If the exported goods are dangerous goods or special types, packaging compliance is not only a requirement for transportation safety, but also a requirement for tax refund compliance. Materials such as packaging appraisal reports, MSDS, and UN packaging numbers must be retained as contents for tax refund document filing. If the packaging is non-compliant and the goods are judged as unqualified during inspection, unable to be exported normally, it will also be impossible to apply for tax refund, and a large number of container unpacking and repackaging fees will be incurred.
Different destination ports have different requirements for packaging; adjust the packaging plan in advance according to the requirements of the destination port and prepare relevant documents. The information of all documents must be consistent with the customs declaration form and tax refund declaration information, avoiding mismatch between product name and specification and affecting the review result of tax refund filing.

Document filing for agent export tax refund is the core of compliance review. The required documents include agency agreement, export customs declaration form, bill of lading, purchase contract, foreign exchange collection voucher, packing list, etc. All materials shall be retained for at least 5 years for tax bureau review. When responding to tax inquiries, provide real and accurate materials in time; do not forge documents. The consistency of the four streams is the core of the review: the information of goods flow, invoice flow, capital flow and document flow must be completely matched.
If any link does not match, it will lead to the rejection of the tax refund review. For cross-year declarations, pay attention to the declaration period. According to the 2026 regulations, declarations can be made before the end of the next year's declaration period after export; beyond the deadline, tax refund application cannot be made anymore. Make advance time planning to avoid missing the declaration period and losing the tax refund.

The cost of agent export tax refund can be further reduced by optimizing the supply chain structure. For factories with long-term export business, fixed agency cooperation can be adopted to process tax refund business in batches, reducing the service cost per shipment and improving the tax refund disbursement speed.
Adjust the agency plan according to different order scales and trade terms; there are subtle differences in the operation process of tax refund under FOB terms and CIF terms. Adjust the structure matching plan in advance to reduce unnecessary operation costs.
The time value of tax refunds should also be included in cost calculation. Choose a compliant agent that can disburse funds quickly; after receiving the tax refund, it can be quickly invested in the next round of production, improving the capital turnover efficiency, further increasing the overall operating income, and optimizing the cash flow status of the enterprise.
