I am the owner of a micro, small and medium enterprise engaged in home goods export. I started cooperating with an agency to export to the European and American markets last year. I have only done tax declarations for domestic businesses before, and have no idea about the tax declaration process for agency exports.

Last month, three shipments to Germany and France were just completed, and now it is the quarterly reporting period. I am worried about under-declaration or non-payment triggering tax alerts that will affect subsequent shipments, and also afraid of making mistakes in documents, missing the export tax rebate declaration deadline, and suffering unjust profit loss.

I am also not sure which expenses can be deducted as input tax and which documents need to be prepared and retained in advance. Please tell me in detail how to submit agency export tax declarations in 2026 and what compliance points must be noted.

First, complete the preliminary document review. The Certificate of Agent Export Goods issued by the agency is the core declaration document. It is necessary to check in advance whether the electronic information of the customs declaration form, foreign exchange collection certificate, goods value, commodity code, and foreign exchange collection amount in the agency agreement are fully matched. The latest requirement for 2026 is that all electronic information of documents must be pre-comparisoned in the tax system 3 working days in advance. If abnormalities occur, coordinate with the agency to modify in time to avoid formal declaration being stuck.

The core nodes must be well connected. Pre-declaration must be completed before the 10th of each month, and the consistency of the four streams must be verified. If there are no problems, complete the formal declaration before the 15th. The VAT special invoice for service fees issued by the agency can be deducted normally, and at the same time, the electronic data of foreign exchange collection verification must be uploaded synchronously. The foreign exchange collection deadline shall not exceed 180 days after export. If it exceeds the deadline,it will be determined as domestic sales and subject to 13% VAT.

If abnormalities occur, handle them quickly. If the pre-declaration comparison fails, first check whether there is a commodity code declaration error,or whether the difference between the foreign exchange collection amount and the customs declaration form exceeds 5%. If the difference is within 2%,a written explanation can be provided to correct it directly. If the difference is too large, contact the agency to modify the customs declaration form or supplement documents. The abnormality handling must be completed 3 days before the end of the declaration period to avoid 0.05% daily late fee due to delay. All documents shall be retained for 5 years for inspection. When cooperating with the tax authorities' routine verification every year, submit complete documents within 10 working days to avoid the tax rebate being suspended.

In the customs declaration form for agency export, the consignor and consignee column shall be filled in with the agency, and the producer and seller column shall be filled in with the entrusting party. When declaring taxes, ensure that the commodity code, goods value, and country of origin in the electronic information of the customs declaration form and the Certificate of Agent Export Goods are fully consistent. If there is a mismatch in information, first check whether there is an error in filling in the logic check items during customs declaration.

For example, if the domestic source location is filled in incorrectly, the tax system will not be able to match the input invoice. In this case, submit a written explanation to apply to the customs for amending the customs declaration form. After the amendment is completed, the electronic information will be synchronized to the tax system within 3 working days. Do not directly delete and re-declare, because deleting and re-declaring will lead to changes in the export date, directly affecting the tax rebate declaration deadline, and even resulting in the situation that the tax rebate cannot be obtained due to delay.

When declaring taxes, a full set of transport documents shall be provided, including ocean bill of lading, road waybill or air waybill. Ensure that the consignor and consignee information on the bill of lading is fully matched with the customs declaration form and agency agreement.

If it is a transit route, retain the bill of lading transfer voucher of the transit port and transit route description to avoid being determined as abnormal transport route during tax verification and being unable to enjoy the export tax exemption policy. At the same time, apply to the shipping company for free detention period in advance to avoid container detention fee.

The container detention fee is a default expense, not part of compliant freight category, and cannot be deducted as input tax. When declaring, it shall be separately included in non-operating expenses, and shall not be mixed into freight cost for deduction.

If goods exported to the EU have handled VAT deferral, submit the deferral declaration voucher of the import country when declaring taxes. It is not necessary to pay import VAT in the import country; directly declare export tax exemption in China, and no additional tax payment is required.

The pricing of cross-border related party transactions shall comply with the arm's length principle. The pricing of agency service fees shall not exceed 10% of the industry average level, to avoid being adjusted for transfer pricing by tax authorities and generating additional income tax expenses.

If withholding tax is paid overseas, it can be credited in China with the tax payment certificate, to avoid double taxation. When crediting, provide the official tax payment certificate issued by the overseas tax authority, and bank debit vouchers cannot be used instead.

When declaring taxes, provide the corresponding foreign exchange collection certificate, either SWIFT message or CIPS payment voucher. Ensure that the foreign exchange collection party is the overseas consignee on the customs declaration form. If there is third-party foreign exchange payment, provide the tripartite payment agreement, clearly explaining the payment reason and the relationship between the three parties, to avoid being determined as abnormal foreign exchange collection.

The exchange rate difference gain generated during settlement shall be included in non-operating income for tax declaration, and shall not directly offset export costs, to avoid underpayment of corporate income tax. When purchasing foreign exchange to pay overseas expenses, retain the foreign exchange purchase voucher. If the corresponding expense is directly related to the export business, it can be declared for pre-tax deduction with the invoice and payment voucher.

When signing the agency export agreement, clarify the responsibility division for tax declaration, clearly specify which party is responsible for handling the Certificate of Agent Export Goods and which party is responsible for submitting tax rebate declaration materials. If there are late declarations or declaration errors, clarify the indemnification clauses of the responsible party to avoid being unable to pursue responsibility after losses occur.

At the same time, add an intellectual property backup clause in the agreement, clearly specifying that the agency shall review the intellectual property status of the export goods to avoid the export goods being suspected of infringement leading to customs cargo detention, affecting tax declaration and tax rebate. If infringement occurs, the agency shall bear all losses.

If the export goods are inspected by customs, retain all materials such as the inspection notice, inspection record, and test report. If the goods value, commodity code, and other information of the customs declaration form are modified after inspection, synchronize the updated customs declaration form to the tax authorities in time to avoid triggering an early warning due to inconsistent information when declaring taxes.

If the goods are submitted for inspection, retain the inspection submission voucher. When declaring taxes, apply to the tax authorities for deferred tax declaration. The maximum deferral period is 30 days, to avoid delayed declaration due to waiting for test results and generating unnecessary late fees.

If the exported goods are home goods with lithium batteries, provide a complete MSDS report and UN packaging certificate. These materials shall be retained for inspection together with other declaration documents.

If the goods are returned due to non-compliant packaging, the expenses generated from the return cannot be deducted as input tax. At the same time, explain the return reason when declaring taxes, submit the return customs declaration form and return agreement, and apply for tax exemption treatment, to avoid being determined as treated as domestic sales subject to VAT.

The packaging cost of ordinary goods is part of the export cost, and input tax can be deducted with the VAT special invoice. When deducting, ensure that the invoice content matches the packaging contract and actual goods.

The tax rebate for agency export shall be declared by the entrusting party on its own. Ensure the consistency of the four streams, namely goods flow, capital flow, invoice flow, and document flow, are fully matched. The commodity name, quantity, and unit in the input invoice shall be exactly consistent with the customs declaration form, and abbreviations or different names shall not appear, otherwise the pre-declaration will directly fail.

If a tax verification notice is received from the tax authorities, submit the full set of documents within 10 working days, including supply contract, input invoice, transport documents, agency agreement, and foreign exchange collection certificate. If not submitted within the deadline, the tax rebate application will be directly rejected, and even be required to repay the already refunded tax, and trigger subsequent tax audit at the same time.

Trade terms will directly affect the calculation of declared goods value for tax declaration. If transacted under CIF terms, freight and insurance premium shall be included in the export goods value, and the vouchers for freight and insurance premium shall be listed separately when declaring taxes, and shall not be mixed with the goods value for declaration.

If transacted under FOB terms, freight is borne by the foreign party, and does not need to be included in the export goods value; exclude the freight part when declaring to avoid overpaid stamp duty due to incorrect declared goods value. Appropriate trade terms can be selected according to their own cost structure. If domestic freight cost is high, choosing FOB terms can reduce the declared goods value, reduce the amount of stamp duty paid, and simplify the accounting process of tax declaration at the same time.
