I am a small business that supplies cross-border home goods and has not applied for import and export rights. Usually, I receive orders from overseas customers, purchase goods from domestic factories and then sell them to customers.

Previously, I always asked a friend to handle the shipment, but recently my friend no longer does this business, so I plan to find a formal export agency to operate. My most concerned issue is about tax refund.

I can obtain special VAT invoices for all purchases and conduct exchange collection normally, but I don't know whether an export agency can handle tax refund legally, and whether I will be identified as non-compliant and investigated by the tax bureau. I have heard from peers that some people who used an agency to handle tax refund were finally required to make up taxes and pay fines, so I am particularly uncertain and want to ask for specific requirements, whether it can be handled, and what conditions need to be met.

A common misunderstanding in the industry is confusing the boundary between "back-door export" and "formal agency export tax refund". Many people mistakenly think that as long as there is an input VAT invoice, claiming tax refund through an export agency is always possible. Many non-compliant small intermediaries will attract customers by using the "buying documents and matching invoices" model, which is essentially fraudulent tax refund. Many customers do not understand regulatory requirements and accidentally fall into traps.

The chain negative effects of this non-compliant model will be magnified in the 2026 regulatory environment. Currently, customs, tax authorities and foreign exchange have realized full-data network verification, and abnormal declarations will be automatically marked by the system. Once violations are found during inspection, all pending tax refunds will be frozen directly, already refunded taxes will be required to be paid back, and additional fines will be imposed,in serious cases, the enterprise will be included in the tax refund blacklist, affecting the customs clearance and tax refund qualifications of all subsequent export businesses of the enterprise, and even involving the credit record of the enterprise's legal representative.

Effective risk isolation methods first involve selecting a formal agency with complete qualifications, and secondly, taking the initiative to cooperate in implementing the requirement of four streams alignment, which refers to the full matching of goods flow, invoice flow, capital flow and contract flow, clear ownership of goods, and traceable transaction nodes at all stages. Do not cooperate with the agency to forge false documents to save costs.

If you have already worked with a non-compliant agency, the exclusive stop-loss strategy is: organize all original transaction documents as soon as possible, take the initiative to explain the situation to the competent tax bureau, convert the non-compliant model into a formal agency export model for declaration, and prepare all materials required for tax investigation in advance to cooperate with the inspection, which can minimize the impact of risks and avoid further losses. For export businesses that meet formal requirements, claiming tax refund legally through an export agency is completely possible, and as long as compliance requirements are met,tax refunds can be successfully obtained.

The core verification requirement for claiming export tax refund via an agency is the four streams alignment. During operation, core materials such as purchase contracts, agency export agreements, export goods customs declarations, special VAT invoices, and exchange collection vouchers need to be prepared in advance.

All documents must be filed within 15 days after the tax refund is declared. If a tax investigation is encountered, it is necessary to cooperate with providing payment vouchers for the purchase side, goods outbound notes, transportation documents, and the agency side's export customs clearance materials and exchange collection slips to ensure that all information matches.

Since 2026, paperless filing requires that the resolution of all scanned documents is not less than 300 DPI, and the information is clear and identifiable, to avoid delaying the tax refund progress due to unclear documents leading to failure of the tax investigation. For capital flow, it is required that the purchase payment is paid by the agency or the principal to the supplier, and third-party capital backflow is not allowed. Once capital backflow is found, the tax refund will be directly judged as abnormal and needs to be re-verified.

Claiming export tax refund via an agency can be compliant optimized in combination with the latest tax policies. Both production enterprises and trading enterprises can obtain tax refunds legally through the agency model, without applying for import and export rights by themselves, saving the cost of maintaining qualifications and operating teams. For export under cross-border e-commerce 9610, 9710, 9810 models, tax refund can also be declared in a consolidated manner through an agency, reducing the tax compliance cost of the enterprise itself.

It should be noted that the export tax refund rate varies for different goods, and the latest tax refund rate of the commodity code should be checked in advance to avoid incorrect application of the tax refund rate due to wrong code classification, resulting in over-refund or under-refund. For goods with a tax refund rate of zero, value-added tax shall be declared and paid as domestic sales, and tax refund shall not be declared in violation of regulations to trigger regulatory risks.

The exchange collection requirements corresponding to export tax refund via an agency still require that exchange collection is completed before the end of the declaration period in April of the next year after export in 2026. For businesses that meet the conditions of deemed exchange collection, corresponding supporting materials need to be prepared in advance for filing.

If RMB settlement is used, the slip settled through the CIPS system can be directly used as an exchange collection voucher without additional conversion, and the compliance is fully met. It should be noted that offshore accounts or personal accounts shall not be used to collect export payments, which will be judged as inconsistent capital flow and affect tax refund.

Even if the agency helps to operate, the tax refund will be rejected due to non-compliant exchange collection. For medium and long-term exchange collection businesses, filing with the competent tax bureau in advance will not affect the tax refund qualification.

To entrust an export agency to handle tax refund, a standardized export agency agreement shall be signed, which shall clearly stipulate the payment time and method of tax refund, as well as the compliance responsibilities of both parties, and clarify the corresponding responsibilities of the agency if tax refund fails due to the agency's operational errors. It is necessary to clarify the ownership of goods. If the principal retains the ownership of goods, the agency is only responsible for handling tax refund and customs clearance procedures.

Do not blur the ownership of goods in the agreement to avoid subsequent disputes affecting the tax refund process. If it involves letter of credit collection, the letter of credit terms shall be reviewed in advance to check for soft clauses, avoid affecting tax refund due to failed exchange collection, and all terms shall clearly define specific responsibility divisions to avoid hidden risks caused by vague expressions.

The information filling of the customs declaration directly affects the tax refund result. The domestic origin place on the customs declaration shall be consistent with the invoicing place of the special VAT invoice, and the product name, specification and model, and unit of measurement shall be completely consistent with the input VAT invoice.

If the information on the customs declaration is filled incorrectly, the tax refund declaration will directly fail, and the customs declaration shall be deleted and re-declared, delaying the tax refund progress. Under the 2026 integrated customs clearance model, customs declaration information of any port across the country can be synchronized to the tax bureau system, and no additional customs transfer procedures are required.

As long as the information is correct, tax refund can be declared normally. If a price assessment dispute is encountered, the purchase contract and payment voucher shall be provided in time to prove the real transaction price of the goods, avoiding the impact of price adjustment on the tax refund result.

Logistics documents involved in export tax refund via an agency shall retain full logistics transportation vouchers, including inland transportation documents and loading documents from the domestic supplier's warehouse to the export port, which shall be retained as filing documents and shall not be missing. If the goods need to be transferred to another port or transshipped, the customs declaration information shall be modified in time to ensure that the transportation information on the customs declaration is consistent with the actual logistics, to avoid failure of tax refund verification due to inconsistent information.

Additional trade expenses such as container detention charges and port congestion charges, as long as they are reasonable expenses, will not affect tax refund compliance and do not need to be reflected separately in the tax refund declaration, and shall be normally included in operating costs. Regardless of direct flight or transit transportation, as long as the goods actually leave the country, they meet the basic requirements for tax refund and will not affect the tax refund qualification.

If the export goods are inspected on site by customs, it is necessary to prepare the agency authorization document and the detailed list of goods in advance, cooperate with customs to complete the inspection, and ensure that the actual goods match the information declared on the customs declaration, including name, quantity and specification. If the inspection finds that the goods information is inconsistent with the declaration, the declaration shall be adjusted in time, and information shall not be concealed.

Concealing information will be identified as false declaration, affecting the tax refund qualification, and in serious cases, administrative penalties will be imposed. If inspection and appraisal are required, the official inspection report of the product shall be provided in time to cooperate with customs to complete the appraisal. If the appraisal result meets the declaration requirements, it will not affect the subsequent tax refund process, and normal declaration can be made.

For enterprises with long-term export businesses, export tax refund via an agency can optimize supply chain costs, without building professional teams for customs clearance, tax refund and logistics by themselves, saving labor and management costs, and more funds can be invested in product R&D and market expansion. The agency tax refund model can be adjusted according to the scale of different export orders: consolidated tax refund declaration can be adopted for small-batch and multi-batch orders to reduce the operation cost of a single business; large orders can be declared separately to speed up the tax refund arrival progress.

The choice of trade terms does not affect the tax refund qualification. Regardless of FOB or CIF terms, as long as compliance requirements for tax refund are met, tax refund can be handled normally, and only the transaction price needs to be accurately reflected in the documents.
