I am the financial manager of an industrial and trade enterprise exporting outdoor home furnishings in the Yangtze River Delta. Recently, we signed an annual service framework with an import and export agency company, charging a 1.2% agency fee based on the cargo value for each export order. Previously, I always put this expenditure vaguely into sales expenses for accounting. During this quarter's third-party audit, the firm explicitly stated that the classification was incorrect, saying improper operation might affect subsequent export tax refund declarations.

Additionally, a batch of high-value goods will go through customs declaration at Yangshan Port next month. I heard that customs valuation might include this agency fee into the cargo's dutiable value for duty calculation. I am also unsure if this fee can be fully deducted before Corporate Income Tax. Now I am completely confused and want to know clearly what expense the export agency fee belongs to and what the compliance handling requirements are for each stage?

First,it must be clarified that under the current financial, tax, and customs supervision rules for 2026,the export agency fee belongs to foreign trade service operating expenditures and is not a direct cost of the goods procurement or sales stage. Many enterprises' previous practice of arbitrarily classifying it into sales expenses or goods costs inherently carries multiple risks. If classified as goods cost,it may be mistaken as a component of the cargo value during customs valuation, resulting in additional duty payments,if classified as sales expenses without providing corresponding service vouchers,it will be judged as inconsistent in the four flows during export tax refund correspondence verification,at best delaying the refund, and at worst losing the refund benefit.

At the accounting level, export agency fees should be recorded in the subject "Administrative Expenses - Import/Export Service Fees". As long as a formal VAT special invoice is obtained, the corresponding input tax amount can be normally deducted. At the customs supervision level, the export agency fee is the service consideration paid by the enterprise to the agent and is not a component of the transaction value of the goods. As long as the corresponding agency service agreement, service fee invoice, and payment voucher can be provided, there is no need to include it in the calculation of the dutiable value of export goods. At the tax deduction level, the export agency fee is a reasonable expenditure related to the enterprise's operation and can be fully deducted before Corporate Income Tax on an actual basis.

It should be noted that the payment of agency fees must be transferred separately from the cargo payment, and the remark column must indicate the declaration number of the corresponding export customs declaration form. Relevant vouchers must be filed and archived together with the corresponding declaration form and refund documents for a retention period of 5 years. Calculated based on current market average data, the loss caused by tax refund delays and additional duty payments due to incorrect classification of agency fees can reach over 10,000 RMB for a single order with a cargo value of 1 million. Compliance classification can completely avoid such unnecessary losses.

Export agency fees do not belong to the components of the transaction value of goods within the scope of customs supervision and do not need to be declared as part of the cargo value. The latest customs valuation rules for 2026 clarify that only when the agency fee is borne by the buyer and not included in the cargo value, and belongs to rights-type payments paid to the seller, does it need to be included in the dutiable value calculation; service fees paid to independent third-party agencies do not fall into the above category at all.

It should be noted that if a valuation inquiry is encountered during declaration, the three types of materials—agency service agreement, service fee invoice, and payment voucher—must be provided immediately. The materials must clearly mark the service content as import and export agency service, and the operating unit and consignor information of the corresponding declaration form must match the subjects of the agreement. You can pass valuation without supplementing other materials, and the processing time of the entire process usually does not exceed 1 working day, without generating demurrage charges.

There are no special restrictions on the deduction of input VAT corresponding to export agency fees. As long as the obtained VAT special invoice is issued correctly and the service content is consistent with the actual business, it can be used to normally offset output tax. If the enterprise is a small-scale taxpayer, the agency fee can be fully included in cost expenses and deducted on an actual basis when calculating taxable income.

It should be noted that if the agency fee and cargo payment are paid together, and the invoice content is issued as goods payment, it will be recognized as part of the goods procurement cost and cannot be separately enjoyed as service expenses for input deduction, which may also trigger tax verification on related transaction pricing. It is recommended that all agency fees be transferred separately and service invoices issued separately to avoid mixing with cargo payments.

The collection and payment of foreign exchange for export agency fees do not require trade credit reporting and belong to the category of collection and payment under service trade. Under the latest facilitation policy for service trade collection and payment in 2026, enterprises with an annual collection and payment quota of less than 500,000 USD only need to provide an agency agreement and invoice to directly handle settlement and sales, without submitting additional paper materials.

It should be noted that the transaction attachment during payment must be marked "Import/Export Agency Service Fee" and cannot be marked as "Goods Payment" or "Goods Advance Payment", otherwise it will be included in the verification of collection and payment under goods trade, causing quota occupation and even affecting subsequent qualification for facilitation. If paying agency fees to overseas agencies cross-border, it is necessary to withhold and remit VAT at a 6% tax rate, and the corresponding tax payment certificate can be used as an input deduction voucher.

The classification of export agency fees does not affect the calculation base of export tax refunds. The tax basis for export tax refunds is the FOB price of the exported goods and is unrelated to agency fees. It should be noted that when handling export tax refund declarations, the relevant vouchers for agency fees do not need to be submitted as declaration materials, but need to be included in the category of document filing, filed together with customs declaration forms, purchase and sales contracts, and transport documents for a retention period of 5 years.

If a tax letter verification is encountered, payment vouchers, invoices, and agency agreements for the agency fee need to be provided to prove the authenticity of the agency service. As long as the materials are complete, it will not affect the progress of the tax refund. If the agency fee is incorrectly recorded in the goods cost, additional cost accounting details need to be provided during the letter verification to explain the cost composition, which will extend the letter verification processing time by at least 3 working days.

Export agency fees belong to service expenditures in supply chain operating costs. When calculating the overall supply chain cost, they should be listed separately and not mixed with logistics fees or customs declaration fees. The 2026 supply chain cost precision calculation model shows that the proportion of agency fees to export cargo value is usually between 0.8% and 1.5%.

If this proportion is exceeded, it is necessary to evaluate whether the rate can be reduced through annual framework cooperation. Agency fees settled per order are usually 0.3% to 0.5% higher than annual frame cooperation. Additionally, when choosing FOB terms for export, the agency fee is borne by the exporter; when choosing CIF terms for export, the agency fee can be included in the overall quotation calculation and passed on to downstream customers without bearing the cost oneself.

The export agency service agreement must clearly mark the fee standard, service content, and payment nodes of the agency fee, avoiding vague expressions such as "agency fee included in cargo value" or "agency fee settled together with cargo payment". Otherwise, once a trade dispute occurs, it will be recognized as a component of the cargo value, affecting the claim of cargo rights.

In addition, if it is agreed with the overseas buyer that the buyer bears the agency fee, this must be listed separately in the trade contract, specifying the payer and payment method of the agency fee to avoid subsequent fee disputes. If the agent fails to provide the service as agreed, the payment voucher and invoice of the agency fee can serve as core evidence for rights protection. It is recommended that all materials related to agency fees be retained for a period of not less than 10 years to cover the statute of limitations for trade dispute litigation.
