I run a small and medium-sized manufacturing factory producing household hardware. We just obtained the independent export right this year. Previously, we sold goods to domestic foreign trade companies for shipment. Now we want to directly connect with overseas customers to carry out self-operated export.

We tried to operate two shipments on our own in the past two months. First, we filled in wrong document specifications during customs declaration and the application was returned, which made us miss the scheduled shipping schedule and pay liquidated damages to the customer. Later, we did not understand the requirements for tax refund filing, and the tax refund for that shipment is still pending now.

We do not have a dedicated foreign trade operation team, and the labor cost of recruiting special personnel is too high. Recently, we have several new orders to be shipped. I am torn over whether we can hire an agent for export goods, whether there will be compliance risks, and whether the charge will be much higher than doing it on our own. I want to get clear answers to judge whether it is suitable for my situation to hire an agent.

Of course you can hire an agent for export goods. There are many formal institutions in the industry that can help small and medium-sized operators solve operational problems, but first you need to sort out common misunderstandings: many small and medium-sized manufacturers default that export agency is just "affiliation for account transfer",and they can get all things done as long as they pay the service fee,and even acquiesce in non-compliant operations to help them reduce costs.

This wrong perception will trigger a chain of negative reactions: non-compliant agency operations will lead to errors in goods declaration and customs detention in mild cases, resulting in high port detention fees, container detention fees, delayed shipping schedules and loss of customer trust,in severe cases, enterprises will be included in the customs credit warning list, affecting all subsequent export business of the enterprise, export tax refund will also be suspended, and in more serious cases, tax inspection will be triggered, resulting in tax repayment and fines, bringing irreversible losses to the enterprise.

Risk isolation at the physical level is not difficult to achieve. First of all,you need to select service institutions that hold formal import and export operation qualifications. Secondly, you must sign a standardized entrustment agency agreement, clarify the division of rights and responsibilities in each link, and keep all operation processes traceable.

We have two exclusive loss-stopping tips for you: First, before cooperation, require the institution to provide proof of no customs administrative penalty records in the past three years to exclude institutions with violation records, second, require the service provider to provide progress notification of the whole process nodes, and the document information of each link shall be confirmed by both parties before submission. For the tax refund link, clearly stipulate the time limit for fund arrival and the liability for delay,so as to avoid risks from the source. For small and medium-sized manufacturers like you who do not have a professional team, formal export agents can help you greatly reduce labor and operation costs, and it is completely suitable for you to choose cooperation.

In the export agency customs declaration link, it is necessary to check in advance whether the name, code and specification of the goods match the declaration requirements. Many small and medium-sized manufacturers are used to using the old codes of foreign trade companies when declaring on their own, which is very prone to code classification errors and lead to application rejection.

When entrusting an agent, you need to provide complete goods parameter information in advance, and the agent will conduct pre-classification review in advance, which can reduce the probability of classification errors. In case of customs price review disputes, formal agents will prepare transaction contracts, foreign exchange payment vouchers, price records of similar goods and other materials in advance to assist the customs in completing the price review, which is more efficient than enterprises handling it on their own.

If there has been a situation of application rejection or document deletion, the agent can also quickly connect with the customs to complete the document modification and re-declaration, minimizing the delay time and reducing the generation of additional costs. Under the integrated customs clearance mode, formal agents can cooperate with national ports to complete declaration, and ensure smooth process even if the goods are shipped from other places.

When entrusting an export agent for operation, the agent will integrate the space resources of multiple shipping companies and freight forwarders. Small and medium-sized manufacturers have small order volumes, so it is difficult for them to get preferential freight rates, while agents can get bulk discounts, which can reduce logistics costs. In case of space shortage and container dumping, agents have the resources to prioritize container allocation, which can help you adjust to the nearest shipping schedule for shipment and reduce delays.

If you need to change the port of destination, the agent can connect with the shipping company in advance to complete the port change procedures and assist in applying for exemption of unnecessary surcharges. For container detention fees and free storage period, the agent can apply to the shipping company for extending the free storage and free rental period in advance, which can save you thousands or even tens of thousands of yuan of additional costs in peak seasons. At the same time, the agent will help you control the ownership of the goods, and the bill of lading information will be checked and confirmed in advance to avoid the risk of loss of goods ownership.

Export agents can help you with cross-border tax planning. If you export to regions such as the European Union, they can help you operate VAT deferral, so you don't need to prepay value-added tax in the import link, which can help you revitalize cash flow and reduce capital occupation costs. For different export transaction modes, the agent can help you sort out the cross-border tax structure, isolate the tax risks of different businesses, and avoid tax inspections caused by unreasonable related party transaction pricing.

For transactions with non-resident customers, they can help you handle the compliant declaration of withholding tax to avoid missed payment. Formal agents will update the tax policies of different destination countries in real time and adjust operation plans, and will not operate with outdated policy rules, which can help you avoid tax minefields in destination countries and reduce the overall tax cost.

In the cross-border foreign exchange receipt and payment link, formal export agents can help you complete compliant foreign exchange settlement. Relying on the CIPS RMB cross-border payment system, they can help you shorten the foreign exchange receipt time and reduce exchange rate loss. For small and medium-sized manufacturers that do not have a professional foreign exchange settlement team, agents can help you with foreign exchange settlement and account reconciliation, match the transaction background to complete the foreign exchange receipt and payment declaration, which meets the compliance requirements of the State Administration of Foreign Exchange, and will not lead to the situation that the account is pending and foreign exchange cannot be settled.

If you use an offshore account to receive payment, the agent can help you complete the compliant management of the offshore account, sort out the foreign exchange receipt and payment chain, and meet the compliance inspection requirements. The agent can also help you choose the appropriate time for foreign exchange purchase and settlement according to the real-time exchange rate trend, optimize exchange rate income, and reduce losses caused by exchange rate fluctuations.

When entrusting an export agent to handle tax refund, the agent will help you complete document filing and pre-declaration verification, and check the problem of inconsistency of four flows in advance to avoid pending tax refund. For tax correspondence, the agent will prepare complete transaction materials in advance to assist in completing the correspondence process and improve the probability of passing the correspondence.

Many small and medium-sized manufacturers often have problems such as cross-month declaration errors and non-compliant capital return when operating on their own, leading to tax refund failure. Formal agents will help you sort out the capital and document chains to ensure that all links meet the tax refund requirements.

They can also help you follow up the tax refund progress and handle abnormal problems in time to ensure that the tax refund is received on time. The agent will regularly check the compliance of your tax refund and check risks in advance to avoid hidden dangers affecting subsequent tax refunds.

When exported goods are inspected by the customs on site, the agent has special personnel to connect with the site, can interpret the inspection notice in advance, clarify the core direction of the inspection, and prepare the corresponding document materials in advance. If container unloading for inspection is required, the agent can coordinate with the yard to arrange container unloading, shorten the inspection waiting time, and identify the authenticity of the seal in advance to avoid the situation of goods being swapped.

If inspection and appraisal are required, the agent can follow up the inspection process, obtain the test report in time, assist the customs in completing the judgment, shorten the overall inspection duration, reduce the time of goods detention at the port, and reduce additional costs. It is more efficient than sending personnel to the site for handling by enterprises themselves, and can avoid many detours.

When entrusting an export agent for cooperation, all rights and responsibilities will be reflected in the entrustment agreement. The agent will help you review various clauses in the agreement to avoid hidden risks, and clarify the division of rights and responsibilities for links such as goods right transfer and payment collection to avoid disputes. For letter of credit payment from overseas customers, the agent can help you check the soft clauses of the letter of credit in advance to avoid the situation that you cannot receive payment due to clause traps.

In case of trade disputes, the agent can provide complete transaction chain records as evidence in legal disputes to protect the legitimate rights and interests of the exporter. At the same time, they can assist in handling the intellectual property customs protection record to avoid goods being detained due to counterfeiting and infringement, and do a good job in risk avoidance at the legal level in advance.
