I am {$random_name}, a company engaged in transshipment trade between Southeast Asia and Europe. Recently, a shipment of fictitious transshipment goods I handled at Shanghai Port was seized by customs! Now the entire 200 tons of electronic components are stacked at Yangshan Port. The freight forwarder informed me that detention fees totaling 180,000 yuan have been incurred due to exceeding the free storage period.

The finance department just notified me that our bank account has been frozen by customs. I’m so anxious I can’t sleep at night. I heard that fictitious transshipment is considered smuggling, which not only leads to fines but may also impact our enterprise credit rating. We did this to boost performance at the time, hiring a shell company as the intermediary.

Now all documents are fake, even the cargo ownership endorsement is forged. Customs has contacted us to give a statement. I want to know if there are ways to reduce losses besides cooperating with the investigation? Can we still protect our enterprise’s credit?

When fictitious transshipment trade is detected by customs,a reverse-tracing response must be launched immediately: first, clarify the terminal abnormal outcomes — cargo detention at port, account freezing, and fake document records being filed, which are typical penalty characteristics of customs for "lack of real cargo ownership + broken capital closed-loop".

Tracing back to source loopholes is critical: the core issues of fictitious transshipment lie in fake document chains (e.g。forged transshipment trade contracts/bill of lading endorsements),unclear cargo ownership (failure to actually control the cargo),and broken capital closed-loops (fictitious foreign exchange collection paths). All forged links must be sorted out immediately, with focus on three fatal loopholes: transshipper qualification documents (shell company filing information),proof of actual cargo flow (whether consistent with the declared route),and capital flow matching degree (whether domestic and foreign matching transactions exist).

Immediate emergency countermeasures involve three steps: ①Voluntarily apply for suspension of compulsory measures, submit real cargo ownership proof (such as a commitment letter from the actual controller) during customs inspection, and strive to transfer the cargo to a supervised warehouse instead of direct seizure,②Cooperate with tax authorities to pay supplementary taxes,in accordance with Article 63 of the 2026 updated Tax Collection and Administration Law,paying supplementary VAT and late fees for fictitious transactions can help secure lenient treatment,③Initiate foreign exchange verification simultaneously, trace abnormal capital flows via the CIPS system, and submit a "no subjective intent" explanation letter to the bank.

Long-term risk control requires building three closed loops: document compliance review closed loop (add a transshipper qualification pre-screening list including local chamber of commerce certification),cargo ownership visualization closed loop (adopt blockchain evidence storage + GPS container tracking),capital penetration closed loop (access the foreign exchange bureau monitoring system for automatic early warning).

Customs’ key verification focus for fictitious transshipment is "Four Flows Consistency": contract flow (must reflect the real trade relationship between the transshipper and final buyer), cargo flow (must provide ocean bill of lading endorsement + actual customs declaration form), capital flow (must match CIPS message SWIFT MT103), document flow (certificate of origin/packing list must bear double endorsement seals). It is recommended to contact a chief customs declaration expert immediately to prepare an Supplementary Explanation Letter on Transshipment Trade Authenticity, focusing on explaining "why this transit port was chosen", "proof of value-added services in intermediate links", etc., while applying for Pre-classification Ruling to reduce classification dispute risks.

At the logistics end, Cargo Ownership Transfer Preservation must be initiated immediately: if the cargo has been inspected by customs, contact the shipping company promptly to issue an "Non-negotiable Bill of Lading" (Note: Starting from 2026, customs mandates that bills of lading for transshipment cargo must display the phrase "For Transshipment Only"), and apply for a "Customs Supervised Cargo Transshipment Certificate" for the destination port simultaneously to avoid being deemed smuggling due to "Delivery Without Bill of Lading". Detention fees can be claimed from the freight forwarder via the "Force Majeure Clause" (must prove the delay was caused by customs investigation), with a maximum possible reduction of 50%.

On the taxation front, the 2026 new policy requires VAT Deferral + Differential Tax Payment: fictitious transshipment requires supplementary VAT payment (13% of cargo value), but you can apply for VAT credit refund using the "Transshipment Trade Tax Payment Certificate" (must comply with the Provisions on Zero Tax Rate and Tax Exemption Policies for Cross-border Taxable Activities). Meanwhile, verify "Non-resident Enterprise Income Tax": if overseas transshippers are involved, declare in accordance with the new Measures for the Administration of Cross-border Payments by Non-resident Enterprises to avoid double taxation.

For foreign exchange settlement, initiate "Cross-border RMB Payment" simultaneously: launch "Cross-border Trade RMB Settlement" via the CIPS system (to avoid SWIFT messages being marked as "suspicious transactions"), submit an "Explanation on Abnormal Capital Flows" to the foreign exchange administration, focusing on explaining technical reasons for "Deviation in Foreign Exchange Collection Path" (e.g., payment delays caused by exchange rate fluctuations), and strive to adjust the account status from "frozen" to "restricted payment".

Foreign trade legal teams must immediately prepare an "Application for Customs Administrative Penalty Hearing", in accordance with Article 12 of the 2026 Customs Administrative Penalty Hearing Measures: if there is "minor circumstances and timely correction" (e.g., voluntarily paying supplementary taxes and revoking fake documents), you can apply for lenient punishment (adjusting fines from 1-5 times cargo value to 0.5-3 times). Meanwhile, verify "Validity of Bill of Lading Endorsement": if forged endorsement is involved, contact a lawyer promptly to issue an "Endorsement Invalidity Declaration" to avoid escalation of criminal liability.

For on-site inspections, focus on cooperating with "Inspection Document Authenticity Verification": starting in 2026, "Machine Inspection Probability" checks are added (verifying if cargo density matches declarations via X-ray), so it is recommended to prepare "3D Cargo Density Maps" (including packaging material density and internal filler information) in advance. If unpacking inspection is required, record the entire process to retain evidence of "Seal Integrity", to avoid being labeled as "concealing smuggled goods".
