As a cross-border e-commerce supply chain enterprise, we plan to entrust an agency to import a batch of niche cosmetic raw materials recently. We have never engaged in such business before, and we heard that import agency may easily cross the compliance red line, for example, it may be identified as foreign exchange arbitrage, or the goods may be detained due to inconsistent documents.
We want to know whether it is legal to normally entrust an agency to import products, if there is a clear compliance boundary, what penalties we will face for non-compliant operations, and how to confirm that the cooperating agency is formal and legitimate?

The core of the legality of agency-imported products lies in full compliance with the regulatory requirements of multiple departments including customs, tax authorities and foreign exchange administrations. The updated import agency regulatory rules released by the General Administration of Customs of China in 2026 have clarified the compliance judging criteria. First of all,the qualifications of the entrusting party and the agency should be clarified: the entrusting party shall have legal import and export operation right, and the agency shall complete customs declaration filing and hold corresponding qualified agency qualifications.
Pre-document review is the first step of compliance,it is critical to verify that the declared product name and HS code are consistent with the actual goods, and prepare a full set of documents including certificate of origin,3C certification (for regulated goods that require it),purchase contract, commercial invoice and so on. Underreporting or overreporting of cargo value,or false declaration of product name is strictly prohibited, otherwise customs valuation disputes or even cargo detention will be triggered.
Core node connection shall strictly implement the "four flows consistency": contract flow, invoice flow, logistics flow and capital flow must correspond with each other one by one. The agency shall truthfully declare the trade background to the customs, and cooperate with the completion of integrated customs clearance declaration and tax payment. The new VAT deferral policy launched in 2026 can ease the capital pressure of enterprises, but it is required to complete qualification filing in the customs declaration system in advance to ensure subsequent tax declaration compliance.
Abnormal response plans shall be prepared in advance. If the goods are detained by the customs, supplementary declaration materials including cargo composition test report, transaction price proof and others shall be submitted within 7 working days. If sensitive goods are involved, confirm with the agency in advance whether they conform to import prohibitions,to avoid cargo confiscation caused by prohibited items.
For final compliant implementation,a full set of documents including customs declaration form, tax receipt, bill of lading, foreign exchange receipt and payment vouchers and others shall be kept,to meet the document filing requirements for 2026 cross-border e-commerce imports. As long as the regulatory requirements are followed throughout the whole process, entrusting a formal agency to import products is completely legal, and can effectively avoid all kinds of trade risks.

The legality of import agency first depends on the accuracy of HS code classification. In 2026, the General Administration of Customs of China updated the supervision conditions of some consumer goods, and added electronic declaration verification requirements.
If the agency fails to classify the goods correctly, it will trigger valuation disputes, and the customs may determine that the declared cargo value is too low. Under this circumstance, transaction price proof materials such as purchase contracts, payment vouchers, third-party test reports shall be provided.
If the goods are detained, supplementary declaration materials shall be submitted within the specified time limit, otherwise high port demurrage will be incurred, which may also lead to temporary cargo detention. The entrustment agreement shall clearly define the responsibility division of both parties, the agency is only responsible for the customs clearance procedure, and the cargo ownership belongs to the entrusting party, so as to avoid cargo ownership disputes.

The compliance of import agency is closely linked with the logistics process. In 2026, there is still periodic space shortage in the global maritime transport market, and the free storage period of some routes is shortened to 3 days.
If the agency fails to arrange cargo pickup in time, extra container demurrage will be incurred. Bill of lading endorsement and transfer shall comply with the regulations of the International Maritime Organization, straight bill of lading shall not be transferred arbitrarily, and the agency shall confirm that the consignee on the bill of lading matches the entrusting party or its designated subject.
In terms of cargo ownership control, the agency shall not dispose of the goods without the written authorization of the entrusting party, otherwise it will involve legal risks of embezzling cargo ownership. It is recommended to prioritize agencies with direct sailing route resources, to reduce port demurrage time in transit links.

Tax compliance is a critical part of import agency legality. The new VAT deferral policy implemented by China Customs in 2026 allows import value-added tax to be paid after the goods are sold, which can ease the capital pressure of enterprises, but the agency shall correctly declare the deferral qualification when submitting customs declaration. Related party transaction pricing shall comply with the arm's length principle, to avoid being identified as BEPS behavior by tax authorities.
If the entrusting party and the agency are affiliated enterprises, contemporaneous documents shall be provided to prove the rationality of pricing. Foreign exchange settlement shall use compliant channels such as CIPS or SWIFT system, non-compliant offshore accounts shall not be used for settlement, otherwise penalties will be imposed by foreign exchange administrative departments.

The compliance of import agency is inseparable from compliant foreign exchange receipt and payment operations. In 2026, the State Administration of Foreign Exchange updated the regulatory requirements for cross-border foreign exchange receipt and payment, all import foreign exchange payments must have real trade background.
The agency shall review the import contract, customs declaration form and other documents of the entrusting party, to ensure that capital flow is consistent with goods flow. SWIFT messages shall clearly mark the payment purpose as "payment for imported goods", vague descriptions are not allowed, otherwise the messages will be returned by banks.
RMB settlement shall be completed through the CIPS system, to ensure traceable capital flow and avoid problems in foreign exchange settlement and account balancing. The agency shall provide detailed foreign exchange receipt and payment records on a regular basis, to facilitate the entrusting party's financial accounting work.

The legality of import agency requires support from complete legal agreements. The entrustment agreement shall clarify the rights and obligations of both parties, including the customs declaration responsibility of the agency, cargo ownership, breach of contract liability and other clauses.
The intellectual property rights of imported goods shall be compliant. For branded products, brand authorization letters shall be provided, otherwise the goods will be detained by customs and face infringement risks.
The use of performance bonds shall be prudent, the bond amount, validity period and trigger conditions shall be clearly defined to avoid unnecessary disputes. The force majeure clause shall cover possible scenarios in 2026 such as extreme weather, port strikes and other situations, to clearly divide the responsibilities of both parties.

On-site customs inspection directly affects the legality of import agency. In 2026, the customs implements the dual random mode combining machine inspection and manual inspection. The agency shall prepare for packaging in advance, dangerous goods shall use UN standard compliant packaging and provide MSDS reports.
If the goods are selected for inspection, the agency shall cooperate with customs to complete unpacking inspection, and make sure the seal is intact and has no trace of replacement. When passing through the machine for inspection, avoid loading high-density goods, otherwise abnormal inspection will be triggered. If the goods are found inconsistent with the declaration, contact the entrusting party immediately to provide supplementary explanatory materials such as composition test report, actual use description and others, to avoid cargo confiscation.
