I am a small and medium-sized import and export merchant with three years of experience in cross-border business. This year, I plan to outsource the whole business of customs declaration and tax payment to an import and export agency. When I operated on my own before, I was unfamiliar with the latest cross-border tax policies, so I paid more than RMB 100,000 of unnecessary tax every year, and was even fined once for wrong declaration.

Now when switching to the agency mode, I am afraid that the agency will not help save tax, but will add a lot of hidden tax-related expenses, and even lead to supplementary tax payment and fines later due to non-compliant operations. I really want to figure out whether the actual tax payment for import and export agency services is high, whether it will be higher than that of my own operation, and whether you can sort out the cost composition here and introduce feasible paths for compliant tax reduction.

Under the traditional self-operated import and export mode, high tax costs mainly come from two problems: first, unfamiliarity with the latest cross-border tax preferential policies, failure to enjoy corresponding reduction, exemption and deferral policies, resulting in unnecessary extra tax payment,second,non-standard declaration procedures, leading to customs valuation disputes, wrong declaration and other problems, which eventually result in extra expenses such as supplementary tax payment and fines. When many small and medium-sized merchants operate on their own,for import VAT alone, they cannot handle deferral compliantly, which not only occupies a large amount of cash flow, but also bears a lot of unnecessary tax difference costs.

Import and export agency services themselves do not require extra tax payment. The essence of the agency mode is to help enterprises handle the declaration and tax payment procedures on their behalf. The tax itself is paid according to the actual value of goods and corresponding tax rates in accordance with the law,and the tax amount will not increase out of thin air. Some non-compliant small agencies in the industry will charge hidden tax-related service fees, which gives merchants the illusion that "agency tax payment is higher".

At present, the compliant optimization paths mainly include three directions: VAT deferral, tax difference planning and export tax rebate optimization. Among them,VAT deferral can effectively delay more than 90% of import VAT expenditure, reducing capital occupation cost and tax difference loss. The access threshold only requires an annual import volume of more than RMB 1 million and compliant goods without prohibited items, which can be met by most small and medium-sized import and export merchants.

Finally,we will dynamically calculate the return ratio under different modes according to your goods category, annual trade volume and import and export ports, sort out the flow and purpose of each tax clearly, help you reduce the actual tax cost within the compliant framework, and will not incur any hidden tax-related expenses.

The core composition of import and export tax includes import tariff, import VAT, export-related stamp duty, etc. The agency mode will not change the calculation basis of tax, and all taxes are calculated according to HS code, actual goods value and corresponding statutory tax rates. Different planning methods can be adopted for different trade types.

For example, B2C import express parcels can enjoy an approved levy rate lower than that of general trade, general trade imports can apply for VAT deferral compliantly, and exports can enjoy tax rebate preferences. As long as the operation is compliant, no additional tax obligation will be incurred.

Some bad institutions will split service fees into taxes to charge merchants, which will lead to an increase in overall expenditure. It is necessary to distinguish between service fees and statutory taxes, and clearly mark the composition of various fees when signing the agency contract to avoid being charged extra fees in disguised form.

The amount of tax payment is directly related to the customs valuation result of customs declaration. Under the agency mode, professional institutions will conduct a compliant review of the declared price of goods in advance, compare the price of similar goods in the customs database, adjust unreasonable declared prices in advance, and avoid being questioned by customs valuation, which may lead to supplementary tax payment and late fees.

When many merchants declare on their own, they do not understand customs valuation rules, and the declared price does not meet customs requirements, which eventually leads to price verification and supplementary tax payment, increasing the actual tax amount instead. Professional agencies will sort out the logical closed loop of declaration documents in advance to ensure that the declared price is consistent with the transaction contract and foreign exchange payment vouchers, reduce the risk of valuation and supplementary tax payment from the source, and the actual tax amount will be lower than that of self-declaration.

No additional tax expenditure will be incurred in the cross-border receipt and payment of foreign exchange. Under the agency mode, the declared amount can be matched through a compliant foreign exchange settlement path to avoid tax verification caused by the inconsistency between the receipt and payment of foreign exchange and the declared amount, which leads to supplementary tax payment.

When many merchants operate on their own, because the amount of foreign exchange received and paid is inconsistent with the declared goods value, they are determined by the tax authority to have false goods value declaration, and are finally required to pay supplementary tax or even fines, which increases the extra tax cost. Professional agencies will adopt foreign exchange receipt and payment schemes that meet current compliance requirements, use CIPS RMB cross-border payment or compliant foreign exchange settlement paths to ensure that the amount of foreign exchange received and paid fully matches the declared goods value, and avoid extra tax payment caused by compliance issues from the source.

In export business, the agency mode can help merchants enjoy export tax rebates compliantly, and the overall tax cost after actual deduction will be lower than that of self-operation. When many small and medium-sized merchants handle export tax rebates on their own, they cannot pass the tax correspondence verification due to non-standard document filing and misalignment of four streams (goods flow, capital flow, invoice flow and contract flow), and finally cannot enjoy tax rebates, which is equivalent to bearing more tax costs.

Professional agencies will sort out all documents required for tax rebate in advance, ensure that the goods flow, capital flow, invoice flow and contract flow are completely consistent, complete pre-declaration verification in advance, complete foreign exchange receipt and verification in time, ensure that the tax rebate is obtained smoothly, and the tax rebate funds can directly offset the tax cost, and the overall tax expenditure will be lower.

The overall tax cost can be reduced through trade structure optimization. The agency mode can adjust the trade structure according to the merchant's annual trade volume and goods type. For example, for high-frequency small-value imports, the bonded warehouse consolidation mode can be adopted to enjoy the preferential treatment of deferred tax payment, reduce current tax expenditure and optimize capital use efficiency.

For large-value exports, the tariff calculation basis can be reduced by adjusting the application of trade terms and reasonably splitting the goods value and logistics costs, so as to reduce the tax amount within the compliant scope. Professional agencies will adjust the supply chain structure according to the actual operation of merchants, dynamically control the tax cost, and will not let the tax expenditure exceed the reasonable range.

The ownership of tax obligations needs to be clearly marked in the agency contract. Many merchants end up bearing extra taxes that should not be paid by themselves because of unclear contract terms. Therefore, when signing the agency contract, it is necessary to clarify that the statutory tax is borne by the principal, and the agency service fee is listed separately, so as to avoid the agent passing on the tax that should be paid by itself to the principal.

At the same time, it is necessary to clarify that if supplementary tax payment and fines are incurred due to the operation error of the agent, the relevant losses shall be borne by the agent. This can avoid extra tax expenditure caused by operation errors, protect their own rights and interests, and avoid unnecessary cost increases.

The amount of tax payment is also related to the choice of logistics path. Different import paths correspond to different tax calculation methods.

For example, the tax calculation basis for entrepot trade entering the domestic market is different from that for direct import. Professional agencies can choose the most appropriate logistics path according to the place of origin and destination of goods to reduce the tax calculation basis within the compliant scope and reduce tax expenditure.

When operating on their own, many merchants only value the level of logistics freight, ignore the tax difference of different paths, and finally save the freight but pay a lot more tax, and the overall cost is higher instead. Professional agencies will comprehensively calculate the logistics cost and tax cost, choose the scheme with the lowest overall cost, and help control the total expenditure.
