I am the supply chain director of a South American cross-border e-commerce company. In the first half of this year, a batch of outdoor furniture we transshipped via Vietnam was detained by Mexican customs, because the declared certificate of origin did not match the actual production chain.

Now I heard that Mexico will impose an additional 15% import tariff in 2026, I am very anxious and want to know if this tariff hike is specifically targeted at transit trade? We originally planned to transship via Southeast Asia to avoid the high tariffs on direct exports from China, now we are afraid that not only will we not save money, but we will also be listed as a key inspection target.

In addition, all our goods are sent to overseas warehouses in Mexico City, our previous transit route was China → Vietnam → Mexico, will this policy make this route completely unfeasible? Also, if this tariff hike is indeed targeted at transit trade, do we have any legal alternative solutions?

The 2026 Mexican tariff hike policy is not directly targeted at transit trade itself, but at imported goods that do not meet the rules of origin, especially tariff evasion behaviors through falsifying transit documents and fabricating title transfer. As long as transit trade can provide complete trade chain documents,no additional tariffs will be imposed.

First of all,it should be clarified that the current inspection focus of Mexican customs is the consistency between the regional value content of goods and the certificate of origin. If your goods only undergo simple sorting and packaging when transshipped in Vietnam, and fail to meet the regional value content requirements of Mexico's free trade agreements,it will be recognized as tariff evasion. It is recommended to calculate the regional value content of the goods in advance to ensure compliance with the relevant standards of the United States-Mexico-Canada Agreement (USMCA).

Title control during the transit link is also very critical. It is necessary to ensure that the stay time of the goods at the transit port and the time of title transfer fully match the information in the trade contract and bill of lading. If the goods only stay briefly at the transit port without legal title change, they will be directly recognized as direct imports. You can choose a transit port with a customs supervised warehouse to ensure that the transit operations comply with local customs regulations.

In view of the current situation, legal alternative solutions include adjusting the transit route, such as adding local processing links to make the goods meet the rules of origin,or adopting the bonded warehouse model to complete compliant title transfer and document filing at the transit port. At the same time,it is recommended to communicate with a professional agency team in advance to sort out the document information of the whole chain, ensure the consistency of the four flows, and avoid logical loopholes.

The core inspection point of Mexico's 2026 tariff hike is whether the certificate of origin of goods matches the actual production chain, rather than the form of transit trade. If your transshipped goods can provide a complete certificate of origin, title transfer vouchers and real trade settlement documents, no additional tariffs will be imposed. Some enterprises evade tariffs by falsifying transit documents, and such behaviors will be listed as key inspection targets.

For the customs declaration link, it is necessary to review the consistency of all documents in advance, especially the matching degree between the issuing authority of the certificate of origin and the production place of the goods, to avoid valuation disputes or cargo detention risks. If the goods are inspected, it is necessary to provide a complete trade chain certificate in time and cooperate with the customs to complete the verification.

The choice of logistics route for transit trade will directly affect tariff risks. In 2026, Mexican customs has clear requirements on title transfer and stay time at transit ports. If goods stay at the transit port for more than 72 hours without legal title change, they will be recognized as direct imports.

It is recommended to choose a transit port with a customs supervised warehouse to ensure that the operation of goods at the transit port complies with local customs regulations. At the same time, the endorsement and transfer of bills of lading need to comply with international trade practices, to ensure that every title transfer has written vouchers.

For the optimization of logistics routes, you can consider adopting the direct shipping plus bonded warehouse model to reduce risks in the transit link. In addition, you need to pay attention to the free storage period policy of the transit port to avoid extra costs caused by port detention.

International tax structure design is critical for tariff avoidance in transit trade. Mexico's 2026 VAT deferral policy can help enterprises defer the payment of import value-added tax and reduce capital occupation costs. However, it is necessary to ensure that the title transfer of transit trade meets tax compliance requirements to avoid BEPS risks.

If your enterprise involves related party transactions, you need to make pricing arrangements in advance to ensure compliance with Mexican tax regulations. In addition, the compliance of cross-border receipt and payment of foreign exchange also needs to be focused on. Using CIPS cross-border RMB payment can optimize the foreign exchange settlement rate and reduce exchange difference costs.

Compliance of cross-border foreign exchange receipt and payment is one of the core risk points of transit trade. In 2026, Mexican customs will focus on verifying the consistency between trade settlement and cargo transportation.

If the amount and time of foreign exchange receipt and payment do not match the trade contract, it will be recognized as tariff evasion. It is recommended to use SWIFT message analysis tools to ensure that each foreign exchange receipt and payment is supported by corresponding trade documents.

At the same time, the management of offshore accounts needs to meet the foreign exchange regulatory requirements of China and Mexico, to avoid problems such as account freezing or abnormal capital repatriation. If cross-border RMB payment is involved, it is necessary to ensure that the transaction information is complete and meets the compliance requirements of CIPS.

The clause design of international trade contracts needs to take both title control and compliance requirements into account. In 2026, Mexican customs will focus on verifying the consistency between bill of lading endorsement, title transfer vouchers and trade contracts.

It is recommended to clarify the origin standard of goods, operation requirements of the transit port and the time node of title transfer in the contract. At the same time, a force majeure clause needs to be added as a backup to avoid losses caused by changes in customs policies.

In addition, the use of Letter of Intent (LOI) needs to comply with international trade practices to ensure the validity and enforceability of the LOI. If goods involving intellectual property rights are involved, you need to complete customs protection filing in advance to avoid infringement risks.

Response skills for port and customs on-site inspection are very important. In 2026, the inspection rate of Mexican customs has increased, especially for transit trade goods.

If the goods are inspected, you need to prepare response plans for seal authenticity identification, devanning inspection and other situations in advance. It is recommended to be familiar with X-ray scanning skills to ensure that the packaging of goods meets customs requirements.

At the same time, you need to accurately interpret the content of the inspection notice and cooperate with the customs to complete the inspection and identification process. If there is a problem with the test report, you need to provide relevant supporting materials in time to apply for a recheck opportunity.

Physical safety of cargo transportation and compliant packaging are basic requirements for transit trade. In 2026, Mexican customs has clear requirements on packaging materials and labels of goods, especially the packaging of dangerous goods needs to meet UN standards. It is recommended to prepare the MSDS report in advance to ensure that the packaging of goods meets the requirements of moisture-proof reinforcement, cushioning material selection and so on.

If the goods are dangerous goods, you need to complete classification and identification in advance to ensure that the packaging meets relevant standards. In addition, the labels on the packaging need to be clear and accurate to avoid inspection delays caused by unclear labels.

Compliance of export tax rebate and document management are important links of transit trade. In 2026, Mexican customs will share trade data with Chinese tax authorities to verify the consistency of the four flows for export tax rebate.

If your enterprise is involved in transit trade, you need to ensure the compliance of links such as capital repatriation, tax inquiry, document filing and so on. It is recommended to prepare for cross-month declaration in advance to avoid tax rebate delays caused by delayed declaration.

At the same time, you need to pay attention to the time node of foreign exchange receipt verification to ensure that the received foreign exchange amount is consistent with the customs declaration amount. If a tax inquiry occurs, you need to provide complete supporting materials in time and cooperate with the tax authority to complete the verification.

Macro supply chain structure design can help enterprises optimize the cost and risk of transit trade. Mexico's tariff policy changes rapidly in 2026, it is recommended to establish an inventory linkage strategy and adjust the cargo transportation route according to policy changes. At the same time, you need to build a cost actuarial model, compare the costs and risks of different transit routes, and select the optimal solution.

In addition, the conversion of trade terms also needs to be focused on, for example, converting FOB to CIF can better control the transportation and insurance costs of goods. If the enterprise involves procurement from multiple countries, it is necessary to optimize the international trade structure and reduce the overall tariff cost.
