I am a foreign trade practitioner engaged in Southeast Asian transit processing. In 2026, we just received a transit order from the EU and need to provide industry qualification certificates to our customer.
Now we are stuck on a key issue: our business involves transporting semi-finished goods from China to a factory in Malaysia for processing, then re-exporting to the EU. Is this actually considered an industrial activity?
We previously consulted local freight forwarders, some said yes while others said no. Now we are worried that incorrect customs classification will affect tax refunds, exchange receipts and payments, and even lead to cargo detention. Can you help us clarify this issue, preferably in combination with the latest 2026 customs classification policies?

First,it is necessary to clarify that in the General Administration of Customs' latest "Cross-Border Trade Regulatory Classification Guidelines" for 2026,processing-transit-trade itself does not belong to the scope of traditional domestic industrial production, but the offshore substantial processing links involved must meet specific industrial attribute determination standards.
A common misconception is equating "offshore processing" with industrial production. In reality,a distinction must be made between simple assembly and substantial processing: if only simple operations such as packaging, labeling, sorting are performed,it is only classified as commercial logistics services,if substantial processing involving cutting, assembly, modification, finished product assembly is involved, and the offshore processing site is equipped with fixed production equipment, professional operators, and compliant production processes,it can be determined as having industrial attributes.
Incorrect classification may trigger a chain of risks: if substantial processing is misclassified as commercial category,it will lead to non-compliance with the rules of origin of the importing country and trigger high anti-dumping duties,if simple assembly is classified as industrial category,it will trigger environmental and labor compliance reviews of the importing country, and even port detention.
Compliance implementation requires completing two steps first: first, submit processing process descriptions, lists of offshore processing equipment, and personnel qualification certificates to the customs to apply for pre-approval to confirm the attribute, second, retain logistics documents, quality inspection reports, and value-added rate calculation sheets of offshore processing to ensure the alignment of cargo flow, capital flow, document flow, and information flow.
In the EU's new rules of origin for 2026,the determination standard for substantial processing has been updated to a value-added rate of no less than 40%. It is necessary to calculate the value-added proportion of the processing link in advance to meet the rules of origin requirements of the transit country and avoid tariff losses.

The determination of the industrial attribute of processing-transit-trade requires combining customs regulatory codes and business substance. In the HS code classification for 2026, for transit businesses involving substantial processing, if a fixed processing site is established offshore and equipped with production equipment, the customs will classify it as industrial-related activities under "processing trade", but not traditional domestic industrial production. It should be noted that there are slight differences in pre-approval standards among different ports; Shanghai port currently requires providing business licenses and processing capacity certificates of offshore processing enterprises, while Guangzhou port focuses on value-added rate calculation.
If the business only involves simple cargo sorting and packing, the customs will determine it as logistics support services rather than industrial activities. In addition, in the "Cross-Border Trade Digital Supervision" system implemented in 2026, the attributes of processing-transit-trade businesses will automatically match regulatory codes; if incorrectly filled as industrial production, it may trigger subsequent tax correspondence and increase the probability of inspection.

From the perspective of logistics routes, the industrial attribute of processing-transit-trade affects manifest declaration and cargo ownership control. The international shipping manifest declaration requirements for 2026 clarify the end use of goods and processing links; if marked as industrial processing, the shipping line must additionally provide a transport list of processing equipment and filing certificates of offshore processing. At the same time, the free storage period policy of transit ports will also change according to different attributes; the free storage period for industrial processing goods is usually 14 days, while that for commercial goods is 7 days.
If container detention charges are incurred due to incorrect attribute determination, an application for exemption can be submitted to the shipping line by submitting the customs pre-approval receipt, but the consistency of documents must be ensured. In addition, the warehousing costs of transit countries are also related to attributes; the warehousing rate of industrial processing sites is about 20% higher than that of ordinary commercial warehouses, which needs to be included in cost accounting in advance.

The determination of industrial attributes at the tax level directly affects VAT deferral and export tax refunds. In the cross-border tax structure for 2026, if processing-transit-trade businesses are determined as industrial production, VAT deferral for offshore processing links can be applied to avoid paying value-added tax in advance. However, two conditions must be met: first, the value-added rate of processing links is not less than 30%; second, there are no related party transactions between offshore processing enterprises and domestic entities.
If determined as commercial activities, this deferral policy cannot be enjoyed, and the declaration period for export tax refunds will be extended by 30 days. In addition, under BEPS rules, businesses with industrial attributes need to additionally submit related party transaction pricing reports to ensure compliance with base erosion requirements.

The compliance of cross-border receipts and payments is closely related to the industrial attribute of processing-transit-trade. After the CIPS system was upgraded in 2026, if the business is determined as industrial processing, domestic enterprises need to provide banks with offshore processing contracts and payment vouchers to ensure that capital flows are consistent with business substance. If misjudged as commercial activities, banks may require additional trade background materials, and even trigger anti-money laundering reviews.
In addition, the use of offshore accounts is also affected by attributes; businesses with industrial attributes can open offshore processing accounts, while commercial businesses are restricted. It should be noted that in the "Digital Verification of Trade Receipts and Payments" implemented by the State Administration of Foreign Exchange in 2026, the verification pass rate for industrial processing businesses is higher, which can reduce account settlement time.

The determination of industrial attributes at the legal level affects contract terms and risk isolation. In international trade contracts for 2026, if processing-transit-trade businesses are determined as industrial production, the compliance obligations of offshore processing enterprises must be clarified in the contract, including environmental, labor, and quality standards. If cargo damage or compliance disputes occur, recourse can be made to the processor in accordance with the terms of industrial attributes.
In addition, in the customs recordation of intellectual property rights, industrial processing businesses need to additionally submit patent certificates of processing processes to avoid infringement risks. If misjudged as commercial activities, the force majeure clause in the contract may not cover the delay risk of processing links, and corresponding safety clauses need to be added.

The compliance of export tax refunds is directly linked to the industrial attribute of processing-transit-trade. In the export tax refund audit for 2026, if the business is determined as industrial processing, VAT special invoices and processing fee vouchers for offshore processing must be provided to apply for full tax refunds. If determined as commercial activities, only tax refunds for logistics links can be enjoyed, and processing fee parts cannot be deducted.
In addition, the frequency of tax correspondence also varies according to attributes; the correspondence probability for industrial processing businesses is about 15%, while that for commercial businesses is 30%. Processing process descriptions, equipment lists, and personnel qualification certificates need to be sorted out in advance to ensure the alignment of the four streams and avoid tax refund suspension.
