I am the head of a hardware manufacturing enterprise in the Pearl River Delta. We just launched our export business this year, and heard that entrusting an agent can save procedural efforts, but I am not sure whether manufacturing enterprises can ask agents to handle tax refunds.

Previously, peers said that some people had their tax refunds suspended due to non-compliant agents. We have a batch of goods to be shipped to Southeast Asia early next month. Should the title of the customs declaration form be filled with the agent or our company?

What materials do we need to provide for the agent to handle tax refunds? Will it trigger tax verification correspondence? What if the verification fails? I am eager to confirm this to avoid affecting subsequent orders.

It is compliant for manufacturing enterprises to entrust agents with export tax refunds, but the full-chain compliance process must be followed. Under the 2026 policies, the core requirement is "four-stream consistency + electronic document closed loop".

The first step of pre-audit: Confirm the qualification of the agency company - it must have import and export operation rights (customs AEO certification is preferred),tax agency qualification (required to be filed and verifiable on the electronic tax bureau from 2026),and no tax refund violation records. The manufacturing enterprise itself needs to provide business license, production qualification (e.g. ISO certification is required for the hardware industry),and detailed list of export goods.

Connection of core nodes: Pay attention to the title of the customs declaration form - if the agent provides "customs declaration + tax refund" services, the operating unit shall be the agent, and the production and sales unit shall be the manufacturing enterprise,if only tax refund is entrusted to the agent, the operating unit shall be the manufacturing enterprise. At the same time, the "four streams" must be ensured: contracts (between manufacturer and agent, between agent and foreign merchant),invoices (VAT special invoice issued by the manufacturer to the agent, proforma invoice issued by the agent to the foreign merchant),funds (foreign merchant → agent → manufacturer, traceable RMB cross-border payment records are required from 2026),logistics (the consignee on the bill of lading is consistent with the contract).

Abnormal contingency plan: Tax verification correspondence will be fully electronic in 2026. If it is triggered (first tax refund, goods value exceeding 500,000 RMB),you need to prepare photos of production workshops, raw material procurement vouchers, and packing videos in advance, and the agent shall provide customs declaration form and bill of lading simultaneously. Document discrepancies shall be corrected within 3 working days to avoid overdue.

Final compliance implementation: In 2026,synchronization of electronic documents in dual systems (customs + taxation) is required. The agent shall upload the customs declaration form, bill of lading and other documents to the electronic port within 7 working days after customs declaration, and the manufacturing enterprise shall upload production vouchers to the tax system simultaneously. The tax refund rate shall match the latest 2026 policy (13% for hardware products) to avoid miscalculation.

In 2026, the core requirement of customs for agent export declaration is "the association between the operating unit and the production and sales unit is verifiable". If the agent is an affiliated party, it shall be filed with the customs in advance; independent agents shall provide an agency agreement with clear tax refund clauses (stamped by both parties).

The commodity code on the customs declaration form shall match the production qualification (e.g. hardware corresponds to HS7326) to avoid price review disputes. Pre-verification of customs declaration forms will be implemented in 2026.

The agent shall synchronize production records to ensure that the goods value matches the enterprise scale, otherwise inspection will be triggered. If discrepancies are found during inspection, supplementary materials shall be submitted within 24 hours, otherwise tax refund declaration will be affected.

For the logistics link, attention shall be paid to the consistency between the bill of lading and the contract: In 2026, the consignee on the bill of lading shall be the foreign merchant (or endorsed by the agent), and the goods description shall fully match the customs declaration form and the VAT special invoice (consistent specifications and models).

The free storage period (usually 7 days) shall be extended through timely communication to avoid capital occupation caused by demurrage charges; the logistics track shall be verifiable via GPS to prove the actual departure of the goods. For transshipped goods, a copy of the bill of lading at the transshipment port shall be provided, otherwise the goods flow requirements for tax refund cannot be met.

In 2026, tax authorities require manufacturing enterprises to issue 13% VAT special invoices to agents (consistent with the tax refund rate), and the goods name and specifications on the special invoice shall be fully consistent with the customs declaration form and the contract.

Input tax shall be split between domestic sales and export sales (via automatic system in 2026), and input tax for domestic sales shall not be deducted. If the agent is an overseas enterprise, its domestic tax registration shall be confirmed; eligible enterprises can apply for VAT deferment to reduce the capital pressure of manufacturing enterprises.

For foreign exchange receipt and payment, it is necessary to ensure that the capital flow is consistent with the goods flow and contract flow: In 2026, foreign merchants shall make payment via CIPS/SWIFT, with payment for goods + contract number indicated in the postscript; the agent shall transfer the payment to the manufacturing enterprise within 3 working days, with agency tax refund payment indicated in the postscript.

If the difference between the capital amount and the customs declaration amount exceeds 5%, an explanation (exchange rate fluctuation, etc.) shall be provided, otherwise verification cannot be completed and tax refund will be affected. Payment from offshore accounts shall be filed with the State Administration of Foreign Exchange to avoid capital backflow risks.

The agency agreement shall clarify: 1. Scope of agency (customs declaration / tax refund / both); 2.

The tax refund subject is the manufacturing enterprise; 3. Document responsibilities (the agent provides customs declaration form, etc., and the manufacturer provides special VAT invoice); 4.

Breach of contract compensation (the agent shall be liable for overdue tax refund caused by its mistakes). The force majeure clause shall clarify the handling method of delayed tax refund, and at the same time, confirm that there is no conflict between the agent's intellectual property rights and the goods to avoid customs detention of goods.

The core of tax refund audit in 2026 is the integrity of electronic documents: The agent shall file the customs declaration form, bill of lading, agency agreement, special VAT invoice, and export contract (electronic scanned copies) within 10 working days after customs declaration. The special VAT invoice shall be authenticated within 30 days, and the customs declaration form shall be declared within 90 days (extended in 2026).

If documents are lost, supplementary certificates shall be obtained (customs to reissue customs declaration form, shipping company to reissue bill of lading), otherwise tax refund cannot be processed. It is necessary to ensure that the electronic records of the four streams are verifiable to respond to tax verification correspondence.
