I am a production factory specializing in small home goods. This year, I received my first foreign trade order and hired an agency company to assist with the export. Previously, we only handled domestic sales and are completely unfamiliar with the rules regarding export tax refunds.

Currently, we are stuck on this issue and dare not proceed with shipment: our factory does not have professional refund operations staff, nor have we ever obtained import and export rights. We are unclear whether finding an agency for export means we must handle the refund ourselves. If we do not handle the refund, will we face customs or tax audits, and are there any penalties?

If we let the agency handle the refund, what risks do we bear, and which method is more cost-effective? The customs cutoff is next week, and we are anxious to finalize the plan. We hope to get a clear and accurate answer.

Seeking agency export does not mandate the entrusting party to handle export tax refunds themselves, nor is there a saying that "not handling refunds is definitely non-compliant." You need to choose a suitable plan based on your own qualifications and order situation.

Under the traditional model, many small factories fall into two extremes: either they reluctantly hire dedicated staff to handle refunds, investing tens of thousands in labor and compliance costs for a refund of just tens of thousands,or they take a chance and do not make any declarations, leaving compliance hazards. The comprehensive costs of both models are far higher than actual returns, making them very unfriendly to small factories new to foreign trade with small volumes.

In actual operation, you can choose from three paths based on your situation: first, handle the refund yourself, suitable for large-scale factories that already have import and export rights and a professional team, second, have the agency company handle the refund on your behalf, requiring only the provision of authentic purchase invoices and proof of cargo ownership, third,if requirements are met, make an exemption declaration and waive the refund, which will not trigger compliance penalties.

For small and micro suppliers with an annual export volume of less than 1 million RMB,the comprehensive cost of choosing agency-handled refunds is over 40% lower than self-handling. Regarding entry barriers,agency-handled refunds do not require the entrusting party to obtain import and export rights themselves, nor do they require dedicated personnel to follow up on verification letters and declaration processes, the agency team completes the full-process operation.

The final choice can be based on dynamic revenue calculation: if input invoices are sufficient and the refund amount is higher than the agency service fee,it is recommended to choose agency-handled refunds to obtain additional revenue,if input invoices are insufficient and the refund amount is extremely low,you can choose exemption declaration to avoid unnecessary cost inputs while maintaining full-process compliance.

The declaration information for the tax refund subject in agency export must be consistent with the operating unit and consignor information on the export customs declaration form. If the entrusting party handles the refund themselves, the domestic consignor on the customs declaration form should be marked with the entrusting party's information, and the agent is only filled in as the operating unit. If there is a mismatch in subject information, the refund application will be rejected, potentially triggering a customs audit.

If deletion and resubmission are required, it will incur additional costs such as demurrage charges and amendment fees, and delay the shipping schedule. In actual operation, if it is agreed that the agent will handle the refund, the relevant information on the customs declaration form should be filled in according to the agent's refund requirements. Verify the consistency of document information in advance to avoid logical contradictions. After all information is filled in, a secondary check of the product name, quantity, and tax code is required to ensure it matches the refund requirements, thereby avoiding rejections and pending accounts from the source.

Different tax refund subjects correspond to different tax liabilities. If the entrusting party handles the refund themselves, all tax liabilities are borne by the entrusting party; if the agent handles the refund on their behalf, the agent bears the compliance liability for the agency handling process, while the entrusting party bears the liability for the authenticity of the goods and invoices.

For agency exports by small-scale taxpayers, the latest policy in 2026 still applies the exemption policy. No refund handling is required; a direct exemption declaration is sufficient, and no tax risks will arise.

If it is a general taxpayer and input invoices are complete, handling the refund can obtain additional tax difference revenue. If choosing not to refund, you must make an exemption declaration according to regulations and cannot process it as domestic sales taxation; otherwise, additional tax costs will be incurred, and a tax warning will be triggered.

The foreign exchange collection information for agency export needs to be consistent with the tax refund subject. If the entrusting party handles the refund themselves, collection should enter the entrusting party's settlement account. If the agent handles the refund on their behalf, collection enters the agent's settlement account before being transferred according to the agreement. The entire process complies with current regulatory requirements for cross-border RMB and foreign exchange settlement.

The State Administration of Foreign Exchange's 2026 regulatory requirements for agency export collection are clear: as long as the four flows are consistent, it will not be deemed as illegal settlement. It is important to note that collection cannot be made through a third-party personal account and then transferred to the tax refund subject's account. This operation will trigger a foreign exchange compliance warning, affect the review of the refund process, and in serious cases, lead to the suspension of refund eligibility.

The division of responsibilities for agency export tax refunds needs to be clearly written into the agency export agreement. Whether handling it yourself or entrusting an agency, relevant clauses regarding invoice provision, information declaration, and responsibility assumption must be agreed upon.

If a refund violation occurs due to false information, the responsibility lies with the party providing the false information. The agreement must clarify liability for breach of contract and compensation clauses to avoid mutual buck-passing when problems arise.

For the case of entrusting agency-handled refunds, the agent's operation time limit and compensation standards for refund delays or failures caused by the agent's operational errors need to be clarified to protect one's legitimate rights and interests. At the same time, the agreement needs to clarify the ownership of the goods to avoid cargo disputes arising simultaneously with refund disputes.

Whether handling the refund yourself or through an agency, you must do a good job in document filing and verification of the consistency of the four flows. The four flows refer to the consistency of the cargo flow, invoice flow, capital flow, and contract flow. This is the core verification standard for the 2026 export tax refund audit. If entrusting an agency to handle the refund, the entrusting party needs to keep copies of the purchase contract, agency export agreement, packing list, bill of lading, and other documents for preparation in case of tax verification letter checks.

For enterprises handling refunds for the first time, the tax authorities will send letters to verify the authenticity of purchases. Relevant materials such as raw material procurement and production records need to be prepared in advance to cooperate with the verification and avoid refund failure due to failed verification. If a verification anomaly occurs, you need to promptly cooperate with the tax authorities to supplement materials and explain the situation.

The choice of refund method needs to match the cost structure of the entire export supply chain. For small factories doing stable long-term exports, the refund can be packaged and handed over to the agent, allowing focus to be placed on production and order expansion, optimizing overall supply chain efficiency and reducing management costs. For suppliers with large order volume fluctuations, different refund methods can be selected based on the actual situation of each order.

For large orders with sufficient input, choose refund; for small orders with little input, choose exemption. Adjust dynamically to fit supply chain costs. At the same time, the choice of refund method will affect the pricing of trade terms. If choosing refund, you can appropriately lower the quotation to enhance competitiveness; if choosing not to refund, pricing needs to cover relevant costs, so adjust the pricing strategy.

The choice of refund method does not directly affect the logistics process, but if amendment or deletion of documents is caused by mismatched refund information, it will affect logistics booking and customs cutoff times, thereby generating additional logistics costs such as container rolling, demurrage charges, and port change fees. In actual operation, if the refund subject and declaration requirements are determined in advance, relevant information can be filled in accurately during the booking and customs declaration stages to avoid subsequent document amendments affecting logistics progress.

For short lead-time orders on near-ocean routes, amending documents will directly result in missing the shipping schedule, generating additional air freight costs or reshipment fees. Therefore, the refund plan must be finalized before shipment to ensure information consistency and smooth connection between logistics and refund links, avoiding unnecessary logistics cost losses.
