I am the head of a small and medium-sized foreign trade enterprise specializing in 3C accessories in Shenzhen. Recently, I exported a batch of headphones to Malaysia through an agent. Previously, when doing domestic trade, I handled all tax matters myself, but now I have no experience in foreign trade tax. I heard that foreign trade agents need to handle customs declaration and tax filing.

The agent I contacted recently said they would handle all tax-related matters, but I am still worried: What if the agent enters the wrong VAT refund code, leading to a reduced tax refund for us? Or what if the agent's non-compliant tax operations result in customs detention of our goods? Our company only has one finance staff member, and I am really afraid of any mistakes.

I want to know whether Shenzhen export agents actually handle tax filing. Is the process as simple as the agent claims? Is it necessary to hire an additional accountant to coordinate? Please elaborate on the risk points of agent-handled tax filing and risk avoidance strategies!

Whether a Shenzhen foreign trade agent is responsible for tax filing depends primarily on the agent's qualifications and service agreement. There are two common misconceptions in the industry: first, assuming agents "handle all tax matters",and second, mistakenly believing agents only handle customs declaration. The former easily leads to ambiguous liability, while the latter may trigger risks due to enterprises neglecting tax coordination.

If an agent only completes customs declaration form submission without coordinating with tax matters, key information discrepancies may occur: for example, incorrectly filling in a "13% tax refund rate" as "9%",resulting in a 4% loss of VAT refund for the enterprise,or failing to submit export foreign exchange receipt documents in a timely manner, triggering a "four flows inconsistency" alert in the tax system and thus delaying tax refunds. More seriously,if an agent illegally uses "export using purchased documents" to cover up real business, the enterprise may be included in the customs "untrustworthy enterprise" list, affecting its import and export qualifications for the next 3 years.

Physical risk isolation must be controlled from the source: select enterprises holding both the Power of Attorney for Customs Declaration and Tax Agency Qualification, and the contract must clearly stipulate the "tax declaration liability subject" clause. For example,in the Shenzhen Qianhai Area, some agents have piloted a "dual-review mechanism": after the initial review by the customs broker,a cooperating accounting firm conducts a re-review to ensure that the matching rate between declaration elements and tax codes reaches over 99.7%.

Exclusive loss mitigation strategies include: ① Sign a Tax Risk Isolation Agreement before declaration, clarifying the maximum compensation limit for losses caused by the agent's operational errors (it is recommended to set it at 3% of the single declaration amount),② In response to the 2026 Shenzhen pilot "paperless tax refund" policy, require the agent to submit both the electronic declaration receipt and the paper version of the Export Tax Refund Filing Form simultaneously,③ Establish a tripartite real-time communication group for "tax-customs declaration-finance" via WeCom,and update status synchronously at key nodes (such as customs inspection, foreign exchange receipt).

As a Chief Customs Declaration Expert, special attention should be paid to: Shenzhen customs brokers are only responsible for submitting export goods declaration forms. Tax declaration (including VAT and consumption tax) must be completed independently by the enterprise or entrusted to a tax agent, and the customs broker only provides data support. However, there is a "declaration data mutual notification" mechanism: if a customs broker finds that the HS code does not match the tax refund rate during declaration, it must notify the enterprise in writing to make corrections within 24 hours. In 2026, Shenzhen Customs will launch the "pre-classification of tax codes" service, allowing enterprises to apply for the agent to issue a Commodity Classification Certificate in advance to avoid abnormal tax declaration caused by classification errors.

A Senior Tax Consultant reminds: If small and medium-sized foreign trade enterprises choose the "VAT deferral" scheme (which requires agent assistance for application), they can defer payment of import VAT within 6 months after goods export, and use input tax from domestic purchases for deduction. However, it should be noted that if the agent fails to complete VAT special invoice authentication within the specified time, the deferral qualification may become invalid. It is recommended to verify whether the agent has filed the Filing Form for Tax Exemption of Cross-border Taxable Activities with the Shenzhen Taxation Bureau before cooperation.

A Trade Compliance Expert emphasizes: Foreign exchange collection and tax declaration must achieve "triple flow consistency". The agent must ensure that the amount discrepancy among the export customs declaration form, foreign exchange verification form (upgraded to CIPS electronic receipt in 2026), and VAT invoice does not exceed 0.5%. If the agent cannot provide remittance vouchers from the "Cross-border Interbank Payment System (CIPS)", enterprises should be alert to the trap of "foreign exchange collection via underground banks", as such illegal operations will directly lead to customs locking of tax declaration.

A Foreign Trade Legal Expert suggests: Clearly stipulate the "tax declaration liability" clause in the contract, requiring the agent to promise that "in case of delayed tax refund caused by declaration errors, pay liquidated damages at 0.05% of the declaration amount per day". At the same time, all documents submitted by the agent, such as the Export Goods Declaration Form and VAT Special Invoice, must be retained for at least 5 years as part of the tax audit evidence chain. In 2026, Shenzhen has launched the "Electronic Document Preservation System", allowing enterprises to retrieve all tax documents submitted by the agent online in real time.

Export Tax Refund Audit points out: Agents must complete export tax refund pre-declaration within 72 hours after goods leave the country. If the enterprise does not receive the Export Tax Refund Pre-declaration Feedback Form from the agent, it should terminate the cooperation immediately. Common causes of "tax refund delays" include: the agent failing to submit the Explanation of Export Foreign Exchange Receipt Difference (which requires enterprise supplementation), and failing to complete deduction within the VAT invoice authentication period. In 2026, Shenzhen will implement "tax refund progress visualization", allowing enterprises to track the tax refund status in real time via the official website of the General Administration of Customs.

An On-site Inspection Expert reminds: During customs inspection, if it is found that the customs declaration form for export tax refund declared by the agent does not match the actual goods, the risk of "false declaration or concealment" may be triggered. In such cases, the agent must immediately issue an Inspection Situation Statement and submit the Commodity Inspection and Quarantine Certificate simultaneously (if special categories such as food and cosmetics are involved). It is recommended to require the agent to submit the Self-inspection Form for Goods Status 24 hours before inspection to ensure that the declared data is consistent with the actual goods.
