I am a sales representative at a foreign trade company in Shenzhen, mainly exporting electronic products such as lithium battery packs. Recently, the EU imposed a 25% tariff on electronic products produced in China, and our European clients requested us to transit through a third country to avoid the tariff. I would like to ask if Shenzhen can handle transit trade?

What specific conditions need to be met? We plan to choose Thailand as the transit country. This batch of goods requires special packaging. I do not know if the supervision of Shenzhen ports for such transit goods is strict, and whether there is a risk of cargo detention.

Also, how does the documentation process for transit trade work, and will it affect subsequent tax refunds? I haven't dealt with transit business before and am afraid of stepping into compliance pitfalls. I hope to get a detailed answer.

Shenzhen is fully capable of legally conducting transit trade business, and as a national core foreign trade port,it possesses a mature transit trade operation system. First, the core compliance prerequisite for transit trade must be clarified: goods need to complete actual transshipment or warehousing in the transit country, and the title to goods and documents must remain consistent throughout the process.

The preliminary review stage requires focusing on preparing the full set of documents for third-country transit: including the Certificate of Origin of the transit country, warehousing proof,as well as the goods' MSDS,UN packaging certification (for dangerous goods like lithium batteries). Shenzhen ports require that the manifest information of transit goods must fully match the declaration data of the transit port, avoiding customs detention caused by document discrepancies.

The core operation process is divided into three steps: first, complete the transit trade filing with Shenzhen Customs in advance, submitting the transit agreement and proof of title, second, cooperate with customs inspection after the goods arrive at the port, focusing on verifying the goods' markings and document information, third, complete final delivery after swapping bills of lading at the transit port.

For dangerous goods like lithium batteries, one must strictly comply with IMDG rules, complete packaging and declaration in advance, and provide a professional packaging appraisal report during on-site inspection to reduce the probability of cargo detention. In addition, transit trade does not fall within the scope of export tax refunds,so financial accounting needs to be adjusted in advance to avoid erroneous tax refund declarations.

Regarding contingency plans,if a customs inspection is encountered, one must provide the warehousing voucher of the transit country at the first opportunity to prove that the goods have not undergone substantive processing within China, thus passing the inspection smoothly.

The core of customs declaration review for transit trade lies in the consistency of title and documents. Shenzhen Customs will focus on verifying the transit agreement, the third-country Certificate of Origin, and the full journey manifest data. If the goods only undergo transshipment and loading at the Shenzhen port, a loading and unloading certificate from the transit port is required to prove that no substantive processing occurred.

If there is a document discrepancy, such as manifest information not matching the actual goods, one can apply to delete the declaration and re-declare within 24 hours, requiring a written explanation and corrected documents. For transit business involving additional tariffs, the trade contract between the client and the supplier in the transit country must be additionally provided to prove that the final flow of goods is not from China, avoiding being identified as false transit.

For transit logistics from Shenzhen to Thailand, priority can be given to the direct route from Yantian Port to Laem Chabang Port, with a voyage of about 3 days, which can effectively shorten the transit time. The Bill of Lading needs to be blank endorsed to ensure the title can be freely transferred at the transit port. It is necessary to confirm the free storage period with the transit port freight forwarder in advance; usually, a 7-day free storage period can be applied for to avoid additional demurrage and detention charges.

If space is fully booked, Shekou Port can be selected as an alternative port, and the transit operation procedures at both locations are consistent. The entire process requires tracking the title transfer nodes to ensure that the title handover is completed at the transit port before delivering the Bill of Lading to the final client.

Tax planning for transit trade needs to focus on the tax policies of the transit country. Thailand exempts VAT on transit goods, and transit can be completed by establishing a compliant warehousing company in Thailand. One must avoid unreasonable pricing in related party transactions, strictly follow BEPS rules for pricing declarations, and avoid being identified by tax authorities as eroding the tax base.

Income from transit trade needs to be accounted for separately from domestic export business to avoid confusion leading to tax risks. In addition, cross-border settlement can be completed via CIPS to mitigate exchange rate fluctuation risks while ensuring the foreign exchange collection path complies with foreign exchange management requirements.

Foreign exchange compliance for transit trade must follow the "real transaction" principle. Foreign exchange collection must come from the final client, and payments must be made to the supplier in the transit country. Complete SWIFT messages and settlement vouchers must be retained throughout the process.

If using an offshore account, ensure the account's compliance to avoid being listed as a high-risk account. Regarding EU tariff barriers, the separation of documentation flow and cargo flow in transit trade can be utilized to ensure the time difference between collection and payment meets regulatory requirements.

One must regularly check the latest policies of the State Administration of Foreign Exchange. In 2026, Shenzhen ports have achieved online filing for transit trade foreign exchange receipts and payments, which can significantly improve compliance efficiency.

The contract for transit trade needs to clarify the division of responsibilities for the transit link. A "title transfer clause" must be added to the contract to ensure that after transshipment is completed at the transit port, the title is formally transferred to the final client. It is a requirement to ask the supplier in the transit country to provide a letter of guarantee to ensure the quality and quantity of goods meet the contract requirements.

Regarding EU tariff policies, a "tariff avoidance clause" should be added to the contract, clarifying that if the client is subject to additional tariffs due to improper transit operations, the responsibility shall be borne by our side. In addition, proper filing and archiving of contracts must be done for inspection by customs and tax authorities.

Inspection of transit goods at Shenzhen ports is usually divided into machine inspection and manual inspection. Lithium battery goods will prioritize entering the machine inspection channel, focusing on verifying whether packaging markings and UN numbers are correct.

If the machine inspection finds abnormalities, a manual unpacking inspection will be arranged, at which point a professional packaging appraisal report and MSDS must be provided. During inspection, ensure that the seals are intact and consistent with the seal number on the Bill of Lading.

If seal damage is found, immediately contact the freight forwarder and customs to apply for re-sealing. The laboratory test report must be issued by a recognized third-party institution to ensure compliance with IMDG Code requirements.

Lithium battery packs belong to Class 9 dangerous goods. Transit transportation must comply with the packaging requirements of the IMDG Code, and packaging containers certified by UN38.3 must be used. The packaging must have moisture-proof and shock-proof functions, and the exterior must be affixed with correct dangerous goods labels, including the UN number, dangerous goods class, and emergency telephone number.

A complete MSDS must be compiled, containing the physical and chemical properties of the goods, emergency handling measures, etc. When declaring at Shenzhen ports, the packaging appraisal report must be submitted in advance to ensure compliance with customs inspection requirements. If the packaging does not meet the requirements, rectification will be required, delaying the transit time.

Transit trade does not fall within the scope of export tax refunds, so there is no need to declare tax refunds, but document filing work must be done well. The full set of documents such as transit agreements, manifest information, and collection vouchers must be retained for inspection by tax authorities via letter verification.

If transit trade is mistakenly declared as an export tax refund, it will be identified as defrauding tax refunds, and the declaration must be corrected immediately, submitting a written explanation. Income from transit trade must be recorded as other business income and declared in accordance with the regulations of Enterprise Income Tax. Regular self-inspection of documents for transit business is required to ensure the consistency of the four flows (contract, invoice, title, funds).
