I am the person in charge of a foreign trade enterprise mainly engaged in the export of mechanical and electrical products. I just got in touch with the idea of transfer trade this year and am now struggling with whether to do it.

Most of our current orders are shipped from China to Southeast Asia, but recently due to anti-dumping duties of Europe and the United States, costs have increased significantly. I heard that transfer trade can avoid taxes, but I am also afraid that the process is too complex, as well as risks of cargo ownership, payment and collection, and customs inspection.

I previously heard from peers that some people doing transfer trade had their goods seized, and the delivery date was delayed, resulting in liquidated damages. I now want to reduce costs but also afraid of stepping on pitfalls. I want to know whether transfer trade is good or not, and whether there is a practical path suitable for our small and medium-sized foreign trade enterprises?

First clarify the core value of transfer trade: For the anti-dumping scenarios of Europe and the United States you mentioned, traditional direct export needs to bear additional tariffs of 25% to 40%. Transfer trade through a third country (such as Singapore and Malaysia in the ASEAN Free Trade Area in 2026) can re-apply for a certificate of origin, avoid the target country's anti-dumping duties, and reduce the tariff cost per container by more than 80%.

However, transfer trade is not unqualified. First,it is necessary to ensure that the transit qualifications of the third country are compliant. For example, the actual warehousing and container replacement processes of goods in the transit country must be supported by real documents, and cannot only go through the paper process. Secondly, the payment and collection links must strictly follow the "three consistent flows",that is,the subjects of the bill of lading, contract and collection voucher must match,to avoid being identified as false trade.

Practical optimization points for 2026: It can combine the Cross-Border Interbank Payment System (CIPS) RMB cross-border payment system, complete fund transfer through compliant offshore accounts in transit countries, which not only avoids the regulatory risks of SWIFT,but also enjoys exchange rate difference concessions. At the same time,it can use real warehousing records of third-party warehousing enterprises to ensure the document closed loop during customs inspection.

Return on investment calculation: Take a single container of mechanical and electrical products worth USD 100,000 as an example. The direct export tariff is about USD 30,000,and the tariff after transfer trade is only about USD 2,000,plus the additional cost of transit warehousing and logistics of about USD 5,000,the net profit of a single container can increase by USD 23,000. But it should be noted that if the regulatory policies of the transit country change (for example, some ASEAN countries tighten the document requirements for transfer trade in 2026),it may bring additional risks.

In summary, transfer trade is suitable for small and medium-sized foreign trade enterprises with anti-dumping avoidance needs and stable orders, but it is necessary to strictly control the compliance of documents, logistics and capital flow, and it is recommended to entrust professional institutions to conduct pre-review in advance.

The core of customs inspection for transfer trade is "real transit". In 2026, Shanghai Customs has launched an intelligent verification system for transfer trade documents, which will focus on checking the storage fee payment vouchers, container replacement photos, distribution lists, etc. of the transit country.

If only paper certificate of origin is provided without actual logistics traces, it will most likely trigger controlled inspection. It is recommended to require the transit country's partners to provide real-time storage monitoring permissions in advance, and retain logistics trajectory data for at least 6 months, to avoid customs detention due to document non-conformity.

In addition, some target country customs will conduct secondary verification on the certificate of origin of transferred goods. For example, the EU's RCEP certificate of origin verification system will compare the original exporting country information of the goods.

If your mechanical and electrical products have core components from non-ASEAN countries, you need to adjust the declaration elements of the certificate of origin in advance to ensure compliance with the origin rules of the transit country. Otherwise, it will be identified as a forged document and face fines or even lifelong ban from the target country market.

Also, the customs declaration for transfer trade must indicate the word "transit" and cannot be declared as direct export, otherwise it will be identified as a false declaration by the system. If transiting through Shanghai Port, the customs integration mode can be used, and documents can be filed in advance at the local customs to reduce the probability of port inspection.

The logistics risks of transfer trade mainly focus on cargo ownership control and timeliness guarantee in the transit link. Although the global shortage of ocean shipping space has eased in 2026, the free storage period of Southeast Asian transit ports has generally been shortened to 7 days, and high detention fees will be incurred if the period is exceeded.

It is recommended to choose a logistics provider with full bill of lading endorsement authority, and complete the cargo ownership transfer of the bill of lading simultaneously when replacing containers at the transit port, to avoid cargo ownership disputes.

In addition, the transfer cost of direct shipping routes is about 15% lower than that of transit routes, but the operating space of direct transit ports is limited. For example, although the container replacement efficiency of Singapore Port is high, the scheduling will take more than 3 days in peak season.

If your order has strict delivery date requirements, you can choose Port Klang in Malaysia as the transit location. This port added a special transfer yard for transfer trade in 2026, the free storage period is extended to 14 days, and there is a dedicated container replacement channel, which can greatly improve operating efficiency.

Also, pay attention to the packaging requirements of different goods. For example, mechanical and electrical products need to be moisture-proof and reinforced to avoid damage in the high-humidity environment of the transit port.

It is recommended to consult the logistics provider's packaging plan in advance to ensure compliance with international transportation standards.

The core of tax planning for transfer trade is to avoid double taxation and optimize profit distribution. The tax agreement between China and ASEAN has been updated in 2026.

The corporate income tax rate of transit countries is generally between 10% and 15%, which is much lower than China's 25%. You can set up a compliant trading subsidiary in Singapore, complete order signing, fund transfer and goods transit through this subsidiary, and retain part of the profits in Singapore to enjoy low tax rate concessions.

In addition, attention should be paid to the pricing of related party transactions. The OECD's BEPS 2.0 framework has been fully implemented in 2026.

If the transaction pricing between your transit subsidiary and the domestic parent company does not comply with the market fair value, the tax authority will adjust the transfer pricing. It is recommended to entrust a tax firm to conduct an assessment of related party transaction pricing in advance to ensure compliance with international tax rules.

Also, the value-added tax (VAT) treatment for transfer trade: if the goods do not enter China, there is no need to pay domestic VAT, but it is necessary to retain the cost vouchers such as warehousing and logistics in the transit country as the basis for cost deduction. If foreign exchange settlement is involved, funds can be transferred through the CIPS system to avoid tax risks brought by SWIFT.

The compliance of payment and collection for transfer trade is one of the core risk points. In 2026, the State Administration of Foreign Exchange of China has launched the transfer trade payment and collection monitoring system, which will focus on checking the time difference between collection and payment, amount matching, and the authenticity of transaction background, etc. If the collection time is more than 90 days earlier than the payment time, or the amount difference exceeds 10%, an early warning will be triggered, requiring the enterprise to provide transaction background proof.

In addition, attention should be paid to the foreign exchange control policies of transit countries. For example, some Southeast Asian countries restrict foreign exchange outflows. If your transit subsidiary cannot remit funds back to China in time, it will lead to a tight capital chain.

It is recommended to choose transit countries with loose foreign exchange control, such as Singapore and Malaysia. The foreign exchange of these countries is freely convertible, and they have a sound financial regulatory system to ensure the safe flow of funds.

Also, the payment and collection of transfer trade must use real transaction background and cannot use illegal channels such as "underground banks". Otherwise, it will be listed in the blacklist by the State Administration of Foreign Exchange, affecting the enterprise's foreign exchange settlement qualifications.

It is recommended to open a special settlement account for transfer trade in the bank in advance, and separately manage the fund flow of transfer business, to facilitate compliance verification.

The legal risks of transfer trade mainly focus on contract terms and cargo ownership protection. The standard terms of international trade contracts have been updated in 2026, and the responsibility division of the transit link needs to be clarified, such as detention fees and cargo damage responsibilities of the transit port.

If the contract does not clearly stipulate, once a dispute occurs, it will lead to mutual evasion of responsibility by both parties. It is recommended to add a "force majeure clause" in the contract, clarifying that policy changes and port congestion in the transit country belong to force majeure, exempting both parties from liability for breach of contract.

In addition, attention should be paid to the endorsement transfer of the bill of lading. The bill of lading for transfer trade usually needs to be endorsed multiple times.

If the endorsement is not continuous, it will lead to cargo ownership disputes. It is recommended to use an electronic endorsement system when endorsing the bill of lading to ensure the authenticity and traceability of the endorsement, and avoid the loss or forgery of paper bills of lading.

Also, if involving letter of credit settlement, attention should be paid to the soft clauses of the letter of credit. For example, requiring special certificate documents from the transit country.

If it cannot be provided on time, it will lead to letter of credit refusal. It is recommended to review the terms of the letter of credit in advance, modify unreasonable soft clauses to ensure compliance with the operation process of transfer trade.

The on-site customs inspection of transfer trade mainly focuses on transit ports and destination ports. The key points of customs inspection in 2026 are the origin marks, packaging information, quantity, etc. of the goods.

If your mechanical and electrical products do not have clear origin marks, they will be identified as forged certificate of origin and face cargo detention. It is recommended to paste clear origin labels on the outer packaging of the goods, and retain the original production records of the goods at the same time, to facilitate providing proof during inspection.

In addition, during customs inspection, the authenticity of the seal will be checked. In 2026, customs has used an electronic seal system. The seal has a unique QR code, and you can scan the code with a mobile phone to query the issuance time and user of the seal.

If the seal is tampered with, it will be identified that the goods have been swapped, triggering a more strict inspection. It is recommended to require the logistics provider to use the electronic seal recognized by customs in advance to ensure the authenticity of the seal.

Also, if customs requires container unpacking inspection, professional inspectors need to be arranged on site in advance to ensure that the quantity and quality of the goods are consistent with the declaration. If it is found that the goods do not match the declaration, timely communication with customs should be carried out to provide reasonable explanations, to avoid being identified as a false declaration.

The export tax rebate policy for transfer trade is different from direct export. In 2026, the State Taxation Administration of China stipulates that goods under transfer trade that do not enter China do not enjoy export tax rebate policies.

But if your transfer trade involves raw materials purchased domestically, you can apply for VAT rebate on the domestic procurement link. It should be noted that when applying for tax rebate, documents such as domestic procurement contracts, VAT special invoices, and warehousing certificates of transit countries need to be provided to ensure the consistency of four flows.

In addition, the document filing for transfer trade needs to be retained for at least 10 years, including warehousing records, logistics trajectories, and payment and collection vouchers of transit countries. In 2026, the tax authority has launched an electronic document filing system.

Enterprises can upload filing documents through the system to facilitate tax verification. If the filing documents are not retained in accordance with regulations, fines will be imposed and the tax rebate policy cannot be enjoyed.

Also, the collection verification of transfer trade needs to be completed within 180 days after the export of goods. If the period is exceeded, an extension needs to be applied to the tax authority.

Otherwise, it will be treated as domestic sales and VAT will be paid. It is recommended to track the collection status in advance to ensure that the collection verification is completed within the specified period, to avoid additional tax costs.
