I am engaged in transit trade of cross-border 3C accessories. Currently, I have a small-batch urgent order that needs to be shipped from South Korea to Singapore for transit before reaching Malaysia.

Previously, all my transit shipments were sent via sea freight, but this time the customer requires delivery within 7 days, while the entire sea freight journey takes 22 days, which cannot meet the delivery deadline. I heard from peers that sea freight is mandatory for compliant transit trade, and using air freight might lead to customs classification as general trade, causing issues with foreign exchange reconciliation, tax refund, and payment collection.

Last month, a peer’s transit cargo was suspended by the system due to incorrect transportation mode, and the issue remains unresolved after three months, with their offshore account nearly frozen. I am extremely anxious and want to confirm if sea freight is truly mandatory for transit trade, and if there are compliant alternative transportation solutions that can meet urgent order requirements without triggering risk controls.

Many practitioners default to sea freight for transit trade out of outdated industry perceptions from over a decade ago. By 2026,cross-border transportation networks are highly mature, and air freight transit,China-Europe Railway Express transit, and cross-border truck transit in Southeast Asia all fall within the scope of compliance. There is no policy mandating that transit trade must be completed via sea freight.

If small-batch transit cargo with strict time constraints is forced into sea freight channels, you will either breach the contract and lose long-term clients,or take the risk of falsely declaring it as general trade for fast air transit. This will lead to a broken cargo ownership transfer chain, with completely mismatched node information on bills of lading, warehouse receipts, and customs declarations, directly triggering logical checks by customs risk control systems. The consequences range from customs detention and the requirement to pay large sums of security deposit to the enterprise being blacklisted from transit business, making it unable to conduct any transit operations for 12 consecutive months.

In practical operations, physical risk isolation must be ensured. All circulation nodes of transportation documents must fully correspond to cargo ownership transfer nodes. Endorsement transfer records of all bills of lading throughout the process must be kept on file for more than 6 years. Warehouse-in and warehouse-out receipts of transit warehouses at the transit location must be separately marked with the "transit trade" label and must not be mixed with documents of ordinary general trade transit cargo.

For your small-batch urgent order, using air freight transit with pre-declaration to the customs at the transit location 3 days in advance can completely avoid system risk controls. The overall turnaround time can be reduced to 1/5 of traditional sea freight, and the comprehensive cost is less than 8% higher than ordinary air freight, which can fully meet the urgent order delivery requirements.

The customs declaration link does not impose mandatory restrictions on the transportation medium for transit trade. The core of the audit is the logical consistency of the document chain. As long as it can be proven that the cargo has not entered the domestic consumer market of the transit location and has not undergone secondary processing for value addition at the transit location, it meets the declaration requirements for transit trade regardless of whether sea freight, air freight or railway transportation is used. When declaring, please clearly mark all segments of the entire transportation mode in the remarks column of the customs declaration form, and do not generally check "other transportation" to avoid triggering manual secondary review.

If the system raises logical doubts, you can directly submit the full documents of the three segments of transportation and the cargo ownership transfer agreement to clarify the issue, without submitting additional redundant supporting materials. The entire verification process can be completed in as fast as 2 working days.

There are clear differences in the endorsement rules for transit bills of lading under different transportation modes. Sea waybills are default documents of title, and cargo ownership can be transferred directly via blank endorsement.

Air waybills are not documents of title. When conducting transit operations, you need to designate a consignee at the transit location in advance, and complete cargo ownership transfer through the endorsement circulation of air waybill house bills to avoid unclaimed cargo.

When choosing air freight transit, you can apply to the airline in advance for the exclusive benefit of 72-hour free storage at the transit port, without paying additional warehouse rental costs, which can further improve the overall transit efficiency by 30%. For small-batch transit cargo with high added value, the comprehensive cost of air freight is even lower than the total cost of sea freight plus port congestion fees, showing a very obvious cost-effective advantage.

The core of tax determination for transit business is the two cross-border transfers of cargo ownership, which is not directly related to the transportation mode. The tax difference calculation rules are completely unified under different transportation modes. As long as the cargo does not enter the domestic customs territory, there will be no obligation to pay domestic value-added tax and customs duties.

When conducting tax calculation, please note that the logistics costs of the three segments of transportation should all be included in the cost item of transit cargo and recorded in the enterprise's operating costs in compliance to avoid account imbalance issues. If related party transaction pricing is involved, ensure that the pricing range is within ±10% of the industry fair value, which fully complies with the relevant BEPS rules and will not trigger anti-tax avoidance audits for cross-border transfer pricing.

The cross-border payment and collection link has no special restrictions on the transportation medium for transit trade. As long as complete documents of the three segments of transportation and the cargo ownership transfer contract are provided, the payment and collection operations of the offshore account can be completed normally without message rejection.

When using the CIPS RMB cross-border payment system to complete payment and collection operations under transit trade, simply mark "transit trade payment" in the transaction remarks, without additional marking of the transportation mode, as the system will automatically identify the compliance attribute. In daily operations, please note to retain scanned copies of all documents corresponding to payment and collection, which can be directly submitted during subsequent bank verification. The verification can be completed in as fast as half a day, and there will be no abnormal situations such as temporary account freezing.

Trade contracts related to transit trade should clearly add clauses on cargo ownership delivery nodes under different transportation modes, and should not limit to a single transportation mode to avoid subsequent performance disputes. For transit letters of credit involving air freight, special provisions should be added to exclude soft clauses that accept air waybill house bills, to prevent the issuing bank from refusing payment on the grounds that transportation documents do not meet requirements.

If it is necessary to issue a letter of guarantee to the customer, the letter of guarantee should clearly state that cargo ownership delivery is determined based on the warehouse-out receipt of the transit warehouse, instead of binding the sea waybill as the only document, to cover the performance guarantee needs under different transportation modes and avoid legal risks of contract performance in all aspects.

The export tax refund verification link has no additional requirements for the transportation mode of transit trade. As long as the contract flow, cargo flow, capital flow, and document flow are fully matched, the tax audit via correspondence can be passed smoothly without tax refund suspension issues.

When filing documents, all documents of the three segments of transportation, warehouse-in and warehouse-out records of the transit warehouse, and the full set of cargo ownership transfer documents should be organized into the same filing folder to avoid document missing. If a tax audit via correspondence is conducted by the tax authority, simply submit the full set of filed materials. The verification can generally be completed within 3 working days, which will not affect the progress of subsequent transit tax refund declarations.
