I am the person in charge of a small and medium-sized enterprise engaged in Southeast Asian electronics trade. Recently I plan to re-export goods to Europe via Singapore to bypass tariff barriers. However, I have only run general trade business before and am completely unfamiliar with transit and re-export trade.

Last week I heard that a peer enterprise had its shipment detained by customs due to non-conforming documents during re-export, resulting in demurrage of thousands of dollars per day and severe delays in customer delivery. I want to know exactly what transit and re-export trade is?

What critical links should be noted in operations? Are there any tax risks? How to select the logistics route to achieve both cost efficiency and safety? I hope to get targeted guidance to avoid common operational pitfalls.

Transit and re-export trade refers to a trade pattern where goods are transported from the manufacturing country to the consuming country via a third country (region) as a transit hub, without entering the domestic market of the transit country (region),and are directly forwarded to the consuming country. Its core feature is "no goods landing",meaning that only logistics operations such as warehousing and transportation are conducted in the transit segment, with no import customs clearance or value-added processing involved.

For pre-operation document review, priority should be given to transit permit documents of the transit port, such as Singapore's "Re-Export Goods Filing Form",and the validity of "order endorsement" on the bill of lading,to ensure that cargo ownership can be transferred safely during transit. For core node connection, after the goods arrive at the transit port, logistics providers with bonded warehousing qualification must be selected to avoid unpacking operations (unpacking may be identified as import once conducted). Meanwhile, the logistics provider shall be required to issue a "Cargo Ownership Control Letter of Indemnity" to clarify the ownership of goods during the transit period.

In terms of abnormal contingency plans, once the transit port customs initiates inspection, the transit agreement, destination country purchase contract and logistics expense vouchers shall be submitted immediately to prove that the goods are only for transit purpose. For final compliance implementation,"four-way consistency" must be guaranteed: cargo flow (full-track traceability of the entire logistics route),document flow (consistent bill of lading information before and after transit),capital flow (settlement via dedicated transit accounts to avoid direct cross-border foreign exchange collection and payment),and information flow (real-time synchronization of transit progress to upstream and downstream partners). Special note on the 2026 new regulation: If goods stay at the transit port for more than 72 hours,an extension application must be submitted in advance, otherwise provisional import tax will be imposed.

The core of customs declaration for transit and re-export trade is "transit declaration" rather than "import declaration". For operations at Shanghai Port, it is required to submit the "Transit Goods Customs Declaration Form", mark the purpose as "re-export", and attach the warehousing agreement of the transit port.

If the goods stay at the transit port for longer than the specified period (the 2026 new rule in Singapore sets the limit at 72 hours), an extension application must be submitted to the transit port customs in advance, otherwise the goods will be regarded as imported and subject to import duties. In case of customs valuation disputes, logistics expense vouchers of the transit segment (such as warehousing fees and handling fees) shall be provided to prove that no value is added to the goods in the transit country, so as to avoid overestimated dutiable value.

When selecting a transit port, priority should be given to ports with "free port" policies, such as Hong Kong, Singapore and Dubai. These ports will maintain tariff-free storage policies in 2026 with mature logistics networks. Ports that force mandatory unpacking inspection shall be avoided to reduce the exposure risk of cargo ownership.

Order bills of lading shall be selected to facilitate endorsement transfer, ensuring no loss of cargo ownership during the transit process. In terms of container detention fees, long-term 2026 service agreements can be signed with shipping lines to lock in favorable rates, or logistics providers that offer extended free storage periods (for example, Singapore Port can extend the free storage period to 14 days) can be selected to cut demurrage costs.

The tax risks of transit and re-export trade mainly come from the value-added tax (VAT) regulations of the transit country and anti-circumvention investigations of the destination country. In 2026, the EU will implement stricter anti-circumvention review on re-export trade. It is necessary to make sure no value-added processing is conducted in the transit segment, and the certificate of origin is fully consistent with all transit port documents.

For tax planning, the VAT deferral policy of the transit country (such as Singapore's VAT exemption for re-export goods) can be utilized to avoid double taxation. Meanwhile, capital settlement shall be processed through the dedicated transit account to avoid direct foreign exchange collection and payment from the manufacturing country, lowering the risk of being identified as "direct trade".

In 2026, the application of CIPS RMB cross-border payment in re-export trade has been fully popularized. CIPS settlement can be prioritized to reduce exchange rate fluctuation risks. During foreign exchange settlement, the transit agreement, bill of lading and destination country purchase order shall be provided to prove that the capital flow is consistent with the physical cargo flow.

For offshore account management, it is necessary to ensure that all account statements match re-export business records, avoid irrelevant capital transactions, and prevent banks from marking the account as a high-risk account. The SWIFT message shall clearly indicate the purpose of "re-export trade" to avoid being flagged as an abnormal transaction by the international clearing system.

A formal "Transit Agreement" shall be signed for re-export trade to clarify the responsibilities of all parties, especially the clauses related to cargo ownership transfer. Soft clauses in letter of credit terms shall be strictly avoided, such as clauses requiring the transit port to issue a certificate of origin (re-export goods do not need a certificate of origin issued by the transit country).

The force majeure clause shall cover risks including port strikes and policy adjustments at the transit port, and specify the responsibility division for any delivery delays. When transferring cargo ownership, all endorsements on the bill of lading shall be consecutive and clear, to prevent cargo ownership out of control caused by blank endorsement.

In supply chain planning, the optimal transit port shall be selected based on the tariff policy of the destination country. For example, Singapore or Dubai can be chosen as the transit hub for European-bound shipments to evade anti-dumping duties. In terms of inventory linkage strategy, bonded warehouses can be set up at the transit port to realize "zero-inventory" transit and reduce warehousing costs.

For trade term selection, FCA (Free Carrier) is recommended rather than FOB, to avoid bearing extra logistics responsibilities in the transit segment. Accurate cost calculation shall take transit port fees, logistics time cost and exchange rate fluctuations into consideration, and a dynamic cost model shall be built to optimize the overall logistics route.
