We are a foreign trade enterprise focusing on 3C electronic products. Recently we are handling a transshipment trade from Port of Hamburg, Germany to Port of Los Angeles, USA, with planned transshipment at Port of Singapore.
However, the Port of Singapore authority requires modification of the destination port information on the bill of lading, which leads to inconsistency between the original bill of lading consignee (German exporter) and the new bill of lading (Singaporean trader). We are extremely anxious under this circumstance: Is bill of lading switching mandatory in this scenario?
If we do not switch the bill of lading, will the customs determine the goods as "split shipment" or "fake transshipment"? How to ensure no loss of title of goods during the bill of lading switching process? Is there any compliant bill of lading switching process template available?

Whether bill of lading switching is required in transshipment trade shall be comprehensively judged in combination with goods transshipment mode, bill of lading type and customs supervision requirements. Below are key operation points across the full link:
Pre-document Review Details: First confirm the type of the original bill of lading: order bill of lading can be transferred through endorsement, while straight bill of lading requires a title of goods transfer declaration issued by the original shipper, consignee and notify party. Secondly, verify whether the "third country value-added rate" specified in the transshipment agreement meets customs valuation requirements (the 2026 customs criterion for "substantial transshipment" determination in transshipment trade is that goods stay in the transshipment country for more than 15 days and complete substantial processing). If the destination port on the new bill of lading is consistent with the transshipment agreement and the goods involve non-EU country of origin (e.g. Singapore),the Third Country Transshipment Title of Goods Declaration shall be submitted simultaneously.
Core Node Connection: Consistency verification of bills of lading by the transshipment port customs is the key. Ensure "Three Documents in One" among bill of lading, manifest and logistics track, that is,the transshipment port (Singapore) and destination port (Los Angeles) stated on the bill of lading are fully consistent with the shipping route shown on the ocean manifest. If the bill of lading switching involves telex release bill of lading, apply to the carrier for "Bill of Lading Amendment Confirmation Letter" via SWIFT message,to avoid customs clearance failure when goods arrive at the destination due to message delay.
Abnormal Contingency Plan: If the bill of lading switching fails due to carrier system failure, you may apply to customs for "temporary release" by issuing an Irrevocable Letter of Indemnity (LOI). Note that the 2026 CIPS system has supported online verification of cross-border letters of indemnity,to avoid accumulation of port demurrage. If the goods have arrived at the transshipment port, you may adopt the combined operation of "bill of lading endorsement + transshipment trade filing" to ensure the title of goods will not be transferred to the Singaporean trader.
Compliance Implementation Standards: The final operation shall meet the "Two Documents and One Certificate" requirement, namely bill of lading, packing list and Transshipment Trade Filing Form (including value-added description in the transshipment country),and all documents shall secure the title of goods at the transshipment port under CIF terms. It is recommended to add a "Third Party Transshipment Mark" (Transshipment via Singapore) on the bill of lading simultaneously,to avoid being misjudged as "split shipment" by customs.

In transshipment trade, the "port of shipment" and "port of arrival" stated on the customs declaration form must be fully consistent with those on the bill of lading. If the transshipment port information is changed after bill of lading switching, note "Transshipment Port: Singapore" in the remarks column of the customs declaration form, to avoid triggering customs inspection due to inconsistency between declared data and manifest. If "offshore transshipment" is involved, the Qualification Certificate of Offshore Enterprise issued by the Singaporean party shall be additionally provided, to prove it is a real trade entity rather than a shell company.

The type of bill of lading endorsement must strictly match the transshipment mode: order bill of lading shall be endorsed in blank, and straight bill of lading must be affixed with a Title of Goods Transfer Letter issued by the original shipper. A 0.5% bill of lading amendment fee (2026 standard) shall be paid to the carrier during bill of lading switching, and the free storage period at Port of Singapore (generally 14 days) shall be noted, container demurrage at 0.05 USD/container/day will be incurred if exceeding the period.

VAT deferral cost shall be assessed for bill of lading switching in transshipment trade: if goods are imported from the EU to Singapore, "EU domestic VAT deferral" can be applied (Transshipment Trade Tax Planning Scheme is required to be submitted), to avoid duplicate payment of import VAT. Note that Singapore levies 7% Goods and Services Tax (GST) on transshipment goods, and the tax base can be reasonably reduced through related party transaction pricing (e.g. the Singaporean party provides value-added services).

CIPS system shall be prioritized for cross-border payment during foreign exchange collection, to avoid "intermediary bank code error" in SWIFT messages. If multi-currency settlement is adopted (e.g. EUR → USD → CNY), ensure that the "trade difference" is consistent with the bill of lading cargo value during foreign exchange settlement and account balancing, and conduct "cross-currency hedging" via offshore account when necessary to lock exchange rate fluctuation risks.

Legal documents for bill of lading switching shall cover "exclusivity" clauses: clearly specify in the Title of Goods Transfer Agreement that "the Singaporean trader only acts as the transshipment party and does not enjoy the final disposal right of the goods", to avoid title of goods disputes caused by bill of lading consignee change. Meanwhile, submit the Transshipment Trade Compliance Commitment Letter to General Administration of Customs in advance, to clarify the "non-commercial sale" attribute of transshipment goods.

During customs inspection, the consistency between seal number and the remarks column of the bill of lading shall be verified as the priority, and ensure that "number of packages and gross weight of goods" are consistent with those on the bill of lading during machine inspection. If "declared item name is inconsistent with the bill of lading" is found in inspection, the value-added processing certificate at the transshipment country (e.g. Singapore assembly and testing report) can be supplemented via Explanatory Letter, to avoid direct determination as "false declaration or concealment".

"Transshipment country climate adaptability" shall be clearly specified in MSDS for special packaging, for example, "moisture-proof reinforcement scheme" is required for high temperature and high humidity environment in Singapore (required by the newly added 2026 Cross-border Transport Packaging Standard). Full-process GPS tracking is required during goods transportation, to ensure that the movement track of goods at the transshipment port is consistent with the route on the bill of lading. Apply for port of call change or document correction immediately in case of any deviation.

"Four Flows in One" shall be prioritized for export tax rebate verification: the "title of goods transfer time" of bill of lading, customs declaration form, foreign exchange collection memo and VAT invoice shall be synchronized. If the invoice consignee is changed due to bill of lading switching, the invoice shall be voided and reissued before tax rebate declaration, to avoid being determined as "false issuance of special VAT invoices" due to "inconsistency between invoice consignee and bill of lading".

Adopt the "transshipment port sorting + bonded warehousing" mode for supply chain planning: set up a bonded warehouse at Port of Singapore, divide goods into "transshipment warehouse inventory" and "final export warehouse inventory", and reduce single inspection risk via "batch customs declaration". Meanwhile, establish a "dynamic calculation model for transshipment country value-added rate", to ensure that the value-added part is no less than 3% (the minimum value-added requirement for transshipment trade specified by 2026 customs regulations).。
