I have a batch of smart home products manufactured by a contract manufacturer in Southeast Asia. Originally I planned to ship them directly to the Port of Los Angeles in the U.S. for customs clearance, but I found recently that the tariff for direct import of this product category is nearly 30% higher than that for entrepot trade.

Some peers of mine who conducted third-country entrepot trade had their entire containers directly seized by U.S. Customs due to document defects, the goods were detained for over three months and finally had to be returned, leading to a loss of nearly one million. Now I am not sure whether the U.S. accepts entrepot trade, where the boundary of compliant operation lies.

I am afraid that hasty operation will either be deemed as malicious tariff evasion by U.S. Customs and get the entity blacklisted, or the process will get stuck and generate huge port demurrage and container detention fees. Could you elaborate on the latest practical operation requirements in 2026, and help assess whether this batch of goods can take the compliant entrepot trade route?

The most widespread misconception in the industry is that operators believe they can complete U.S. entrepot trade customs clearance smoothly as long as they change containers at the transit port and purchase a local certificate of origin. Such operation does not comply with 2026 U.S. Customs regulatory requirements at all. Once the system detects contradictions between the original factory information, initial logistics trajectory of the goods and the submitted origin information through cross-verification,full container seizure will be triggered immediately. Afterwards, the operator will not only be required to pay all due tariffs for the corresponding product category in full, but also face a maximum fine equal to 3 times the value of the goods. The trade entity will be directly included in the U.S. Customs high-risk list, which means all subsequent goods it ships to the U.S. will be subject to 100% inspection.

To achieve risk isolation, you must first ensure that the transit link meets the substantial transformation value-added requirement. The compliant entrepot trade recognized by U.S. Customs in 2026 requires that the value added of processes completed at the transit location accounts for no less than 35% of the total goods value, instead of simple container changing and label pasting. All documents shall be sorted out to form a closed loop in advance, including transit location processing working hour records, raw material purchase vouchers,full-course logistics trajectory sheets, and goods title transfer endorsement documents. No logical breakpoint shall appear across all information.

If Customs initiates origin retrospective inspection, submit the full set of value-added proof materials immediately, and do not randomly add irrelevant explanatory documents. Complete pre-verification of all documents 7 working days in advance, and arrange the first-leg shipment only after confirming all information is fully matched. This practice can avoid over 99% of cargo seizure and return risks, and realize compliant cost reduction.

The core logic of customs valuation for U.S.-bound entrepot trade is that U.S. Customs will trace the full-chain transaction price of the goods throughout the process, and will not solely rely on the certificate of origin issued at the transit location. Among the full set of declared documents submitted, the gradient change of goods value must conform to the value-added proportion at the transit location, and the value of goods after transit shall not be lower than the original ex-factory price.

If you receive a customs valuation query notice, provide the transaction contract and payment voucher for the corresponding phase immediately, do not arbitrarily increase the declared goods value in an attempt to pass the inspection, otherwise associated transaction traceability verification will be triggered. If the system automatically pushes a request for supplementary origin supporting materials, submit complete materials within 7 working days, and failure to submit within the time limit will directly trigger the cargo seizure procedure.

For the logistics route of U.S.-bound entrepot trade, transit ports in Singapore, Malaysia and other regions with signed free trade agreements are preferred. Routes provided by carriers with no less than 14 days of free storage period at the transit port are prioritized, to reserve sufficient buffer time for container changing, label pasting and processing at the transit port, and avoid high costs caused by port detention at the transit port.

The consignee field on the bill of lading shall not be filled with the information of the final U.S. buyer directly, you can fill in the associated trading company at the transit location as the consignee first, and issue the second-leg bill of lading to ship goods to the U.S. after completing the goods title transfer endorsement. The full-course logistics trajectory shall ensure that the manifest information of the first leg, transit phase and second leg are fully matched, no abnormal records such as port skipping or port modification shall be found.

For the tax structure design of entrepot trade, the profit corresponding to the value-added part of the transit link shall be accounted for by the entity registered at the transit location, instead of being fully recorded in the domestic entity’s account, to avoid triggering the pricing adjustment risk of cross-border associated transactions. For the U.S. customs clearance phase, you can apply for the local VAT deferral policy, so you do not need to prepay the full amount of value-added tax at the time of customs clearance, which greatly reduces capital occupation cost.

The transaction pricing of all transit links shall conform to the arm's length principle, and the floating amplitude shall be controlled within 15% of the average transaction price of the same category in the local market, to avoid being included in the BEPS key verification list, and will not trigger additional withholding tax levying requirements for non-resident enterprises.

The receipt and payment settlement chain of entrepot trade shall be fully corresponding to the goods title transfer nodes. The first-leg payment shall be remitted to the original manufacturing country entity, the transit phase payment shall be remitted from the U.S. buyer to the offshore account at the transit location, then the corresponding difference after value addition shall be returned to the corresponding entity. No mismatch between the capital path and goods title path shall occur throughout the process.

You can choose the CIPS cross-border RMB payment channel to complete the settlement of the transit link. The remittance information field of the SWIFT message shall accurately mark the corresponding bill of lading number and contract number for each transaction, to avoid the message being marked as a high-risk transaction leading to account freezing. Each capital flow shall be matched with the corresponding document for archiving during foreign exchange settlement and account balancing.

Before operating entrepot trade, sign a formal trade contract with the final U.S. buyer, clearly stipulate the processing arrangement at the transit location, to avoid goods title disputes in subsequent phases. If settlement is made by letter of credit, check for soft clauses in advance, do not accept clauses that require submission of non-processing certificate at the transit port which obviously contradict the basic logic of entrepot trade.

You can apply for a Letter of Indemnity (LOI) issued by the carrier to clarify the ownership of goods title during the transit phase, to avoid the situation of goods released without original bill of lading at the transit port. If the goods involve intellectual property rights, complete the intellectual property filing at the transit location and U.S. Customs in advance, to avoid the goods being judged as infringing goods and confiscated.

After container changing and sealing is completed at the transit port, check that the seal number, anti-counterfeit mark are completely consistent with the manifest information issued by the carrier immediately. Do not use non-official seals purchased privately. After the second-leg vessel arrives at the U.S. port, if the goods trigger machine inspection, sort out the full set of goods detail list in advance, ensure that the product category scanned by the inspection machine completely matches the declared information, no under-declaration or omission of declaration shall exist.

If manual unpacking inspection is arranged, fully cooperate with the guidance of customs officers, do not move goods inside the container without permission. Prepare corresponding product description documents in advance, and sign for confirmation only after all requirements on the inspection notice are responded properly.

Before container changing of entrepot goods at the transit port, completely clean up all original manufacturing country marks and shipping marks, do not leave any labels, instruction manuals, packaging debris marked with the original manufacturing country information inside the container.

For special goods such as chemical products and electric-powered goods that require MSDS, re-issue the MSDS document with the transit location entity as the issuer, all parameters shall be consistent with the actual attributes of the goods, no parameter contradiction between different versions shall be found. If the goods belong to the category that requires UN packaging certification, ensure that the UN mark on the newly replaced packaging completely matches the information declared for the second-leg shipment, to avoid the full container being seized due to non-compliant packaging.

For document filing of export tax rebate corresponding to entrepot trade, ensure full consistency of four flows across the whole chain, the corresponding contract, logistics document, capital flow and invoice information shall be matched one by one. If you receive a tax verification letter notice from the tax authority, provide the full set of explanatory materials for the full chain of entrepot trade, do not hide any operation details of the transit link.

When declaring across months, complete pre-declaration verification in advance, troubleshoot all logical abnormality points of the data. The period of foreign exchange collection and verification shall be controlled within 270 days after goods export, the part of payment that is not received within the time limit cannot enjoy the corresponding tax rebate policy, conduct time node control in advance to avoid losses.

For long-term stable U.S.-bound entrepot orders, you can build a zoned inventory linkage strategy, stock goods of regular sales volume in the bonded warehouse at the transit port in advance. After receiving orders from U.S. buyers, complete processing and value addition at the transit location before shipment, the overall logistics lead time can be reduced by more than 40%.

For trade terms, FCA terms that complete goods title transfer at the transit location are preferred, to clearly divide the rights and responsibilities of the first-leg logistics and second-leg logistics. The overall cost can be reduced by about 25% compared with the traditional direct shipment mode. Conduct full-link cost precision accounting on a regular basis, dynamically optimize the supply chain structure according to U.S. Customs tariff adjustments and policy changes at transit ports, to maximize the profit space of entrepot trade.
