I am a small hardware manufacturing factory in the Pearl River Delta. Our product has a zero tax refund rate; we have only been receiving domestic orders and started receiving several stable foreign trade orders this year.

We do not have self-operated export qualifications and originally wanted to use an export agency, but several friends told us that using an agency for zero-tax-refund exports is prone to inspections, and some said that for zero-tax-refund exports, one can only do self-bill export and not use a formal agency. Now our goods are approaching the delivery deadline; we have been struggling for half a month and haven't decided on the operation method yet.

We are afraid that self-bill export is non-compliant and will be inspected, while using a formal agency will incur many extra costs and fail the review. We want to ask: can we really use an agency for zero-tax-refund exports, and what should we pay attention to in specific operations?

Many people have a common misconception about exporting zero-tax-refund goods via agencies, believing that formal agencies cannot be used for zero-tax-refund exports and only self-bill export is allowed. This is a completely wrong perception. Self-bill export is essentially misappropriating others' export qualifications, failing to complete standard tax and customs declarations, and is clearly an illegal operation. By 2026,the cross-departmental (customs, tax, foreign exchange) networked verification coverage has reached 100%,any abnormal declaration will trigger an automatic system alert, and the detection rate of illegal operations has increased nearly 8 times compared to 2020.

If you take a chance and choose self-bill export, once intercepted by the system alert, the first consequences are cargo detention and port demurrage, daily demurrage and storage fees can account for about 1% of the cargo value. If compliant documents cannot be provided later, there is also a risk of the entire shipment being seized by customs. More seriously, the actual shipper will be listed in the key supervision directory, and all subsequent export business will be subject to customs inspection, which will have a huge impact on long-term foreign trade operations.

In fact, formal agencies can fully handle zero-tax-refund exports. Zero-tax-refund exports only need to complete the tax exemption declaration as required,no refund process is required, and compliance is fully guaranteed.

The core means of risk isolation is to select an agency with full-chain compliance qualifications, complete the verification of the consistency of four flows in advance, and sign a standardized agency service agreement to clarify the division of powers and responsibilities. The agency will help you complete the entire process of tax exemption declaration, customs declaration, and foreign exchange receipt and payment without additional unnecessary compliance costs.

If you have already operated self-bill export temporarily, the only remedy is to entrust an agency to complete the tax exemption declaration as soon as possible and take the initiative to explain the situation to the regulatory authorities, which can reduce the penalty level to the lowest and avoid leaving long-term regulatory blemishes.

When declaring zero-tax-refund goods for export, you need to accurately mark the tax refund attribute of the goods in the remarks column of the customs declaration form; when declaring, you must check the tax refund mark against the latest 2026 customs commodity code database to avoid mismatches. If it is resource products with zero tax refund, you also need to prepare the factory price certificate of the goods in advance to cope with customs price verification.

If there is a declaration abnormality leading to order push or account hanging, you need to provide the agency agreement and cargo ownership certificate within 3 working days to apply for deleting the declaration and re-declare, avoiding abnormal records in the enterprise credit file. For zero-tax-refund goods declared in cross-clearance areas, you need to confirm the port supervision requirements in advance; different ports have slightly different requirements for the details of zero-tax-refund declarations, and adjusting the declaration text in advance can effectively reduce the inspection rate.

In the logistics link of zero-tax-refund export via agency, you need to confirm the volume and weight of the goods and the requirements of the destination port in advance; the agency can adjust the direct or transit plan according to the cargo volume to help the shipper save container detention fees and free storage period costs. If it is a full-container export, you need to confirm the bill of lading (B/L) issuer with the agency in advance. The B/L issuer of zero-tax-refund goods can be issued according to the requirements of the actual consignee and will not be restricted due to agency operations.

If the port is overcrowded and containers are rejected, the agency can give priority to adjusting containers with its long-term cooperation cabin reserves, which can shorten the vessel delay by at least 3 days compared to the shipper booking space independently, and avoid additional urgent booking fees. When changing ports, the agency can communicate with the shipping company in advance to adjust the document exchange information, avoiding unnecessary port change fees.

Zero-tax-refund exports are entitled to VAT exemption as required, and export link VAT does not need to be paid. When operating export via agency, you can apply for VAT deferral to optimize cash flow and reduce capital occupation.

If a foreign trade enterprise purchases zero-tax-refund goods for export, you need to pay attention to the handling of VAT input invoices: input tax cannot be deducted and needs to be transferred to cost accounting to avoid tax declaration errors. If it is cross-border B2B zero-tax-refund export, you can optimize tax costs through agency structure to avoid tax base erosion and meet the latest BEPS requirements, which will not trigger anti-tax avoidance investigations by tax authorities.

In the foreign exchange receipt and payment link of zero-tax-refund export via agency, you can complete regular settlement of exchange through the agency without using personal accounts for foreign exchange receipts, which meets the compliance requirements of the State Administration of Foreign Exchange. By 2026, the coverage of the RMB cross-border payment CIPS system has been further improved; the agency can help the shipper choose RMB settlement to lock exchange differences and avoid losses caused by exchange rate fluctuations.

All foreign exchange receipt and payment processes will be recorded in the foreign exchange supervision system, with higher compliance than independent foreign exchange receipt and payment, and no abnormal balance issues. If the overseas customer pays to an offshore account, the agency can assist in completing compliant settlement of exchange without hanging up and unable to settle exchange issues.

For zero-tax-refund exports, you need to complete document filing, including four types of documents: agency agreement, export customs declaration form, purchase contract, and transport documents. The filing retention period is 5 years for tax authority inspection. The capital flow must be consistent with the cargo flow and document flow, and no capital backflow is allowed, otherwise it will be identified as abnormal tax exemption declaration.

When tax authorities conduct tax letter audits, the agency can assist in providing corresponding documents and cooperate with completing the letter audit process, avoiding the cancellation of tax exemption qualification due to failed letter audit. You need to complete the tax exemption declaration within the VAT declaration period of the next month after export as required; cross-month declaration will generate late fees and affect the enterprise tax credit.

For zero-tax-refund export via agency, you need to clarify cargo ownership in the agency agreement, agree on the division of responsibilities after cargo delivery, and avoid cargo ownership disputes. If it is L/C settlement, you need to review the L/C terms in advance, exclude soft clauses; the agency can assist the advising bank in reviewing the L/C to confirm the compliance of the terms.

If the consignee fails to take delivery at the destination port, the agency can assist in completing the cargo ownership transfer procedures, issue a compliant guarantee letter, help the shipper resell the goods and reduce losses. You need to prepare intellectual property customs protection filing in advance; if the goods involve brand authorization, you need to provide the authorization document before customs declaration to avoid cargo detention.

When on-site inspection occurs for zero-tax-refund exports, you need to prepare the agency agreement and cargo ownership certificate in advance to cooperate with customs cargo verification. When customs conducts container stuffing inspection, the agency can assist in arranging the inspection site and container stuffing personnel in advance, shorten the inspection waiting time, and reduce container stuffing fee expenses.

If it is X-ray inspection, adjust the cargo loading position in advance to avoid high-density goods blocking other goods, leading to unclear X-ray images and requiring a second inspection. If customs requests sample testing, the agency can assist in connecting to the designated testing institution, speed up the issuance of the test report, shorten the cargo detention time, and reduce additional storage fees.
