I am a 3C accessory manufacturing factory with an annual export volume of 3.2 million USD. Previously, I handled the entire process of customs declaration, foreign exchange collection, and export tax refunds independently. In the past six months, we have added many scattered orders from cross-border e-commerce clients, and our internal customs resources cannot keep up at all.

We plan to find an agency company to provide a full-service package for the export process. What I am unsure about now is whether tax refunds are mandatory after entrusting agency export? If we do it, is the declaration subject our company or the agency company?

I heard from peers that agency export tax refunds easily trigger tax verification inquiries, and it might take half a year to get the refund money. If we give up the tax refund directly, will we be fined by the tax authorities? Are there any new policy requirements for agency export tax refunds in 2026?

First, clarify that agency export does not have a mandatory requirement for "must refund",it depends on your cost-benefit calculation and qualification conditions. The cost difference between the two choices can be as high as 13%. If you give up the refund directly, the corresponding exported goods will be deemed as domestic sales by the tax authorities and subject to 13% VAT. Not only will there be no revenue, but it will also add at least 10% more tax cost. If the order profit margin is below 15%,it will basically be a direct loss.

The current 2026 policy supports tax refund declarations under compliant agency models. As long as your company can ensure the complete consistency of the flow of goods, capital, invoices, and agency entrustment, you can choose to have the agency company handle the refund on your behalf,or declare it yourself using the "Certificate of Agency Export Goods". The refund arrival cycle for both methods is within 7-15 working days, and the probability of triggering a verification inquiry is only about 3%,far lower than the average level of self-declaration.

The entry threshold only requires your company to have general taxpayer qualifications, and the corresponding exported goods belong to the tax refund catalogue category. Calculated based on the average refund rate of 13%,with your company's annual export scale of 3.2 million USD,the annual refund revenue is approximately 2.8 million RMB. After deducting agency service fees, the net income exceeds 2.6 million, far higher than the cost of giving up the refund. If there are indeed special scattered orders where input invoices cannot be obtained, you can make an exempt declaration in advance, without being deemed as domestic sales for taxation, and no fines will be incurred.

Before declaring agency export tax refunds, a pre-validation of documents is required. Focus on checking whether the agency export agreement clearly defines the subject of refund responsibility, whether the domestic consignor on the customs declaration matches the production and sales unit, and whether the name, quantity, and specifications of the goods on the input VAT special invoice correspond exactly to the customs declaration. If you choose the agency company to handle the refund, you must complete the filing for agency refund in the tax authorities system in advance.

The special invoice for agency refund issued by the agency company cannot be used as a VAT deduction voucher. Within 30 days after the refund is completed, the full set of documents including shipping orders, transport documents, and dock receipts must be retained for filing. Filing materials must be kept for more than 5 years for inspection. If a tax verification inquiry is triggered, all transaction vouchers for the corresponding order, including procurement contracts, material requisition slips, and warehouse delivery orders, must be submitted within 15 working days to avoid rejection of the refund due to missing materials.

If there are orders where compliant input invoices cannot be obtained, do not give up the declaration directly. You can make an exempt declaration in the month of export. You only need to transfer out the corresponding input tax amount, and no VAT deemed as domestic sales is required.

For cases with a high proportion of cross-border e-commerce scattered orders, the 2026 policy allows the superposition of the deemed levy policy under the 9610 model. No input invoice is required. Enterprise income tax is levied at a deemed profit rate of 4%, while enjoying the VAT exemption policy.

The comprehensive tax cost is controlled within 2%, far lower than the 13% VAT cost deemed as domestic sales. If the annual export volume exceeds 5 million USD, you can further reduce the comprehensive tax level by building a cross-border supply chain structure and retaining part of the profit in low-tax overseas regions.

Special attention must be paid to the logical correspondence of the three fields: domestic consignor, production sales unit, and consignee in the customs declaration filling for agency export. If the entruster declares the refund themselves, the domestic consignor is the agency company name, the production sales unit is the entruster name, and the remarks column must note "Agency Export"; if the agency company handles the refund, the remarks column must additionally note "Agency Tax Refund" to avoid rejection due to non-standard filling.

In 2026, national ports have achieved real-time synchronization of customs data with the tax authorities refund system. Data is automatically transmitted to the refund system within 24 hours after the customs declaration is released.

No paper customs declaration needs to be submitted. If there is a data transmission delay, you can contact the port customs to issue a retransmission message for the customs declaration electronic data, and data synchronization can be completed within 2 working days.

The foreign exchange collection link for agency export must strictly follow the principle of "who exports, who collects foreign exchange". If the agency company collects foreign exchange on behalf, the agency agreement must clearly specify the collection time limit, settlement exchange rate, and fee standard. In 2026, the coverage of CIPS cross-border RMB settlement has exceeded 60%.

You can choose cross-border RMB settlement without bearing exchange rate fluctuation risks. The settlement speed is 2-3 working days faster than SWIFT settlement, and there are no intermediary bank fees. After collection is completed, export exchange verification must be completed before the tax refund declaration.

The deviation between the collection amount and the declaration amount must not exceed 5%. If there is a shortage of collection, corresponding proof of difference, including overseas deduction vouchers and quality claim agreements, must be provided to avoid the refund failing due to non-compliant collection.

When signing the agency export agreement, the division of refund responsibilities between both parties must be clearly agreed, including the obligation to provide refund materials, the assumption of responsibility for refund failure, the payment time limit for refund funds, and liability for overdue breach, to avoid the agency company withholding the refund. If it involves intellectual property clauses of overseas clients, the agreement must clearly define the ownership of intellectual property to avoid goods being detained due to IP infringement, thereby affecting the refund declaration.

If a tax verification inquiry occurs, the responsibility for providing materials must be clearly agreed. The agency company is responsible for providing all materials in the customs declaration and logistics links, and the entruster is responsible for providing materials in the production and procurement links. If the inquiry fails due to missing materials from one party, the responsible party bears the corresponding tax loss.

For cases with many scattered orders, you can choose the agency company to provide consolidation export services, merging scattered orders from multiple customers for customs declaration to reduce declaration and logistics costs. The declaration cost for a single scattered order can be reduced by about 40%, and logistics costs by about 20%.

At the same time, goods can be declared by classification according to different refund rates. Goods with higher refund rates are prioritized for declaration and refund declaration to speed up capital return.

According to your company's current export scale, the comprehensive operating cost of the agency export + consolidation model is about 15% lower than self-operation. Adding the refund income, the annual comprehensive income can be increased by more than 3 million RMB, far higher than the income level of self-operation.
