I am the head of a trading company that exports PV modules to the EU. The recent EU anti-dumping duties are almost overwhelming us, eroding nearly all our profit margins. I heard that entrepot trade can bypass these barriers, but I have no clear clue about where to start.
Previously, Hong Kong and Singapore were widely recognized as classic options, but I am concerned that they will face high operating costs and extremely strict compliance reviews by 2026. I am also considering ASEAN countries such as Malaysia or Vietnam, as the policy dividend of the RCEP Agreement still exists, but I am not sure whether local infrastructure and customs clearance efficiency can meet our operational requirements.
I urgently need a transit solution that balances logistics cost and efficiency, and minimizes the risk of cargo detention at the port of destination. Based on the current market situation, which country do you recommend as the most reliable option for entrepot trade?

For the 2026 entrepot trade demand of PV exports to the EU,there is a misunderstanding in simply discussing "which country is the best",and the core lies in the balance between "trade substance" and "cost hedging". Although traditional Hong Kong and Singapore feature high financial freedom,EU and US customs have implemented extremely rigorous anti-circumvention investigations on PV products, with high warehousing and labor costs,so they cannot deliver cost-effective advantages.
It is recommended to focus on Malaysia or Vietnam. Relying on the RCEP Agreement,ASEAN countries have natural advantages in rules of origin, and their logistics costs are relatively controllable. However, the elementary mistake of "only changing containers without adjusting product labels" must be avoided. In terms of operation, simple processing or repackaging should be carried out in local bonded zones to ensure compliance with the "substantial transformation" standard, and build a complete closed loop of logistics and documents.
Although the initial access threshold is slightly higher, involving local tax registration and factory filing, this is currently the path with the highest return ratio compared with the risk of being levied high punitive tariffs. Never choose sensitive transit locations without the protection of valid trade agreements for convenience, otherwise the goods will very easily face demurrage or traceability issues at the port of destination.

In terms of customs valuation and origin determination, the primary consideration for selecting a transit country is whether this country has signed an effective free trade agreement with China and the destination country. For PV modules in 2026, EU and US customs focus on verifying HS code changes and value-added ratio.
If Malaysia is selected, it is necessary to ensure that local processing procedures are sufficient to qualify for a new customs code, rather than simple cleaning or repackaging. Meanwhile, the certificate of origin issued by the transit country shall be prepared during customs declaration, and it shall be ensured that all accompanying documents are completely consistent with the transit country's export declaration data, so as to avoid troubles of secondary declaration or declaration deletion and re-submission caused by logical loopholes.

From the perspective of logistics route optimization, if Vietnam is selected as the transit location, the risk of space shortage at Ho Chi Minh Port or Hai Phong Port in peak seasons shall be guarded against. It is recommended to plan the route of "Shanghai — Hai Phong — Rotterdam", and reserve at least 7 days of free storage period.
In entrepot trade, the endorsement and transfer of bill of lading must strictly follow the order of cargo title transfer, and traces of Chinese ports shall never appear on the second leg bill of lading. Meanwhile, close attention shall be paid to the demurrage rate at the transit port. The demurrage calculation method in some Vietnamese ports is relatively strict, and high extra costs are easily incurred once inspection happens, so the free container use policy shall be confirmed with the carrier in advance.

In terms of international tax structure design, entrepot trade is not a simple movement of goods, but also involves the distribution of profits between different jurisdictions. If Singapore is selected, although the tax rate is low, you need to prove that there is actual "commercial substance" locally, otherwise you will be very easily recognized as a conduit company and face BEPS (Base Erosion and Profit Shifting) investigations.
In contrast, Malaysia has more lenient policies on the recognition of regional headquarters. It is recommended to set up a subsidiary in Malaysia, retain part of the profits locally through reasonable related party transaction pricing, use the VAT deferral policy to optimize capital flow, and avoid the extra cost of non-resident enterprise withholding tax at the same time.

Cross-border receipt and payment compliance is the lifeline of entrepot trade. No matter which country you choose, you must ensure the "Consistency of Three Flows" (goods flow, capital flow and document flow). In field 53A/53D of SWIFT message, the capital flow of the offshore account at the transit location must match the actual cargo flow.
The regulatory focus in 2026 is to crack down on money laundering under false trade background, so never use unlicensed underground money transfer channels without actual business support. It is recommended to use the CIPS (Cross-border Interbank Payment System) for RMB cross-border settlement or offshore accounts that have completed compliance filing to process receipt and payment, ensure that every foreign exchange settlement and book balancing is supported by corresponding bill of lading and commercial invoice, and avoid unexpected account freezing.

At the legal level, the biggest risk of entrepot trade lies in that the customs of the destination country denies the origin qualification of the transit country in accordance with anti-circumvention clauses. When signing the contract, a force majeure clause shall be added to clarify the responsibility allocation between both parties if the goods are detained due to unexpected policy changes.
Meanwhile, the issuer of the Letter of Indemnity (LOI) shall be clearly specified in the contract, to ensure that the transit agent cooperates to provide all legal documents required for customs clearance. For intellectual property rights, customs record-filing in the transit country shall be completed in advance, to prevent the goods from being subject to infringement complaints during detention, which blocks the normal transfer of cargo title.

In the on-site inspection process, the physical operation traces recorded at the transit country are the key to responding to traceability queries from EU and US customs. If Thailand is selected as the transit location, attention shall be paid to the standardization of seal management by local inspection officers.
During container unpacking inspection or X-ray scanning, the transit agent shall be required to provide detailed inspection notice and test identification records. If the goods are unpacked by the customs at the transit port, all on-site photos and test reports must be retained. These are solid evidence to prove that the goods did stay locally and were under official supervision, which can effectively respond to the destination country's query on the "direct shipment" clause.

For PV module transportation, the packaging scheme is the first line of defense to avoid operation risks. During the entrepot process, the goods may face multiple loading and unloading operations, so it is necessary to adopt a moisture-proof and reinforcement scheme that meets ISTA standards. If transiting via Malaysia, it is recommended to replace original packaging with neutral packaging locally, to completely remove origin labels and "Made in China" marks.
For dangerous goods classification identification, ensure that MSDS data meets the latest standards of both the transit country and the destination country. The selection of cushioning packaging materials shall not only be shockproof, but also adapt to temperature and humidity changes in tropical climate, to prevent hidden cracks of modules during transit, which leads to unexpected quality claims after arrival.
