I am the foreign trade manager of a ceramic mug manufacturer in Guangdong. Previously, when exporting directly to the EU market, we lost many regular clients due to the additional 48% anti-dumping duty.
At the end of last year, a freight forwarder recommended the Malaysia entrepot trade model to me, saying that obtaining a local Certificate of Origin and then exporting to the EU could avoid anti-dumping duties. A peer of ours last year encountered an EU customs anti-investigation when doing entrepot trade, not only having 3 containers of goods detained, but also being blacklisted by the customs.
Now I am very confused and want to know what specific risks exist in the entrepot trade of ceramic mugs? Which nodes are prone to problems? Are there any ways to isolate risks in advance so that we will not lose both goods and money?

First,it is necessary to correct a common industry misunderstanding: obtaining a third-party Certificate of Origin alone does not avoid anti-dumping duties. Many small freight forwarders only handle superficial documents without matching local production, delivery, and logistics chain documents. Once investigated by the destination customs,100% of cases will be judged as falsified origin.
Once an anti-investigation is triggered,full-container demurrage will occur immediately. Daily container detention fees and storage fees are approximately 120 euros per day for a 20-foot container. If it exceeds 14 days, the goods will be auctioned, and in severe cases, the same type of goods exported in the past 12 months will be traced, requiring payment of all backdated anti-dumping duties, and even the enterprise will be blacklisted by EU customs, with all goods prohibited from entering.
For risk isolation, the first step is pre-qualification verification. The third-party service provider must have actual production qualifications for ceramic products and provide corresponding factory delivery notes, local VAT invoices, and inland transportation documents, not just a trading company. All documents must have 100% matching of product name, specification, quantity with the actual goods, and no marks related to Chinese production can appear, including outer box marks, product base labels, and instructions inside the packaging, which must be checked in advance.
For cargo ownership control, phased holding is required: the bill of lading from China to the third country should have your company as the shipper, and the bill of lading from the third country to the destination should have the local service provider as the shipper. The second-stage bill of lading should be telex released only after receiving the full payment from the client,to avoid the situation where payment cannot be collected after cargo ownership transfer. If a customs anti-investigation is encountered, the third-party service provider should be required to submit a full set of chain documents for review immediately. If it cannot pass, application for transshipment to a neighboring country for resale can be made to minimize losses.

In 2026, the anti-investigation intensity of the EU and the US against ceramic products for entrepot trade has increased to 27%, focusing on verifying the authenticity of third-party Certificates of Origin and corresponding local production traceability documents. When declaring at customs, it is necessary to compare the code of the third-party Certificate of Origin with the coding classification of the destination customs in advance. The first 6 digits of the HS code for ceramic mugs are global uniform, and deviations in subsequent sub-items will easily trigger price review warnings.
If a price review query is encountered, the production cost calculation sheet, factory invoices, and local customs declaration documents of the third-party factory should be submitted immediately to prove that the product price meets the normal level of the local market, avoiding being judged as dumping at low prices. In addition, transshipped goods cannot be shipped directly from the third-country port just by changing containers; there must be actual warehouse entry records, container change photos, and customs inspection records, otherwise it will be judged as "document washing" operation and detained directly.

As ceramic mugs are fragile products, the loss rate of two transshipment loads during entrepot trade should be controlled within 0.3% in advance. When selecting a third-country transshipment port, priority should be given to ports covered by direct shipping routes to avoid multiple transshipments increasing the probability of cargo damage.
For the first shipment, at least 21 days of free detention period should be applied for, and 14 days of free storage period for the second shipment, to avoid additional container detention fees due to customs clearance delays during transshipment. When changing containers, the whole process should be recorded with videos, including outer box marks, seal numbers, and cargo placement.
The videos should be retained for at least 18 months for future use in case of destination customs anti-investigations. The endorsement of the bill of lading should be a straight endorsement, not a blank endorsement, to avoid malicious transfer of cargo ownership during transshipment. If cargo is rejected, the nearest available vessel should be arranged first, and the exemption clause for delayed delivery should be communicated with the client to avoid liquidated damages.

The core of tax compliance in entrepot trade is to ensure the matching of capital flow, cargo flow, and document flow. The customs declaration amount from China to the third country must meet the requirements of export tax rebates, and cannot be intentionally understated or overstated, otherwise it will trigger a domestic tax letter inquiry.
The third-party service provider must issue corresponding service invoices, including container change fees, storage fees, and Certificate of Origin processing fees. All fees must be paid through corporate accounts, not private accounts.
If doing entrepot trade for the EU market, advance VAT deferred declaration should be made to avoid being unable to deduct after paying import VAT at EU ports, increasing additional tax costs. In addition, do not collect payment through personal accounts of third countries; all payments must go through regular offshore accounts or domestic foreign trade settlement accounts, avoiding being judged as tax evasion and facing fines or revocation of export tax rebate qualifications.

The collection of payments in entrepot trade should adopt phased settlement: the client's payment should first be transferred to the domestic foreign trade account, then the third-party service provider's fees are paid. Do not let the client directly transfer payments to the third-country account, otherwise it will trigger abnormal foreign exchange receipt and payment early warning from the foreign exchange bureau. The SWIFT message's remark should not contain sensitive words such as "entrepot", "transshipment", or "made in China"; directly write the product name and corresponding bill of lading number.
If settling in RMB, when using the CIPS channel, documents related to entrepot trade must be reported in advance to ensure that the source and purpose of the payment are legal and compliant. In addition, it should be noted that EU anti-investigations against transshipped goods will also verify the payment collection path. If it is found that the payment is directly received from China, the authenticity of the origin will be suspected, so an offshore account can be used as a transit to ensure that the payment collection path matches the shipper on the documents.

When signing a contract with the entrepot service provider, the responsibility for the authenticity of the Certificate of Origin should be clearly stipulated. If losses such as cargo detention, fines, or anti-dumping tracing are caused by falsified Certificate of Origin, all losses shall be borne by the service provider, and a maximum compensation amount not less than 1.2 times the cargo value shall be stipulated. An exemption clause for entrepot trade shall be added to the trade contract with the client, clarifying that delayed delivery or cargo detention caused by destination customs anti-investigations does not belong to the seller's liability for breach of contract, and no liquidated damages shall be paid.
In addition, a cargo ownership guarantee should be required from the service provider: during transshipment, cargo ownership belongs to the domestic seller; without the seller's written permission, the service provider cannot dispose of the goods without authorization, including transshipment, delivery, or mortgage. In case of intellectual property disputes, advance checks should be made to confirm whether the appearance design or pattern of the ceramic mug is registered in the destination country to avoid being sued for infringement.

When changing containers for ceramic mugs at the third-country port, all packaging and labels with Chinese production marks must be cleaned in advance, including the "made in China" mark on the bottom of the product, outer box marks, certificates of conformity, instructions, and even the logos on packaging belts, which should be replaced with local ones of the third country. During machine inspection, attention should be paid to the placement density of the goods.
Ceramic mugs have high density, and uneven placement will easily trigger machine inspection warnings, leading to manual container inspection. During manual inspection, actively cooperate with the customs' requirements, do not conceal the true situation of the goods, and take good photos and videos of the inspection for future reference. If sample inspection is required, prepare product inspection reports in advance to prove that the products meet the quality standards of the third country, avoiding being judged as unqualified products and detained.
