I am the person in charge of a small and medium-sized foreign trade enterprise engaged in cross-border home goods exports. For 3 years, I have always commissioned third-party agencies to handle export tax refund procedures. This year, there are 8 LCL shipments to Southeast Asia with small orders, each with a maximum value of less than $2,000.
The tax refund proceeds are not enough to cover the manual costs of document preparation and process handling. Additionally, there are 12 free sample orders sent to customers, for which compliant input VAT invoices cannot be obtained. I want to directly waive tax refund declarations for these two types of orders.
However, I previously heard from peers that not declaring tax refund may be deemed non-compliant by customs, affecting customs clearance and tax refund qualifications for other subsequent orders. I would like to consult: Is export tax refund mandatory? In which cases can tax refund be legally waived? What compliance procedures are required to waive tax refund?

Export tax refund is not a mandatory declaration item. Enterprises can choose to declare or waive it based on actual business conditions. The core criterion is the balance between compliance costs and actual benefits.
First, clarify two scenarios where tax refund can be legally waived: 1) For small export orders or samples where the tax refund proceeds are lower than comprehensive handling costs (document preparation, document verification coordination, etc.),declare under the category of "export tax exemption without refund",2) For cases where compliant input VAT invoices cannot be obtained and the four-way consistency requirement (goods flow, fund flow, invoice flow, logistics) is not met, voluntarily waiving tax refund can avoid being listed in the abnormal investigation list by tax authorities.
Two prerequisites must be met to waive tax refund: All export orders must undergo formal customs declaration, there must be no underreporting or omissions,Corresponding income must be truthfully declared as tax-exempt income in the enterprise's VAT declaration system. The latest 2026 regulatory rules allow small orders with individual batch value below $3,000 to use a simplified tax exemption declaration process, without providing input vouchers. Only customs declaration forms and logistics records need to be retained for filing.
Blindly declaring non-compliant orders may trigger tax document verification requests. This could temporarily suspend the enterprise's tax refund qualifications for 3-6 months,or even require tax payment with 0.5-5x fines. The total cost far exceeds the loss from waiving tax refund. Enterprises can establish a dynamic calculation model: directly choose tax exemption declaration for orders with single-batch tax refund proceeds below RMB 500.

Orders with tax refund waived must be separately filed in document ledgers, retaining customs declaration forms, commercial invoices, shipping documents, transaction communication records, etc. The filing period shall not be less than 5 years. If choosing tax exemption declaration, mark "Other Legal" in the "Tax Payment/Non-payment Nature" column of customs declaration forms.
In the corresponding tax refund system, mark "Non-refundable". It is prohibited to neither declare tax refund nor tax exemption.
Unmarked orders will trigger tax system alerts for four-way consistency verification. If verified as non-declared, enterprises will be required to pay 13% VAT and surcharges as domestic sales, and may have their tax credit ratings reduced, affecting other tax-related services.

Waiving tax refund does not affect normal customs clearance. No additional documents are required for customs declaration, but ensure the declared value, product name, quantity, etc. match actual goods. Do not deliberately underreport values to avoid tax refund declaration.
The 2026 customs valuation system is now synced with tax authorities in real-time. If the declared value of a single export batch is more than 30% lower than the average price of similar products in the same period, customs will trigger an alert and require submission of transaction contracts, payment records, etc. Failure to provide them may result in customs adjusting the duty-paid value and fines below 5% of the declared value, plus increased inspection rates (over 30%) for subsequent orders.

Receipt processes for tax-refund-waived orders are unaffected. CIPS or SWIFT channels can be used for normal settlement. When settling, only provide customs declaration forms and commercial invoices to banks; no additional explanation for tax refund waiver is needed.
Corresponding foreign exchange data must be declared in the foreign exchange monitoring system. Do not mix tax-refund-waived order receipts with other declared orders to avoid mismatched foreign exchange and tax refund data.
Mismatches may lead to being listed as a key monitoring object, with annual foreign exchange purchase/sales quotas restricted. Severe cases may suspend foreign exchange account functions, affecting all import/export fund operations.

If the annual value of tax-refund-waived orders exceeds 20% of total exports, submit the "Detailed List of Export Tax-exempt Business" separately during annual enterprise income tax final settlement, explaining reasonable reasons for waiver. Input VAT for tax-refund-waived orders cannot be used to offset domestic sales output VAT; it must be transferred out.
Failure to do so may require tax payment and penalties. For cross-border e-commerce orders under 9610/9710 models, directly apply the non-invoice tax exemption policy without input VAT transfer-out. The overall tax burden is lower, suitable for small-batch, high-frequency exports.

Waiving tax refund is an enterprise's independent operational decision with no legal non-compliance risks, provided no illegal acts (e.g., forged contracts, false declarations) occur. If trade contracts with foreign clients include export tax refund clauses, communicate with clients in advance before waiving tax refund to avoid contract disputes.
If clients require tax refund certificates but the enterprise voluntarily waives, contractual liability may arise, requiring compensation and potential blacklisting by clients, or even cross-border trade arbitration with additional legal costs.

Enterprises can flexibly choose tax refund or exemption based on order profitability, establishing a dynamic cost model: directly select tax exemption for single-batch orders with proceeds below RMB 500 to save manual document costs. If small orders exceed 30% of annual exports, adjust the supply chain to concentrate small orders for cross-border e-commerce exports, applying non-invoice tax exemption.
Comprehensive costs can be reduced by 15-20%. Separate large and small orders for customs declaration to avoid affecting large orders' tax refund progress. Balance compliance costs and actual benefits.
