I am a sales representative of a foreign trade company, mainly responsible for the entrepot business of consumer electronics from Southeast Asia to European and American markets. Since last year, Hong Kong's transit policies have been tightened amid Sino-US trade frictions. Last month, a shipment of our goods was detained in Hong Kong for 8 days, and the ownership documents were randomly inspected by customs, which almost delayed the delivery time for our core clients.

Now I plan to switch the transit route to Macao, but I am completely unfamiliar with Macao's entrepot trade policies. I would like to know whether it is legal to carry out entrepot trade in Macao in 2026, what documents need to be prepared, whether there are special requirements for foreign exchange settlement, whether there are inspection risks, and could you elaborate on the practical operation details and precautions of current Macao entrepot trade?

It is completely legal to carry out formal entrepot trade operations in Macao in 2026. Relying on the policy dividends after CEPA upgrading, its operation process is more convenient than other transit hubs. First,pre-document review needs to be completed: You shall complete the transit qualification filing with the Macao Economic and Technological Development Bureau in advance, and submit documents including trade contracts, ownership certificates, transit plans, etc. The review cycle usually takes 3 working days.

For core node connection,Macao entrepot trade must follow the principle of "three-region document separation",that is,documents of the place of shipment, transit place and final destination shall not have direct connection,to avoid being identified as mainland entrepot trade. For logistics, you can choose transit services of Macau International Airport or Macao Deep Water Port. You need to entrust an international freight forwarder with Macao transit qualification, and the bill of lading shall be marked with "Transit Place: Macao" and completed with local endorsement in Macao.

For abnormal contingency plans, the inspection rate of Macao Customs is about 3%. If you encounter on-site inspection, you need to prepare ownership certificates, translated versions of trade contracts, transit agreements and other documents in advance, and cooperate with the inspection for quick release. In case of port detention,Macao ports provide a maximum free storage period of 7 days, which can be extended to 14 days through the freight forwarder.

Two points need to be noted for final compliant implementation: First, foreign exchange settlement shall be handled through compliant banks in Macao, and non-compliant offshore accounts shall be avoided,Second,if goods stay in Macao for no more than 30 days, you can enjoy Macao's VAT deferral policy, and no value-added tax is required for the transit link. The whole process does not involve formal declaration with mainland customs, only local transit filing in Macao is required.

The core of document review for Macao entrepot trade is to confirm the "transit attribute". After CEPA upgrading in 2026, transit trade between the mainland and Macao can enjoy looser document review standards. Key documents to be reviewed include transit agreements, ownership transfer certificates and full bills of lading, among which the transit agreement shall specify that goods are only transited in Macao without processing or sales.

If there are direct related transaction records between the mainland and Macao in the documents, customs may question it as disguised mainland entrepot trade. You need to adjust contract terms in advance to ensure complete separation of trade flow, goods flow and capital flow across the three regions. In addition, Macao Customs has relatively detailed requirements for declaration elements of transit goods. You shall accurately fill in information such as HS code, certificate of origin and transit time of goods, to avoid customs detention due to false declaration.

For price review, Macao Customs adopts the transaction price method. As long as the transit link costs are reasonable, no additional price certificate is required.

But note that if transit costs are excessively high, you may be required to provide a detailed cost list, such as storage fees, loading and unloading fees, etc. In addition, if goods involve sensitive categories such as electronic products and textiles, you need to prepare the certificate of origin in advance to ensure compliance with Macao's preferential import tariff policies.

Macao's transit logistics routes are mainly divided into air and sea. Air transit can connect to routes covering more than 20 countries and regions worldwide through the freight hub of Macau International Airport, while sea transit relies on the container terminal of Macao Deep Water Port, covering major routes in Southeast Asia, Europe, America and other regions.

When choosing a freight forwarder, you shall confirm that it has local freight forwarding qualification in Macao and owns stable transit space resources, to avoid space shortage or container rolling.

For ownership control, the transit bill of lading shall adopt the "order bill of lading" and be endorsed in Macao, to ensure that ownership is only transferred to the final consignee and avoid ownership disputes in intermediate links.

In addition, Macao ports provide a maximum 7-day free storage period and 14-day free container period, which can be extended by applying to customs through the freight forwarder, to reduce costs of container detention fees and port detention fees. If you need short-term storage in Macao, you shall choose a storage enterprise with Macao Customs supervision qualification, to ensure goods are under supervision throughout the process.

Macao's tax policy for entrepot trade is relatively loose. According to 2026 policies, transit goods staying in Macao for no more than 30 days can enjoy the VAT deferral policy, and no value-added tax is required for the transit link.

But if goods are simply processed or sold in Macao, corresponding VAT shall be paid. In addition, if transit trade involves related party transactions, you need to make pricing arrangements in advance, to avoid being identified as BEPS risk by the Macao Tax Bureau.

For foreign exchange settlement, compliant banks in Macao provide both CIPS and SWIFT settlement methods. The capital flow of entrepot trade shall be consistent with goods flow and document flow, to avoid capital return or abnormal flow.

If withholding tax for non-resident enterprises is involved, you need to complete filing with the Macao Tax Bureau in advance to ensure compliant payment. In addition, there is no corporate income tax in Macao, and profits from entrepot trade only need to pay a small amount of stamp duty, with relatively low costs.

Compliance of foreign exchange receipt and payment for entrepot trade is the core risk point. According to Macao's foreign exchange supervision policies in 2026, funds for transit trade shall be settled through legal banking channels, and complete trade documents including contracts, invoices, bills of lading, etc. shall be provided.

If you use offshore accounts for settlement, you shall ensure the compliance of the accounts, to avoid being identified as money laundering or tax evasion by the Monetary Authority of Macao.

For foreign exchange settlement, compliant banks in Macao provide preferential settlement rates, which are slightly higher than those of mainland banks, reducing settlement costs. In addition, note that the time of foreign exchange receipt and payment shall be consistent with the transit time of goods, to avoid advance or delayed settlement.

If multiple transit links are involved, you shall record the capital flow of each link separately to ensure consistency of four flows. In addition, you shall regularly submit trade settlement data to Macao's foreign exchange administration department to avoid regulatory risks.

The entrepot trade contract shall clearly specify the transit place as Macao, and indicate that goods are only for transit without any processing or sales. Force majeure clauses shall be added to the contract to clarify risk responsibilities in the transit link, such as handling methods for port detention, customs detention and other situations.

In addition, you shall require the freight forwarder to provide LOI (Letter of Indemnity) to ensure it has transit qualification and can complete transit services on time.

For ownership transfer, endorsement transfer shall be adopted to ensure ownership is only transferred to the final consignee, avoiding ownership disputes in intermediate links. If third-party logistics enterprises are involved, you shall sign a detailed logistics agreement to clarify rights and obligations of both parties, including responsibilities for goods storage, transportation, inspection, etc. In addition, attention shall be paid to the applicable law of the contract.

Macao's legal system belongs to the civil law system, which is different from that of the mainland. You shall consult professional foreign trade legal personnel in advance.

On-site inspection by Macao Customs is mainly divided into machine inspection and manual inspection. Machine inspection has a high pass rate, and manual inspection will be carried out if abnormalities are found during machine inspection.

The focus of manual inspection is to check information such as quantity, model and certificate of origin of goods, and relevant documents including certificate of origin, trade contract, ownership certificate, etc. shall be prepared in advance.

Authenticity identification of seals is the focus of inspection. Macao Customs seals have unique anti-counterfeiting marks. If seals are found to be damaged or forged, it may be determined that goods have been swapped, and you shall contact the freight forwarder and customs for communication in time.

In addition, if goods need to be tested, samples shall be prepared in advance to ensure test results meet requirements. After inspection, you shall collect the inspection notice in time and confirm whether the seals and packaging of goods are intact, to avoid subsequent disputes.

Packaging of entrepot trade goods shall meet the requirements of Macao Customs. Especially for special categories such as fragile goods and dangerous goods, packaging materials conforming to UN standards shall be adopted.

For goods susceptible to humidity such as electronic products, moisture-proof packaging such as desiccant and moisture-proof film shall be used, to ensure goods are not damaged during transit.

Packaging labels shall be clear and accurate, including information such as goods name, quantity, HS code, destination, etc., and shall be marked in both English and Chinese. In addition, attention shall be paid to packaging strength to ensure goods are not damaged during loading, unloading and transportation.

If goods involve dangerous goods, MSDS (Material Safety Data Sheet) shall be prepared in advance, and relevant identification reports shall be submitted to Macao Customs to ensure compliance with dangerous goods transportation requirements.

If entrepot trade involves mainland export tax refund, you shall ensure consistency of four flows, that is, complete consistency of goods flow, capital flow, document flow and information flow. Complete transit documents including Macao transit filing certificate, bill of lading, customs declaration form, etc. shall be retained for the tax department's letter verification.

In addition, attention shall be paid to the declaration time of export tax refund, which shall be completed within 90 days after goods export, to avoid failure to get tax refund due to overdue declaration.

If transit trade goods are stored in Macao for a short time, you shall provide invoices and certificates of storage fees to ensure the rationality of expenses. In addition, attention shall be paid to document filing for export tax refund, and all trade documents shall be kept for at least 5 years for tax department audit.

If multiple transit links are involved, you shall record expenses and documents of each link separately to ensure compliance of tax refund. In addition, you shall regularly submit relevant data of entrepot trade to the tax department to avoid tax risks.
