I run an export business of 3C electronic products. Recently I have a batch of LED lamps to be shipped from Shenzhen to France, with the original plan of transiting via Rotterdam, the Netherlands for subsequent distribution.

However, the customs notified us during customs declaration last week that "the entrepot trade mode is suspected of false declaration". Currently all ports are strictly inspecting transit goods, and daily demurrage increases by 2000 RMB, which almost drains my working capital.

I heard that is entrepot trade completely banned in 2026? Can I really reduce tariffs on exports to the EU via entrepot trade? For compliant operations now, which countries are safe to choose as transit points?

Entrepot trade will not be eliminated in 2026. Instead,it is shifting from "grey practices" to "compliance-oriented operation". The biggest misconception in the current industry is that "entrepot trade equals false declaration of origin". In fact, under the framework of global trade agreements in 2026,entrepot trade remains a legitimate tool for tariff reduction, especially in the overlapping coverage area of RCEP and CPTPP (such as the ASEAN-Europe shipping route),the "cumulative clause" in the rules of origin can directly grant tariff exemption benefits.

Take your LED lamps as an example. If the goods are exported from Shenzhen to Penang Port,Malaysia (with prior completion of "re-export filing" at Penang Customs),then transited via Singapore Port to Europe, the EU anti-dumping duty (assumed original rate 15%) can be avoided. However, you shall note that the transit country must be a WTO member state and listed in the newly added 2026 Transit Country Re-Export Inventory. EU member states such as the Netherlands have tightened the judgment standard of "no substantial processing within EU territory",so it is recommended to give priority to Singapore Port (which obtained the new "Non-EU Transit Port" certification in 2026).

Operational Execution Roadmap: ① Pre-review stage: Submit the Compliance Statement for Transit Goods to the transit port customs, which shall include the physical status of goods (e.g. unprocessed, unlabeled),transit duration (no more than 90 days),and proof of final destination country,② Core node: Adopt the "offshore warehousing + direct shipment" model at Singapore Port, bind transit data via electronic manifest to avoid "container unpacking inspection",③ Compliance red line: Stay away from "tax haven transit" (such as BVI,Cayman Islands). Under the 2026 OECD anti-tax avoidance framework, such transit may trigger 30% withholding tax,④ Loss control tip: If the goods have been stranded at the transit port for more than 5 days, you can apply for a "demurrage reduction letter" by providing delay proof issued by the transit country customs (e.g. force majeure events such as extreme weather or strikes).

The core of entrepot trade in 2026 is "genuine goods ownership flow". It is recommended to use traceable logistics systems (such as blockchain-based goods ownership certificates) throughout the whole process, and avoid "empty transit" or "nominee goods ownership holding". Otherwise, once customs verification finds inconsistency between "document flow and logistics flow",a maximum fine of 500,000 RMB and goods detention will be triggered.

Entrepot trade in 2026 still requires submission of Certificate of Re-Export, with the newly added requirement of electronic signature verification by the transit country customs. It is recommended that you ask your local agent in Malaysia to prepare the 2026-version official customs form in advance to avoid being rejected due to "non-standard documents".。

Singapore Port is the preferred transit point for entrepot routes (it launched the new 2026 "direct shipment demurrage exemption" policy). If unpacking and re-sealing of packages are required during transit, full compliance inspection of packages (such as UN3480 lithium battery packaging) must be completed at the transit port to avoid port detention caused by mixed loading of dangerous goods.。

The EU VAT deferral policy was relaxed in 2026. Entrepot goods are exempt from VAT payment within the EU territory temporarily, with a required "EU territory guarantee letter".

It is recommended to confirm the guarantee amount (usually 15% of the goods value) with the local agent, and lock in exchange rates in advance to avoid losses from exchange rate fluctuation.。

Settling transit payment via the CIPS system can avoid SWIFT sanction risks. In 2026, the RMB Cross-border Payment System launched a new "RMB clearing channel for transit countries", with handling fee only 1/3 of that of SWIFT, and real-time arrival of funds.。

The bill of lading shall be an "order bill of lading" with completed "blank endorsement" to avoid goods ownership disputes. If the transit country is not a contracting party of relevant trade agreements, a "Non-discriminatory Certificate of Origin" shall be supplemented to prove that the goods have not been processed in any third country.。

Prepare "process flow chart + raw material list" for customs inspection, to prove that the goods only go through simple consolidation operations at the transit country (such as re-marking, distribution). In 2026, customs inspection focuses on verifying the "processing procedure list", to avoid wrong judgment of "substantial transformation".。

If the goods contain dangerous goods such as batteries, apply for UN number packaging appraisal in advance. Singapore Port released a new "Dangerous Goods Transit Blacklist" in 2026, banning transit of dangerous goods imported from countries such as Iran and Syria.。

Entrepot export tax refund requires prior completion of the "export tax refund filing form". A new "four flows in one pre-review" rule was introduced in 2026, requiring synchronous upload of logistics documents, payment documents, customs documents and goods ownership certificates.

It is recommended to confirm the matching criteria with the competent tax authority in advance.。

The combination of China-Europe Railway Express and entrepot trade can reduce costs. The newly launched 2026 "Shenzhen-Hamburg" China-Europe Railway Express has added a dedicated "entrepot distribution station", goods transited from Hamburg Port to inland Europe can cut 20% of the ocean freight cost, while avoiding port congestion risks.。
