Is Changing Bill of Lading and Modifying Transshipment Port Considered as Re-export Trade?

I am engaged in Southeast Asia re-export trade {$random_name}. Recently, for a batch of palm oil exported from Jakarta Port, Indonesia, the original plan was to transit through Hong Kong to Singapore. However, a sudden strike broke out at the Hong Kong port, causing shipping schedule delays.
We intend to modify the transshipment port on the bill of lading from Hong Kong to Singapore, and replace the consignee with our partner based in Singapore. After such operation, can this transaction still be recognized as re-export trade?
Will it be identified as "fictitious re-export" by the customs? In addition, after changing the bill of lading, we are worried about potential problems in taxation and foreign exchange settlement, and want to know how to ensure compliance and avoid customs inspection or fines under this circumstance.

In the 2026 cross-border trade scenario, the relationship between bill of lading change and re-export trade needs to be dissected from three dimensions: The essence of re-export trade is that "goods complete transshipment in a third country/region without substantial processing",while bill of lading operation refers to "endorsement and transfer of the document of title to the goods". The core difference between the two lies in whether the cargo flow goes through legal transshipment.
From the perspective of process compliance: Transshipment port modification needs to meet three conditions simultaneously: first, the bill of lading shall be a negotiable marine bill of lading (such as order B/L) with complete endorsements (blank endorsement or special endorsement shall correspond to the new consignee),second, the transshipment port modification shall be within the acceptable scope confirmed by the shipping company (the 2026 new regulation of International Liner Conference requires that the application for manifest amendment for transshipment port change shall be submitted 48 hours in advance),third, when making declaration, note "Transshipment Port Modification: Original Hong Kong → Current Singapore" in the remarks column of the Export Re-export Trade Customs Declaration Form, and attach the delay certificate issued by Hong Kong Port Authority (which is required for modifications caused by strikes).
A common misconception is "equating bill of lading replacement with re-export trade operation". If only the transshipment port is modified without changing the consignee entity, and no substantial processing (such as unpacking, repackaging or simple processing) of the goods is conducted in Singapore, the transaction still falls under re-export trade, however,if the goods are directly cleared and sold in Singapore (without further transshipment) after B/L change,it may be identified as "trade nature alteration",and supplementary tax shall be paid as per general import trade.
Three points shall be noted for risk isolation: First,it is prohibited to completely separate the bill of lading from the actual logistics route, which means the shipping company must confirm that the goods actually depart from Singapore Port, and no falsified transshipment records are allowed, second, keep all full-link cargo title transfer vouchers, such as the transshipment confirmation letter issued by the Singapore agent (new requirement added by customs in 2026),third,the foreign exchange settlement shall match the remark on the SWIFT message of "transshipment port modification" to avoid triggering verification by the State Administration of Foreign Exchange due to wrong collection route. It is recommended to update the transshipment port information in the Re-export Trade Filing Form synchronously, and complete the filing before conducting bill of lading operations.
Final compliance implementation suggestion: Complete the manifest amendment for "transshipment port modification" first (which requires declaring the manifest change to Shanghai Customs, the new C-2000 system online modification function is launched in 2026),then carry out bill of lading endorsement and transfer, meanwhile specify "Re-export Trade (Code 0139)" in the "Trade Mode" column of the Export Goods Customs Declaration Form, and mark the details of transshipment port modification in the remarks column.

Chief Customs Declaration Expert: Bill of lading alteration involves conversion risks between "Master Bill of Lading (MB/L)" and "House Bill of Lading (HB/L)". If the original B/L is a straight bill of lading, complete document of title proof shall be provided for bill of lading exchange; if it is an order bill of lading, the blank endorsement shall cover all transfer links.
In 2026, the Customs Document Examination Center has tightened verification on "transshipment port consistency" for re-export trade. If the manifest shows "Hong Kong transshipment" while the B/L shows "Singapore transshipment", it may trigger the risk of "inaccurate declaration", and the "Manifest Correction Certificate" issued by the shipping company shall be submitted.。

Senior Logistics Expert: Singapore Port has implemented the "Smart Transshipment System" in 2026. It is necessary to ensure that the actual cargo trajectory after B/L replacement is consistent with the system records.
It is recommended to apply for the seaway bill (B/L) for "transshipment port modification" synchronously to avoid cargo title disputes caused by "delivery of goods without original B/L". In terms of demurrage, the Hong Kong Port Authority has a "force majeure" clause for shipping schedule delays caused by strikes in 2026, but the goods shall be transshipped within 3 working days after B/L replacement, otherwise additional container detention charges may be incurred.。

Senior Tax Consultant: Under the 2026 VAT deferral policy for re-export trade, it is required to ensure that the residence time of goods at the transshipment port does not exceed 90 days (new regulation of Singapore Customs).
If the goods are directly sold in Singapore after B/L replacement, 13% consumption tax (Singapore consumption tax is raised to 9% in 2026) shall be supplemented, and the value-added tax (VAT) generated during the original export from Indonesia is not deductible. It is recommended to adopt "offshore account + CIPS cross-border payment" to avoid tax verification caused by wrong remarks on SWIFT messages.。

Trade Compliance Expert: Foreign exchange settlement shall match the logistics trajectory of "transshipment port modification". If the original foreign exchange collection route is "Indonesia → Hong Kong → Singapore", remark "transshipment port modification" when collecting foreign exchange after B/L replacement, to avoid triggering SAFE verification due to the difference between the foreign exchange collection amount and the declaration amount.
In 2026, the State Administration of Foreign Exchange added "matching of bill of lading transfer path and capital flow" to the "four flows in one" verification requirements for re-export trade, and it is necessary to ensure that the transshipment port information on all documents is consistent.。

Foreign Trade Legal Expert: Bill of lading replacement involves the transfer of cargo title under the Hague Rules. Attention shall be paid to the legal relationship between "bill of lading endorsement" and "actual cargo title transfer".
If the consignee after B/L replacement is a Singapore company, an Exclusive Transshipment Agreement shall be signed and notarized, to avoid being held liable by the shipping company for "delivery of goods without original B/L". The 2026 UNIDROIT Principles of International Commercial Contracts adds the "transshipment port modification" clause, which requires both parties to confirm the division of responsibilities after modification in written form.。

On-site Inspection Expert: If customs inspection finds "transshipment port modification without shipping company certificate", it may trigger "unpacking inspection". It is recommended to prepare in advance the "Hong Kong Port Authority Strike Certificate" (with official seal affixed), the shipping company's Manifest Modification Receipt, and the cargo transshipment confirmation letter issued by the Singapore agent.
In 2026, the inspection focuses on verifying "whether the transshipment port is consistent with the bill of lading", so as to avoid being identified as smuggling due to inconsistent package marks and bill of lading information.。
