I am an enterprise owner running Southeast Asia-focused transit trade, and recently encountered a serious trouble: a consignment of electronic accessories shipped from China to Europe was detained by local customs during transshipment in Singapore, on the grounds of incomplete transit documents and unmatched records of capital flow and goods flow. The goods have been stranded at the port for one week, with daily container detention charges and storage fees rising continuously, while the end customer is pressing for delivery, making me extremely anxious.
I previously thought that transit trade only needs a transit port, never expecting the supervision to be so strict. Now I have no idea how to solve the current goods detention problem, and I am more worried about how to operate compliantly to avoid similar risks in future transit trade operations?

First, take immediate actions to address the Singapore customs detention issue: contact the customs broker at the transit port to obtain the specific list of discrepancy points raised by customs, such as missing document types (e.g. transit trade permit, copy of certificate of origin) or inconsistent data items (e.g. mismatched bill of lading consignee and payer). Then quickly supplement the missing documents. If the issue involves mismatch between capital flow and goods flow, provide authentic trade contracts, payment slips and logistics authorization letters to prove the authenticity of the transaction.
Trace back to the root of the problem, common loopholes include: failure to verify the regulatory requirements of the transit port in advance (e.g. Singapore requires original manufacturer's authorization letter for transit of electronic accessories),broken document chain (e.g. bill of lading not properly endorsed for transfer),and failure to process fund receipts and payments through compliant channels (e.g. settlement via personal accounts). These loopholes will trigger customs verification on trade authenticity.
Immediate emergency response: If the goods still cannot be released after document supplementation, you can entrust a local compliant institution to issue a trade authenticity statement,or apply for the customs fast-track processing channel (e.g. expedited verification via Singapore's TradeNet system). Meanwhile, negotiate with the customer for delayed delivery to reduce breach of contract losses.
A long-term risk control closed loop requires three measures: Conduct due diligence on transit port compliance in advance (including document requirements and regulatory procedures),Establish full-link document management (ensure full consistency of four flows: contract, bill of lading, invoice and payment order),Select compliant logistics and payment channels (e.g. use the CIPS system for cross-border RMB payment).

The logical consistency of documents is the top priority in the customs declaration link of transit trade. Taking Singapore Customs as an example, for declaration of transit goods, the transit confirmation letter, certificate of origin (if required by the transit port), as well as commercial invoice and packing list of the goods shall be submitted. In case of document discrepancy, customs will launch manual document verification procedure, and even detain the goods.
For resolution, first confirm whether the HS code on the customs declaration form is consistent with the actual goods, as a wrong HS code will directly lead to non-conformity of regulatory conditions. Second, check whether the consignee on the bill of lading is the agent company at the transit port rather than the end buyer, which is a key detail for transit trade customs declaration.
In addition, if the goods involve registered brands, the brand authorization letter shall be provided to avoid detention caused by intellectual property issues. For subsequent operations, it is recommended to use the customs pre-verification system (e.g. Singapore's Pre-Declaration Service) before customs declaration to identify document issues in advance and reduce customs clearance risks.

Regulatory risks in the logistics link of transit trade mainly focus on cargo right control and transshipment procedures. For example, during the storage of goods at the transit port, ensure that the endorsement and transfer of the bill of lading complies with local laws and regulations to avoid loss of cargo right. If the goods are detained, check whether the logistics track is complete: including the loading record at the port of origin, the unloading and storage records at the transit port, and the delivery plan at the port of destination.
For the port detention issue, negotiate with the shipping company to extend the free storage period, or entrust a local logistics service provider to transfer the goods to a bonded warehouse to reduce port detention fees. In addition, when selecting a transit port, give priority to ports with transparent regulatory procedures and sound logistics infrastructure (e.g. Singapore, Hong Kong) and avoid niche ports with non-standard supervision. Meanwhile, it is recommended to purchase logistics insurance covering risks such as goods detention and damage during the transit period.

The core of transit trade tax supervision is to avoid double taxation and ensure VAT compliance. Taking the European destination as an example, if goods are transshipped via Singapore, confirm whether the transit port levies VAT or other taxes on transit goods. Singapore generally exempts VAT on transit goods, but relevant transit proof (e.g. transit bill of lading, destination port customs clearance documents) is required for application.
In addition, if the transit trade involves related parties, ensure that transfer pricing complies with BEPS (Base Erosion and Profit Shifting) rules to avoid being recognized as profit transfer by tax authorities. It is recommended to clearly define tax liability division in the transit trade contract, for example, the transit port agent is responsible for filing local tax returns, and retain all tax-related documents (e.g. VAT return forms, tax payment certificates) for at least 7 years for tax inspection.

Compliance of fund payment and foreign exchange settlement for transit trade requires compliance with foreign exchange regulatory requirements. For example, when processing transit trade payment and receipt of foreign exchange within the territory of China, the transaction shall be declared through the State Administration of Foreign Exchange's Goods Trade Foreign Exchange Monitoring System, with documents such as transit trade contract, bill of lading and invoice submitted. If the amount and time of capital flow do not match those of goods flow, the transaction will be listed as an abnormal transaction by the foreign exchange authority.
For resolution, provide authentic trade background materials to prove the rationality of the fund receipt and payment. In addition, using the CIPS system for cross-border RMB payment can improve compliance, as the transaction records of CIPS are more transparent, which facilitates verification by regulatory authorities. It is recommended to confirm the foreign exchange policies for transit trade with the bank before payment and receipt, to avoid fund freezing caused by policy understanding deviation.

The legal risks of transit trade mainly come from contract clauses and cargo right transfer. For example, under the letter of credit payment method, avoid soft clauses (e.g. requiring the submission of the transit port customs release certificate), which will increase the breach of contract risk when goods are detained. If the goods are detained, negotiate solutions with the customer according to the force majeure clause or dispute resolution clause in the contract.
In addition, cargo right transfer shall be completed via bill of lading endorsement, to ensure the continuity and legality of the endorsement and avoid third-party claims on the cargo right. It is recommended to clearly define the liability division of the transit port in the transit trade contract, for example, the transit port agent is responsible for goods storage and customs declaration, and purchase cargo transportation insurance to cover losses during the goods detention period.

When transit goods are inspected at the transit port, the following points shall be noted: First, cooperate with customs inspection officers and provide all relevant documents (e.g. bill of lading, invoice, packing list), and ensure that the goods are consistent with the description on the documents. If customs doubts the authenticity of the trade, they may conduct container unpacking inspection. At this time, ensure that the goods are properly packed with clear labels. In addition, check whether the seal is intact.
If the seal is damaged, provide the seal replacement record to prove that the goods have not been tampered with. If customs requires sample submission for testing, cooperate to provide the sample and track the progress of the test report. It is recommended to conduct pre-inspection on the goods before shipment to ensure that the goods meet the regulatory requirements of the transit port and reduce the risk of on-site inspection.
