I am the operator of a small and medium-sized clothing manufacturing enterprise in Zhejiang that has just launched self-operated export business. We used to supply goods to foreign trade companies, and this year we received overseas orders independently and hired an agency company to provide export agency services. Now we are at the tax refund stage and I am completely confused.

I do not know whether the agency company handles the tax refund for us or we need to handle it ourselves? What materials do we need to prepare? What compliance requirements do we need to meet?

I heard from peers before that it is easy to encounter pitfalls when entrusting an agency to handle tax refund, which may lead to tax correspondence inspection, even failure to receive tax refund, and leave violation records. I want to know clearly how agency export tax refund works, what the whole process is, and what we need to cooperate with to get the tax refund smoothly.

There are two operation modes for agency export tax refund classified by handling subject: one is that the entrusting party handles the tax refund independently, the other is that the agency company handles the tax refund on behalf and then transfers the amount to the entrusting party. The current mainstream compliant operation is independent handling by the entrusting party, and the full-chain operation can be divided into four clear core stages.

The first stage is preliminary document review, which requires checking four types of core documents in advance: Certificate of Agency Export Goods issued by the agency company, electronic information of export goods declaration form,VAT input invoice, and export foreign exchange receipt certificate. Confirm that the goods name, pricing unit and transaction quantity on all documents are completely consistent,to avoid the application being rejected directly due to information mismatch.

The second stage is core node connection. After the goods are exported and declared, the entrusting party needs to log in to the export tax refund module of the electronic tax bureau to submit declaration data within 90 days. The agency company needs to complete the filing and verification of the Certificate of Agency Export Goods at the tax authority of the customs declaration place in advance, and synchronize the information to the competent tax authority of the entrusting party,to avoid delayed review caused by information asynchronization.

The third stage is abnormal response plan. If tax correspondence inspection is triggered, you need to sort out and provide materials including procurement contracts, payment records, logistics bills of lading and other materials to cooperate with the inspection within 10 working days. If the declaration information is wrong, you need to correct it in time and resubmit,to avoid delaying the tax refund cycle.

The final compliance implementation stage: after the declaration data passes the review, the tax refund will be directly transferred to the corporate account of the entrusting party. You need to keep the full set of document filings throughout the process, and all materials shall be retained for no less than 5 years, which meets the regular inspection requirements of tax authorities in 2026.

Handling agency export tax refund must meet the requirement of "four flows consistency", that is, the information of goods flow, invoice flow, capital flow and contract flow are completely matched, which is the core inspection point of tax authorities in 2026. If there is capital backflow, that is, transferring the funds back to a third-party account after receiving the tax refund, it will be directly determined as a violation.

In minor cases, the tax refund will be temporarily withheld, and in serious cases, the enterprise's tax credit rating will be affected. In daily operation, you need to sort out all document filing materials in advance, including the catalog of export goods filing documents, purchase contracts, export goods loading notes, and export goods transport documents.

All materials shall be archived uniformly, and can be retrieved immediately when the tax authority initiates inspection, to avoid tax refund review failure due to missing materials. For cross-month declaration, you need to conduct pre-declaration verification in advance, and submit formally only after confirming that the declaration data is correct, to reduce the number of modifications.

Agency export tax refund can be optimized in combination with the latest cross-border tax policies in 2026. If the entrusting party is a small and low-profit enterprise, it can enjoy the additional tax reduction and exemption policy corresponding to export tax refund. Complete classified declaration of taxable goods in advance, and you can automatically enjoy the reduction and exemption without submitting additional applications.

For cross-border B2B bulk cargo export, you can apply for VAT deferral to ease the capital occupation pressure in the export link. The access threshold requires the enterprise's tax credit rating to be above Grade B and no major tax violation records. Eligible enterprises can submit the application simultaneously when declaring export tax refund, and the approval cycle is no more than 7 working days. Note that different categories of export goods have different tax refund rates, you need to check the tax refund rate corresponding to the HS code in advance, to avoid incorrect calculation of tax refund amount due to wrong code classification.

Agency export tax refund requires that the export goods must complete foreign exchange receipt verification, which complies with the latest compliance requirements of the State Administration of Foreign Exchange in 2026. Except for special cases of deemed foreign exchange receipt, all export goods need to provide corresponding foreign exchange receipt certificates to handle tax refund.

If RMB cross-border settlement is adopted, the payment shall be completed through the CIPS system, and the corresponding settlement message shall be retained and submitted together when declaring tax refund, to avoid tax refund failure due to non-compliant settlement path. For overseas orders with an account period of more than 180 days, you need to file with the competent tax authority in advance to explain the delayed foreign exchange receipt. Approved filing will not affect normal tax refund declaration, and will not trigger abnormal warnings.

For entrusted agency export tax refund, the rights and responsibilities of both parties shall be clarified in the agency agreement, especially the division of responsibilities related to tax refund. It shall be clearly agreed that if the tax refund fails due to wrong information declaration by the agency company, the agency shall bear the corresponding loss compensation liability.

The time node for document delivery shall be specified in the agreement, to avoid overdue declaration and missing the tax refund deadline caused by delayed delivery of the Certificate of Agency Export Goods by the agency company. Note that if the agency company collects the tax refund on behalf of the entrusting party, the time cycle for tax refund transfer and the penalty clause for overdue transfer shall be agreed, to protect the capital rights and interests of the entrusting party and avoid the tax refund being occupied.

The customs declaration information of agency export goods must be completely consistent with the tax refund declaration information. If the domestic source of goods declared on the customs declaration form is wrong, it will directly trigger correspondence inspection by the competent tax authority, and even lead to refusal of tax refund handling. If the customs declaration information is wrong, you need to apply to the customs for deletion and re-declaration in time, and handle the tax refund only after modifying the information correctly, to avoid declaring with wrong information and affecting the tax refund progress.

If integrated customs clearance declaration is adopted, you need to confirm the time when the customs declaration information is synchronized to the competent tax authority of the entrusting party. If the synchronization is delayed for more than 10 days, you need to contact the port customs to re-push the information, to ensure that the tax authority can normally retrieve the electronic customs declaration information.

For enterprises with long-term demand for agency export tax refund, they can optimize the scheduling of export orders, adjust the customs declaration and export time in combination with the monthly tax refund declaration cycle, to avoid centralized customs declaration at the end of the month leading to delayed information synchronization, missing the current month's tax refund declaration deadline and increasing capital occupation time.

You can sort out orders by natural month, plan the time nodes of customs declaration, foreign exchange receipt and document sorting in advance, form a standardized operation process, improve the efficiency of tax refund declaration, and shorten the tax refund arrival cycle. On average, the tax refund arrival time can be shortened by 3-5 working days, accelerating the capital turnover of enterprises, which can effectively relieve cash flow pressure for small and medium-sized export enterprises.
