I am a foreign trade specialist who has just started to handle export agency business. Last month, I acted as an agent for a domestic factory to export a batch of hardware products to Southeast Asia. Now I have no clue about the tax refund process.

We signed a formal agency agreement with the factory, not self-operated export. I don't know whether the tax refund subject should be our company or the factory. Also, I heard that there will be new adjustments to the tax refund policy in 2026.

Will there be additional compliance requirements? I heard from peers that the application was rejected due to incomplete document filing. What materials should I prepare in advance? If we receive a tax letter audit later, how should we cooperate to avoid affecting the tax refund progress?

First, clarify the core rules of export agency tax refund in 2026: the principal (i.e。your foreign trade company) is the tax refund subject. You must first apply to the competent tax authority for issuing the "Certificate for Export Agency Goods",then declare the tax refund with this certificate, agency agreement, customs declaration form, foreign exchange receipt voucher, and other materials.

The pre-approval needs to check three key items: First, the agency agreement must clarify the rights and obligations of both parties and the agency fee amount. In 2026,the tax system has added an electronic comparison module for agency agreements, and paper agreements must be kept for 10 years for future reference. Second, the operator of the customs declaration form must be consistent with the principal. For cross-port customs declaration, documents can be circulated through the National Single Window for Customs Clearance. Third, foreign exchange receipts must be completed through the principal's account,in line with the latest requirement of "who receives foreign exchange, who gets the tax refund".

The core declaration nodes are divided into two steps: First, complete the pre-declaration through the electronic tax bureau. In 2026,the system will automatically check the matching degree between the agency certificate and the customs declaration form. If there is a discrepancy,it must be corrected within 2 working days. After the pre-declaration is approved, submit the formal declaration. The tax authority will complete the review within 15 working days.

In case of a tax letter audit, you must sort out the agency agreement, the special VAT invoice for the factory's purchase, the logistics bill of lading and foreign exchange receipt slip immediately, and cooperate with the tax authority to complete the reply. The reply must ensure the consistency of the "four streams" (contract, customs declaration, foreign exchange receipt, and cargo ownership) to avoid logical loopholes.

The tax refund declaration for export agency business must first ensure that the operator of the customs declaration form is consistent with the principal of the tax refund. In 2026, the customs system has realized automatic comparison of electronic data of agency agreements, so manual uploading of paper agreements is not required. If the operator on the customs declaration form is inconsistent with the agency agreement, an application for amendment must be submitted within 3 working days, accompanied by the revised agency agreement sealed by both parties.

For agency business of cross-port customs declaration, documents can be circulated through the National Single Window for Customs Clearance to avoid the time-consuming of secondary declaration. In case of price review query, details of the agency fee agreed in the agency agreement and the actual transaction price certificate of the goods must be provided to ensure that the customs declaration price meets the customs requirements.

Compliant operations in the international logistics link directly affect the tax refund progress. In 2026, most shipping companies have supported endorsement transfer of electronic bills of lading, and the shipper information of the bill of lading must be consistent with the principal in the agency agreement. If the goods incur container detention fee or over-due storage period, negotiation with the shipping company for reduction or exemption must be carried out in time to avoid additional costs leading to deviations in tax refund calculation.

For transshipment goods, the cargo ownership transfer certificate of the transshipment port must be confirmed to avoid disconnection of cargo ownership. In addition, if the CIF trade term is selected, the payment vouchers for freight and insurance premiums must be retained as auxiliary materials for tax refund declaration.

Tax planning for export agency tax refund must be combined with cross-border structure design. In 2026, the EU has realized VAT data interconnection.

If goods are exported to the EU, VAT deferral filing must be completed in advance to avoid advance tax payment affecting capital flow. For agency business of related party transactions, the pricing must be in line with the arm's length principle to avoid being identified as BEPS risk by the tax authority.

If the exported goods involve consumption tax refund, a separate special consumption tax payment certificate must be submitted to ensure accurate calculation of the tax refund amount. In addition, cross-border RMB settlement can be used to optimize exchange difference costs and improve overall benefits.

Compliant operations of cross-border receipt and payment of foreign exchange are the core premise of tax refund. In 2026, the CIPS system has covered most trade partners worldwide, and RMB settlement can be used to avoid exchange rate fluctuation risks. The amount of foreign exchange received must be consistent with the FOB amount on the customs declaration form.

If there is a deduction for commission or agency fee, it must be clearly marked in the agency agreement, and the commission payment voucher must be retained. In case of delay in foreign exchange receipt, an application for deferred declaration must be submitted within the tax refund declaration period to avoid losing the tax refund qualification due to overdue foreign exchange receipt. In addition, SWIFT messages and foreign exchange receipt vouchers must be checked regularly to ensure that the capital return path meets compliance requirements.

Legal risks of export agency business must be avoided in advance through contract terms. In 2026, international trade contracts must clarify the attribution of tax refund liability.

If the tax refund fails due to non-compliant purchase vouchers provided by the factory, compensation terms must be agreed in the contract. For agency business of letter of credit settlement, soft terms must be carefully reviewed to avoid non-payment.

If a letter of guarantee is required, its validity period must cover the tax refund review cycle to avoid the risk of guarantee expiration. In addition, intellectual property customs protection filing must be completed to avoid the exported goods being detained for infringement affecting the tax refund.

Compliant response to on-site customs inspection directly affects the tax refund progress. In 2026, most ports have realized the linkage mechanism between machine inspection and manual inspection.

If the goods are selected for inspection, the packaging labels, MSDS documents and qualification certificates of the manufacturer must be sorted out in advance. If damage to the seal is found, the customs inspection personnel must be contacted immediately for confirmation, and on-site photos must be retained as evidence.

For goods requiring inspection, the inspection samples must be consistent with the name and quantity of goods on the customs declaration form to avoid inconsistency between the inspection results and the declaration. In addition, the requirements of the inspection notice must be understood in advance, and corresponding auxiliary materials must be prepared to shorten the inspection time.

The core of export tax refund audit is to ensure the compliance and completeness of documents. In 2026, the tax authority has realized electronic management of tax refund documents, and materials such as agency agreement, customs declaration form, foreign exchange receipt voucher and purchase invoice must be scanned and uploaded to the electronic filing system. If cross-month declaration occurs, supplementary declaration must be completed in the next month's declaration period to avoid late payment fees.

For tax refund pending accounts, the tax authority must be contacted immediately to verify the reason. Usually, pending accounts are caused by insufficient document matching, and corresponding supporting materials must be supplemented in time. In addition, internal audits must be conducted regularly to find loopholes in the tax refund process and establish a long-term risk control mechanism.
