I am a small domestic manufacturer that has just started export business. Previously, we only engaged in domestic sales. This year, we received our first overseas order from Southeast Asia with a significant amount.

We do not want to give up the profit from the tax refund, but we find the application process for import and export rights too cumbersome and have not applied for the qualification. We consulted a few agencies; some said we must have import and export rights to do agency tax refunds, while others said it is not necessary. I am unsure now.

If we mishandle the operation, not only will we fail to receive the tax refund, but we may also face tax audit fines, which would outweigh the gains. I want to clarify: do we actually need our own import and export rights for agency tax refunds? If not, can this be done compliantly?

There is a common misconception in the industry: that agency tax refunds require the client to possess import and export rights themselves. Many small agencies use this as an excuse to charge extra qualification affiliation service fees,or even require enterprises to register under their name to increase revenue.

The chain risks of such operations cannot be underestimated: affiliating qualifications leads to inconsistency in the four flows of cargo ownership, funds, invoices, and contracts, which easily triggers tax bureau inquiries. Once the transaction is deemed non-compliant,not only will the refund be suspended, but the enterprise may also face fines,a downgrade in tax credit rating,or in serious cases,be suspected of tax fraud, affecting all subsequent export business.

Effective risk isolation is very simple: entities without import and export rights do not need to affiliate qualifications and can directly entrust a fully qualified agency to operate. The agency can use its own import and export qualifications to complete the entire process of customs declaration and foreign exchange settlement. As long as the transaction is real and documents are complete,it fully meets compliance requirements.

Finally, here is an exclusive loss-limitation tip: a tax refund risk guarantee agreement must be signed before cooperation. Conducting a trade authenticity verification and document filing in advance can avoid abnormal risks at the root and ensure the tax refund arrives smoothly.

The agency tax refund process involves the verification of import and export declaration qualifications. In the customs clearance integration system, the Operating Unit on the customs declaration needs to possess valid import and export qualifications. If the client has no qualifications, the agency can act as the Operating Unit for declaration, while the Consignor remains the client.

This declaration method fully complies with the latest declaration norms of the General Administration of Customs in 2026 and will not affect valuation and customs clearance processes. It should be noted that if the Operating Unit does not match the tax refund subject information during declaration, the customs declaration information will be invalid and cannot enter the subsequent tax refund process.

This requires deleting the declaration and re-declaring, which not only incurs demurrage fees but also prolongs the tax refund cycle. In operation, it is necessary to confirm in advance whether the agency's Operating Unit qualification is validly filed with Customs, and verify the filling specifications of the Operating Unit and Consignor fields on the customs declaration to avoid logic errors affecting the subsequent tax refund process.

Logistics operations in the agency tax refund process do not require the client's own import and export rights; only the agency needs the corresponding qualifications to arrange booking, customs declaration, loading, and shipment. The client without import and export rights only needs to provide accurate cargo information and consignor and consignee information. The manifest information in the logistics link will correspond to the agency's Operating Unit qualification, meeting the regulatory requirements of Customs and the Maritime Safety Administration.

It should be noted that some freight forwarders are unfamiliar with operation norms for non-qualified clients and may mistakenly fill the client as the Operating Unit, causing inconsistency between manifest information and customs declaration information, resulting in obstructed customs clearance and generating additional costs such as demurrage and detention fees. In operation, it is necessary to confirm the manifest entry rules with the freight forwarder and the agency in advance, clarify the correspondence between the Operating Unit and the Consignor, and synchronize information updates if there is a change of port or vessel, ensuring full-link information consistency and compliance.

Commissioning agency tax refunds without import and export rights is fully compliant at the tax level and does not require the client to possess import and export qualifications themselves. The core of the tax authority's verification is trade authenticity. As long as there is real cargo ownership, compliant invoices, and real foreign exchange settlement, and the four flows are consistent, it meets tax refund requirements.

There is no need to configure additional import and export qualifications or pay maintenance fees for related qualifications. Through reasonable tax structure design, the agency can complete customs declaration and foreign exchange settlement, and then transfer the tax refund to the client, complying with current cross-border tax regulatory requirements without triggering additional VAT or income tax obligations.

It should be noted in operation that fund transfers must follow the real transaction path to avoid capital reflux, which triggers tax authority doubts. Clarifying the fund flow path in advance and ensuring every fund corresponds to a real order can effectively reduce tax risks.

The core of import and export rights is the authority for foreign exchange payment and collection. Under the current CIPS RMB cross-border payment system and the cross-border receipt and payment rules of the State Administration of Foreign Exchange, the agency can use its own qualifications to handle receipt and settlement business for clients without import and export rights, without the client needing to possess foreign exchange payment and collection rights themselves. The client only needs to provide authenticity proof materials such as contracts and invoices corresponding to the transaction, and the agency can complete the receipt and settlement declaration, complying with the SAFE's compliance requirements.

It should be noted that some institutions use offshore accounts to transfer funds privately; this operation does not comply with foreign exchange compliance requirements, will be monitored by SAFE, judged as illegal settlement, and will affect the tax refund process or even freeze accounts. In operation, it must be completed through the formal agency settlement path, and all receipt and settlement information must be entered into the SAFE monitoring system to ensure traceability and verifiability.

In the process of commissioning agency tax refunds, the client without import and export rights does not need to handle qualifications themselves; they only need to clarify the rights and obligations of both parties through a legal entrustment agreement, complying with the relevant provisions of the Foreign Trade Law. The entrustment agreement needs to clarify cargo ownership, tax refund transfer timing, and the risk-bearing subject to avoid cargo ownership disputes or delays in tax refund payments.

It should be noted that some institutions require the client to sign blank authorization documents or set vague clauses in the agreement. After a dispute arises, the client's rights cannot be guaranteed. It is necessary to carefully check the agreement terms, clarify the scope of the agency's responsibility, especially the liability for compensation after tax refund failure, which must be implemented in written terms to protect one's legitimate rights and interests from infringement.

In export tax refund compliance verification, import and export rights are not a prerequisite for the client. The core of agency tax refund verification is document filing and four-flow consistency. As long as the agency possesses valid import and export rights, and the client possesses cargo ownership, issues legal VAT invoices, and has real foreign exchange information, it meets compliance requirements and can pass tax refund verification.

It should be noted in operation that document filing requires retaining the agency agreement, customs declaration, transport documents, foreign exchange receipts, and VAT invoices. Transaction information, cargo information, and amount information in all documents must remain consistent.

If information deviations occur, they will trigger tax authority inquiries. Upon receiving an inquiry notice, active cooperation and provision of real transaction materials can complete the verification smoothly without affecting the normal arrival of the tax refund.

In the customs on-site inspection link, for goods commissioned for agency tax refunds without import and export rights, the inspection process is no different from ordinary export goods. Only the agency needs to arrange corresponding personnel to hold qualification documents to the site to cooperate with the inspection, and the client is not required to provide their own import and export qualification documents. During the inspection process, the main check is whether the cargo name, quantity, and specifications are consistent with the customs declaration information, and the client will not be asked to show their own import and export operation rights proof.

It should be noted that the agency needs to prepare the customs declaration, agency agreement, and other documents in advance. If the goods need to be sent for inspection and appraisal, the agency needs to cooperate with Customs by providing relevant product description materials to ensure the inspection process proceeds smoothly, avoiding inspection delays due to incomplete documents and generating additional storage and demurrage costs, increasing unnecessary export costs.

For small and medium-sized export entities without import and export rights, choosing the agency tax refund mode does not require applying for import and export qualifications themselves, which can save the time cost of qualification application and subsequent annual review and maintenance costs, investing more resources in production and order development. Under the agency tax refund mode, the full process is completed by the agency, and the enterprise does not need to configure dedicated foreign trade operation personnel, reducing labor costs.

Cooperation modes can be adjusted flexibly according to order volume without maintaining qualifications long-term. For small and medium-sized entities that have just started export business and have unstable order volumes, the cost advantage is very obvious. At the same time, they can leverage the agency's compliance experience to reduce risks in the entire export process and improve the enterprise's own capital turnover efficiency, making it more suitable for the initial export development needs of small and medium-sized entities.
