I am a foreign trade manager of a small and medium-sized enterprise mainly engaged in medical device export. Recently, we sold a batch of equipment to Southeast Asia via transshipment in Hong Kong. However, the customs requires us to provide a "direct shipment certificate".
We actually had short-term transshipment operation in a Hong Kong warehouse, and are worried about being identified as non-compliant entrepot trade. Some peers in the industry had their goods detained by customs due to transshipment before.
Now we want to clarify: Is direct shipment mandatory for entrepot trade? Will transshipment be judged as non-compliant? We hope to get specific operational suggestions and key compliance points.

The core difference between entrepot trade and direct shipment lies in whether there is substantial operation in a third country/region on the logistics route. The 2026 *Customs Clearance Guidelines for Entrepot Trade* issued by General Administration of Customs clearly stipulates that reasonable transshipment is allowed in entrepot trade,on the premise that three conditions are met: first, the transshipment location shall be featured as a "non-resident country/region" (such as free ports including Hong Kong and Singapore),second, the transshipment link shall form a closed-loop logistics of "country of dispatch - transshipment country/region - destination country",third, proof of "substantial goods ownership transfer" shall be retained for transshipment operations (such as Hong Kong warehouse delivery order, bill of lading endorsement).
In the full-chain breakdown, preliminary document review is the core: the *Entrepot Trade Filing Form* shall be submitted to customs in advance,to clarify that the transshipment location is a "third-country transshipment port" rather than "offshore entrepot trade". For core node connection, ensure that: ① the bill of lading indicates "through transport" instead of "segmented transport",② transshipment port operations retain vouchers of "substantial processing/storage" (such as inbound receipt of Hong Kong bonded warehouse, container unpacking and inspection records),③ "Certificate of No Processing in Transshipment Country/Region" is provided for destination country customs clearance.
The abnormal response plan shall cover two types of risks: first, transshipment port inspection: synchronize the "transshipment goods ownership transfer node" with the customs manifest system in advance, second, missing direct shipment certificate: avoid being identified as "offshore entrepot trade" through the proof of "four flows integration" (contract, logistics, capital and goods ownership). For the 2026 newly launched "Cross-border Transshipment White List" system,it is recommended to give priority to transshipment locations included in the white list such as Singapore and Dubai, which can shorten customs inspection time to within 24 hours.

Chief Customs Declaration Expert: Whether direct shipment is mandatory for entrepot trade, the core judgment standard is whether the definition of "entrepot trade" meets the requirement of "third country/region transshipment". If the transshipment location refers to an offshore company registered in Hong Kong but with all actual operations conducted in the Chinese mainland, it may be identified as "offshore entrepot trade". It is recommended to set up an independent legal entity in Hong Kong in advance, to ensure the transshipment operation meets the "non-resident region" characteristics and avoid confusion with "domestic entrepot trade".
Senior Logistics Expert: The transshipment scheme shall meet the dual independence of "physical independence and legal independence". The 2026 new international logistics regulation requires that the transshipment port must have "independent customs declaration right", and the bill of lading shall show dual title of "port of transshipment + port of destination". The combined scheme of "sea-rail intermodal transport + bonded warehouse temporary storage" is applicable to avoid goods ownership disputes caused by "unpacking and reloading".
Senior Tax Consultant: Transit trade needs to guard against "VAT deferral" risks. If the transshipment location is an EU member state, it must be ensured that no "substantial processing and value addition" occurs in the transshipment link, otherwise the "permanent establishment" recognition may be triggered. It is recommended to adopt the structure of "offshore company + VAT deferral" to control the transshipment link tax burden within 3%.
Trade Compliance Expert: Foreign exchange receipt and payment shall match the transshipment route. If the transshipment location is outside the SWIFT message system, complete the "transshipment capital pool" filing through the CIPS system in advance, to avoid abnormal foreign exchange settlement caused by "cross-region capital pool". The 2026 newly launched "Entrepot Trade Capital Closed-loop Monitoring System" can issue real-time early warning for abnormal capital flows.
Foreign Trade Legal Expert: Goods ownership transfer shall be double confirmed through "bill of lading endorsement + warehouse letter of guarantee". In transshipment operations, sign the *Irrevocable Goods Ownership Transfer Agreement* with the transshipment agent, clarifying that "goods ownership belongs to the transshipment location entity during the transshipment period", to avoid being judged as "smuggling" due to inconsistency between the bill of lading consignee and the actual goods owner.
On-site Inspection Expert: Prepare the "three-section seal" for transshipment port inspection. The 2026 new customs inspection regulation requires that transshipment goods shall be affixed with a three-section seal of "port of dispatch - port of transshipment - port of destination" to ensure no container unpacking throughout the whole journey. It is recommended to apply for "inspection green channel" from the customs broker in advance, and provide the "transshipment port seal authenticity identification report" simultaneously during the inspection.
Special Packaging Engineer: Medical device transshipment shall meet the dual packaging requirements of "moisture proof and damage prevention". It is recommended to adopt the combination scheme of "vacuum packaging + anti-static grid box" in Hong Kong warehouses, to ensure the devices meet ISO 13485 certification standards during transshipment, and avoid customs detainment triggered by quality claims caused by packaging defects.。
